Dear Commissioners: This request for a Recorded Exemption is submitted by Melvin and Ola Fae Brug. The parcel of land is described as part of the N2 SE4 of Section 29, TSN, R64W of the 6th P.M. , Weld County, Colorado. A single-family dwelling currently exists on proposed Lot A, however, no dwellings currently exist on proposed Lot B. The property is located within the Urban Growth Boundary of the Town of Kersey. The Town verbally responded this proposal did not conflict with their interests. This request is to divide the contiguous land holdings of the applicant into two lots , one which is 22 acres, and the other 28 acres, more or less . The applicant wants to sell the 28 acre tract with the current single-family dwelling upon it, and build another dwelling on the remaining 22 acre parcel. The Department of Planning Services has concerns about this recorded exemption request based on inconsistencies with Recorded Exemption standards as set forth in Section 11.8 of the Subdivision Ordinance. The 160 acres known as the S2 NE4 and the N2 SE4 Section 29, TSN, R64W of the 6th P. M. , Weld County, Colorado, presently has seven parcels with seven residences . The average lot size of this area is under 23 acres. This 160 acre area is zoned A (Agricultural) and has never been platted as a subdivision. However, through the recorded exemption process, the 160 acre tract has been inefficiently divided. Three recorded exemptions have been approved by the Board of County Commissioners. Recorded Exemption 1030 on the 80 acre parcel to the north was denied by the Board of County Commissioners in July, 1987. Two residences were approved to exist on the 80 acre parcel to the south of this 160 acre tract through the Use by Special Review process. The parcel immediately to the west had a recorded exemption approved by the Board of County Commissioners, and the parcel to the northwest of the 160 acre tract also had a recorded exemption approved administratively. 940359 Melvin and Ola Fae Brug RE-1602 April 13, 1994 Any further approvals of recorded exemption applications in this location would distort the intent of the Weld County Subdivision Ordinance. We need to sell our present 3300 sq. ft. home, and we would like to build a smaller 'retirement' home. We like this area, and would like to stay on this land if at all possible. The proposed recorded exemption would not change the use of the land in any way. Each lot would still be used for animal grazing and each lot would have (1) mingle—family home or it. i Descrape. the location, size and present use of the area where each proposed new lot will be created. The property is located approximately 1 mile south of Kersey and is presently a 49.95 acre parcel of land with (1) single-family dwelling. The land is dryland pasture and has been used for animal grazing for many, many, years. Explain how the proposal is consistent with the Weld County Comprehensive Plan and any adopted municipal plan, if applicable. The property is zoned "Agriculture', and is located in an area that the Town of Kersey has designated as a low residential area in its long range Comprehensive Plan. Both lots would be more than minimum lot sizes S. Explain how the uses permitted will be compatible with existing uses surrounding the proposed recorded exemption. The parcel of land on which this request is being made is described as the NW' SKI and part of the NEI SKI of Section 29, TSR R64W of the 6th P.M., Weld County, Colorado. The property is located approximately .75 mile zi southwest of Kersey on Weld County Road 53. The parcel of lend under . consideration is the total contiguous land holdings of the applicant. The request is to divide the property into parcels of 44.89 acres and 5.06 acres, more or less. LS Based upon the submitted information and policies of the County. the Department of Planning Services staff recommends the request be denied for the following reasons: The applicant has not demonstrated that the proposal is consistent with efficient and orderly development. The Brugs originally owned two 40 acre parcels in the SRI of Section 29, TSR, 164W. In 1983 • recorded exemption was approved on one of the 40 acres. resulting in two 20 acre parcels. In 1984 there vas a subdivision exemption recorded which decreased one 20 acre parcel to 10 acres and added 10 acres to the second 40 acre parcel. Ta date, both the 20 acre parcel and the 10 acre parcel have been sold with the Brugs retaining the 49 acres, more or less. This recorded exemption application is for the Bprpose of dividing 5.96 acres off of the 49 acres the Brugs' retained. The Department of • Planning Services staff feels that, sufficient justification has not been given to warrant exempting • lot at this time, and that in the immediate vicinity development has reached • level where continued division of parcels would evade the intent of the Weld r County Subdivision Regulations. • , • Board of County Commissioners A�- April 30, 1986 Page 2 e The applicant has failed to demonstrate that the proposal is consistent with the Weld County Comprehensive Plan. The fact that the parcel is .75 miles southwest of Kersey should net allow haphazard development to take place. As stated on page V of the Weld County Comprehensive Plan the purpose of the Comprehensive Plan is for the ..."general purpose of guiding and accomplishing a coordinated, adjusted and harmonious development of the county...which, in accordance with p and future needs and resources, will but promote...efficiency and economy in the process of development, including such distribution of population and uses of land..." The applicant has not demonstrated that the proposal is consistent with the intent of the agricultural zone district , nor does it comply with minimum lot size requirements. The minimum lot size in the Agricultural Zone district is 80 acres for irrigated land and 160 acres for dryland. Agriculture in Weld County is Considered a valuable resource which must be protected from adverse impacts resulting from uncontrolled and undirected residential land uses. The y: Agricultural Zone district was established to maintain and promote agriculture as an essential feature of Weld County. It is intended to provide areas for the conduct of 14 agricultural activities without the interference and encroachment of other more intensive land uses. The property is located approximately 1/2 mile south of Kersey on the west side of Weld County Road 53. The parcel of land under consideration is the total contiguous land holdings of the applicant. It is the opinion of the Department of Planning Services' Staff that sufficient justification has not been given to warrant exemption of a lot at this time, and that in the immediate vicinity development has reached a level where continued divisions of parcels would evade the intent of the Weld County Subdivision Regulations. In this section, seven Recorded Exemptions have been approved and an additional 18 Recorded Exemptions have been approved in adjoining sections, creating land splits and residential building sites. The Department of Planning Services Staff Las concerns about the amount of development in the immediate vicinity and the potential for continued divisions of parcels which will Increase the residential density in the area. The Agricultural Zona District was established to maintain and promote agriculture as an essential feature of Weld County. It is intended to provide areas for the conduct of agricultural activities with out the interference and encroachment of other more intensive land uses. The proposal is consistent with the intent of the zoned district because the use of the land will not change. As indicated in the application, the land is not irrigated and has only sparse vegetation. It is presently suitable, therefore, for only very limited grazing. Lot A will continue to be used for the same purposes. The intent behind the recorded exemption is to allow someone to live in the country on a ten-acre tract and to raise one or two horses, cattle or sheep. The tract is likely to be most desirable to a family with children interested in participating in 4-H activities. There are many excellent 4-H clubs in the community, and our children as well as the children ' of a number of the neighbors are actively involved in 4-H clubs. The intent of the A District is to preserve agriculture as a valuable resource, and the limited agricultural use of the land t will be preserved.
