RESOLUTION RE: APPROVE AMENDED SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR THE EXPANSION OF A KENNEL AND BOARDING FACILITY IN THE A (AGRICULTURAL) ZONE DISTRICT, NOT TO EXCEED 140 DOGS AND 20 CATS - STEPHANIE STOKES WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 20th day of May, 1992, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Stephanie Stokes, 14253 Highway 392, Greeley, Colorado 80631, for an Amended Site Specific Development Plan and Special Review Permit for the expansion of a kennel and boarding facility in the A (Agricultural) Zone District, not to exceed 140 dogs and 20 cats, on the following described real estate, to-wit: Part of the SWe, Section 16, Township 6 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Tom Hellerich, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. This proposal is consistent with the Urban Growth Boundary Goals and Policies of the Weld County Comprehensive Plan. The proposed expansion is located within the urban growth boundary of the City of Greeley. The City of Greeley Planning Commission has reviewed this proposal and found no conflict with its interests. This proposal is consistent with the intent of the A (Agricultural) Zone District and is provided for as a Use by Special Review. c. This proposal will be compatible with the future development of the surrounding area which is expected to remain agricultural. d. Special Review Development Standards will make the proposed expansion compatible with the existing surrounding land uses which include irrigated agricultural production and rural residences. e. No overlay districts affect the site. f. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for the expansion of a kennel and boarding facility in the A (Agricultural) Zone District, not to exceed 140 dogs and 20 cats, on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Within 30 days of approval by the Board of County Commissioners, the applicant shall submit a report prepared by a Colorado Registered Professional Engineer regarding the adequacy of the existing septic system to handle the increased demand caused by the proposed expansion. The Site Specific Development Plan and Special Review Permit is for a boarding kennel in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and limited to 140 dogs (including puppies under the age of 6 months) and 20 cats subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. The boarding kennel facility shall be constructed and operated in compliance with the requirements of the State of Colorado Health Department. 4. Trees along the north side of the property shall be located a minimum of 35 feet from the edge of the Greeley No. 2 Canal. 5. All dogs and cats on the property shall be allowed in outdoor runs between the hours of 7:00 a.m. and 9:00 p.m. only. 6. The applicant shall remove, handle, and stockpile manure in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. The manure storage site shall have a water-tight surface which does not permit seepage or percolation of manure pollutants into the ground. 7. No permanent disposal of wastes shall be permitted on this site. 8. Fugitive dust shall be controlled on this site. 9. The maximum permissible noise level shall not exceed the residential limit of 55 dB(A) as measured according to 25-12-102, Colorado Revised Statutes. 10. Adequate toilet facilities served by an individual sewage disposal system shall be maintained on site. Any new or existing sewage disposal systems shall be designed and maintained in compliance with Weld County Individual Sewage Disposal Regulations. 11. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 12. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 920435 DEVELOPMENT STANDARDS - STOKES PAGE 2 13. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 14. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 15. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 16. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 920435 HEARING CERTIFICATION DOCKET NO. 92-25 RE: AMENDED SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR THE EXPANSION OF A KENNEL AND BOARDING FACILITY IN THE A (AGRICULTURAL) ZONE DISTRICT, NOT TO EXCEED 140 DOGS AND 20 CATS - STEPHANIE STOKES A public hearing was conducted on May 20, 1992, at 10:00 A.M. , with the following present: Commissioner George Kennedy, Chairman Commissioner Constance L. Harbert, Pro-Tem - Excused Commissioner C. W. Kirby Commissioner Gordon E. Lacy Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Bruce Barker Planning Department representative, Brian Grubb The following business was transacted: I hereby certify that pursuant to a notice dated May 4, 1992, and duly published May 7, 1992, in the Windsor Beacon, a public hearing was conducted to consider the request of Stephanie Stokes for an Amended Site Specific Development Plan and Special Review Permit for the expansion of a kennel and boarding facility in the A (Agricultural) Zone District, not to exceed 140 dogs and 20 cats. Bruce Barker, Assistant County Attorney, made this a matter of record. Commissioner Lacy recommended the Resolution of the Planning Commission and the Planning staff's recommendation be entered into the record as written. Tom Hellerich, Attorney, represented the applicant and stated they were agreeable to this. Mr. Hellerich explained there are currently 80 dogs and 20 cats, and he used a map to show the proposed expansion. He said there were six additional kennels built when Stephanie Stokes, applicant, bought the facility; however, no further additions have been constructed since Planning staff recommended an amended permit. Mr. Hellerich explained the expansion includes additional kennels, shrubbery, exercise areas, and a security fence. An additional 40 runs are proposed, to be constructed in two phases. Activities will also be expanded to include three one-hour training classes per week, to be held Tuesday evenings between 6:00 and 7:00 p.m. , Thursday evenings between 7:00 and 8:00 p.m. , and Saturday mornings between 9:00 and 10:00 a.m. Parking will be allowed on the premises only, and there are two accesses. Mr. Hellerich gave a brief background on Ms. Stokes, saying she has 26 years of experience with dogs, and 12 of those years were in management. He said the existing utilities and septic are adequate; however, they will be inspected by an engineer within 30 days of approval. Mr. Hellerich said the Eaton Fire Protection District has recommended approval, the runs are cleaned and disinfected daily, and all trash and manure is disposed of off-site. He said there will be three full-time and two part-time employees, and the hours of operation are 8:30 a.m. to 5:30 p.m. Mr. Hellerich said the dogs are currently allowed to be outdoors until 8:00 p.m. ; however, they would like to change the time to 9:00 p.m. for the summers. He said there will also be eight sheep and four goats on seven acres of the property for training purposes. Mr. Hellerich said they have read and agree with all recommended Conditions of Approval and Development Standards with the exception of Development Standard #5, which concerns the hours allowing the dogs to be outdoors. Ms. Stokes said she would like the hours to be changed to from 8:00 a.m. to 8:00 p.m. , to 7:00 a.m. to 9:00 p.m. In response to questions from Commissioner Lacy, Ms. Stokes explained that the dogs are mainly trained to work sheep and goats. She said the fence constructed for the sheep and goats will probably be barbed wire; however, she is still checking into that matter, and there will be no training in 920435 cc- ('L RE: HEARING CERTIFICATION - STOKES PAGE 2 that area, only grazing. Ms. Stokes said she could add a shelter for the sheep and goats if necessary. Brian Grubb, Planning Department representative, said that matter could be handled by a letter to staff. Mr. Barker suggested that be included as a condition of approval, to be added to the plat before recording. During discussion concerning planting trees along the ditch, Mr. Hellerich said there is a Development Standard requiring the trees be planted 35 feet from the edge of the ditch. In response to a question from Commissioner Webster, Ms. Stokes said the dogs will be confined after the proposed shelters are built, which should take care of the barking problem. There was no public testimony offered concerning this matter. Commissioner Lacy moved to approve the request of Stephanie Stokes for an Amended Site Specific Development Plan and Special Review Permit for the expansion of a kennel and boarding facility in the A (Agricultural) Zone District, not to exceed 140 dogs and 20 cats, based on the recommendation of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record, with Development Standard #5 to be changed to allow the dogs to be outdoors between the hours of 7:00 a.m. and 9:00 p.m, and to include the conversation regarding the proposed shelter for the sheep and goats. The motion was seconded by Commissioner Webster, and Chairman Kennedy stated he was opposed to changing the hours. The motion carried three to one, on roll-call vote, with Chairman Kennedy voting nay. It was clarified that Ms. Stokes is not required to build a shelter for the sheep and goats; however, if a shelter is constructed, it shall be approved by Planning staff. The existing kennel operation and the property described in the application, was approved by the Board of County Commissioners, by resolution dated August 2 , 1985. The present facility was built shortly after approval by the Board of County Commissioners, and provides presently for a kennel facility for 80 dogs and 20 cats. Because of increased requests and demands, the applicant desires and requests to expand the operation, to include an additional 28 runs, to provide facilities for a total of 140 dogs, 20 cats. This would consist of an expansion on to the existing kennel facility, to provide for the additional 40 runs, which would be built in accordance with the existing specifications in accordance with the existing facility. These new runs would be indoor and outdoor exercise areas and an outdoor run associated with each indoor run. In addition, the applicant proposes six additional large runs, approximately 32 ' x 32 ' , and six additional outdoor runs, approximately 10' x 40 ' , and a large exercise area, approximately 150 ' x 95 ' . Exterior fencing around the new runs and exercise area would be 6' tall, and would be connected to the main kennel through fencing and gates, to provide that all dogs would be housed indoors during the night. The applicant also anticipates and intends to hold dog training and showmanship classes, during the months of good weather, a maximum of three times per week, and a maximum of 20 dogs per class. Each class would take approximately one hour, and would be held on Tuesdays, 6:00 to 7: 00 P.M. , Thursdays, 7 : 00 to 8: 00 P.M. , and Saturdays, 9:00 to 10: 00 A.M. The applicant anticipates that upon completion of the addition to the facility, the facility will have the capability of housing 140 dogs and 20 cats and will consist of approximately 80 runs, indoor and outdoor, directly attached to the kennel building. The applicant anticipates to operate and accommodate the facilities will consist of the applicant and a maximum of five employees which includes two part-time employees. The hours of operation, would be 8 : 30 A.M. , to 5: 30 P.M. The applicant anticipates that the dogs will be indoors between the hours of 9: 00 P.M. , and 7: 00 A.M. The employees would work during the hours of 8 : 00 A.M. , to 5: 30 P.M. , and the applicant/owner would be on the property 24 hours a day. Utilities are already existing to the premises, including the two residences and the existing kennel facility. The current water source is from North Weld County Water District. Adequate water is available for the expansion of the additional 28 runs, as evidenced by a letter from the Water District attached hereto, marked Exhibit "B" . All other utilities for electrical, gas and telephone presently exist on the property and are adequate for the expansion. The existing residence on the premises as well as the office and kennel facility, are all serviced by a large septic system. The septic system has been previously approved by the Weld County Health Department. At the time of the addition of the existing kennel facility, an expansion was made of the septic system to 2 provide adequate size to accommodate the kennel, anticipating there would be a total of 80 runs at the kennel facility. Thus, the applicants believe that the existing septic system is adequate to handle all normal waste, including the expansion, through this septic system and there will be no waste stockpile or storage areas associated with the proposed expanded use. As indicated, the property is located five miles west of Lucerne on Colorado State Highway 392 . Customers of the boarding facility and classes will be able to use the existing driveway and accesses, which accommodate the existing facility. The expanded facilities will not require additional access to the property. The residence that exists on the property, has a separate driveway, and will continue to provide access to the residence. Adequate area is available to accommodate all anticipated customers for parking on the property and off of adjoining highways. Through past experience the applicant believes there will only be standard size vehicles used by its customers, and will not cause additional congestion or traffic flow on Highway 392 . No parking will be allowed on State Highway 392. Applicant believes that the vehicular traffic will be insignificant, and in addition to the customers, the only traffic anticipated will be for standard trash removal. The property is located within the Eaton Fire District and adequate fire protection is provided by the District. The existing kennel building is concrete block structure, and the expanded addition will be concrete structure and will have very high fire resistance. The applicant does not anticipate any additional storm water retention facilities will be required on the property as adequate drainage presently exists and the existing storm water retention facilities and disposal will not be interfered or altered by the operation of the facilities or by the construction of the expansion. In addition, for training purposes, the applicant anticipates from time to time there may be up to 8 sheep and 4 goats on the property which will assist the applicant in training activities. The kennel facilities will continue to be sanitized regularly in accordance with Colorado Health Department regulations, and any regulations of the County Health Department. The facilities and runs will be cleaned several times daily, according to individual pet requirements in addition to the Health Department regulations. As indicated, normal household waste will be picked up on a weekly basis by a commercial disposal service, and no waste of any nature will be stored on the property or stockpiled. The applicant anticipates that the facility can be expanded in two phases, consisting of Phase I for 20 new runs, fencing and 3 C)"n individual enclosed dog shelters to commence in 120 days and take approximately 90 days to complete. Phase II would commence in approximately 18 months and would consist of an additional 20 runs, for a total of 40 runs added on to the existing building. This time schedule includes the installation of all necessary facilities and/or utilities. The applicant anticipates planting of additional trees for windbreaks, erosion control, decoration and possible noise control. Additional landscaping measures include planting of some shrubbery, grass, flowers and trees to compliment the existing landscaping. The applicant does not anticipate any reclamation procedures would be required upon cessation of the use by special review. The applicant' s proposal for a boarding and training facility in an agriculturally zoned area is consistent with a comprehensive plan. There presently exists a boarding facility on the site, approved by the Board of County Commissioners and the applicant only desires to expand the facilities. This use is consistent with the intent of the agricultural district which anticipates such activities as those proposed by the applicant. At present, the neighboring lands are used for agricultural purposes, including the production of crops, pasturing of animals and livestock and a dairy facility nearby. The Weld County Zoning Ordinances provide that the use by special review in the A District contemplates uses such as veterinary clinics or hospitals, animal training and boarding facilities and the keeping, raising and boarding of exotic animals. These specific uses with other uses by right in the agricultural zoned lands are consistent with the intent and current uses of the property and are consistent with the Weld County Comprehensive Plan. At present, the property described in the application is being used for its best purpose as a boarding facility. A proposed expansion of the facilities will enhance the appearance of the property, and will provide additional services needed by the County. The expanded use, will not take agricultural land out of production, but will in effect, conserve productive agricultural land and put the property to it's best use. Adequate provisions have been made in the existing construction of the facilities for the protection of the health, safety and welfare of the inhabitants of the neighborhood and the County. Rigid sanitation methods have been applied in the past in accordance with the Colorado Health regulations and these guidelines will continue to be strictly enforced by the applicant. The kennel facilities will provide indoor facilities for all animals, and will be totally fenced in. Exercise areas, both indoors and outdoors, will likewise be fenced. A sketch of the proposed expanded facility is attached hereto, marked Exhibits "C" and "D" . As indicated in the exhibits, indoor and outdoor runs will be totally enclosed to prevent the escape or straying of any animals at the facility. In addition, the office area, residence and kennel will have exterior fencing around their perimeter made of chainlink fencing, six feet in height, to protect neighboring 4 or ft,;Si"A properties as well as the animals. Animals will be confined to fenced areas and the kennel at all times except when being transported to and from vehicles. At such time of transporting of any animals, all animals must be leashed. Internal health safety protections include solid dividing wall between kennels and runs to protect animals from each other and to eliminate any potential noise created by animals. In the event of excessive barking by any dog, confinement rooms containing several kennels are included in the facilities to insure that the facility will conform to all required noise levels. The proposed use, will be in compliance with all future developmental plans of the surrounding area including any master plans of the nearby municipalities. As a further protection against noise to protect the health, safety and welfare of the neighboring property owners, all animals will be kept indoors during nighttime hours. The soil report prepared by the Soil Conservation Service indicates that the soil is type 32 (Kim Loam 1 2 TO 3% slope) and has moderate strength. The Service has indicated that there will be no problems with the proposed building and many larger buildings were built on soil of this strength. The applicant has examined and found that the property proposed in the application at the time of the original approval of the use by special review and presently, does not lie in any flood plain, geological hazard area, or the Weld County Airport Overlay District area.
