RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 1503 - CHASE AND BAXTER INVESTMENTS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 3D-28-101(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 1503, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption No. 1503 was submitted by Chase and Baxter Investments for property which is located in part of the E; of the SEa of Section 21, Township 4 North, Range 68 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 71.94 acres and 8.90 acres. NOW, THEREFORE, BE IT RESOLVED by the Board 9f County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. 2. A Weld County septic permit is required for any proposed home and its septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 3. Dear Commissioners: This recorded exemption is submitted by Chase and Baxter Investments. The parcel of land is described as the east half of the southeast quarter of Section 21, T4N, R68W of the 6th P.M. , Weld County, Colorado. The property is located north of Weld County Road 42, west of Weld County Road 7. This request is to divide an 80.84 acre parcel of land, which is the total contiguous land holdings of the applicant, into two lots of 71.94 acres and 8.90 acres, more or less. It is the opinion of the Department of Planning Services' staff that this request should be denied. Three other recorded exemption applications have been approved in the south half of this section since 1976, making a total of 8 parcels in this half section. The staff wants the Board to be aware of the level of development and the potential for continued divisions in this area. The proposal is not consistent with efficient and orderly development. The applicant has not shown that a legal access exists to the proposed smaller lot. The proposal as presented shows an access crossing a lot to the north to serve the proposed smaller lot. A copy of the letter from the water district is submitted. 11.3.7 The lots of the proposed Recorded Exemption will utilize septic systems. The septic systems will be constructed in accordance with the Weld County ISDS regulations. 11.3.8 Proposed Lot A (8.90 acres) is currently growing alfalfa, primarily for weed control. Proposed Lot B (71.94 acres) is growing winter wheat. There are no existing structures on either Lot A or Lot B. 11.3.9 The recorded exemption is proposed to allow the 80.84 acre tract to be split into two tracts. The Little Thompson River forms a physical barrier dividing the 80.84 acres into 71.94 acres and 8.90 acres. The northern 8.90 acres cannot be farmed efficiently with the southerly 71.94 acres. As noted previously, it is in alfalfa principally for weed control. The northerly parcel is essentially non-productive land and the owner wishes to sell this land for a single family dwelling homesite. The remaining 71.94 acres will continue to be farmed as it presently is. A residential dwelling may be constructed on the 71.94 acres; however, efforts will be undertaken to minimize the removal of productive agricultural land. 11.3.10 The new lot is proposed on the north side of the Little Thompson River. It is 8.90 acres and is in alfalfa, primarily for weed control. 11.3.11 The proposal is consistent with the Weld County Comprehensive Plan. The Plan allows for a property owner to sell off agricultural land that is non- productive for one single family dwelling homesite. The remainder of the property will continue in agricultural production. Compliance with any adjacent municipality's adopted plan is not applicable, since the site is not located within 3 miles of any municipality. -1- 930586 11.3.12 The proposed recorded exemption is compatible with the surrounding uses which consist of agricultural, residential and oil and gas production. Proposed Lot A will be residential and proposed Lot B will be agricultural and residential. 11.3.13 The intent of the Agricultural zoning district is to preserve land for agricultural activities. Lot B will continue to be farmed as it is presently. Lot A is essentially non-productive land. 11.3.14 The proposal is not inconsistent with efficient and orderly development. Access to proposed Lots A and B will remain unchanged as it exists today. Access to Lot A is via an easement located on Weld County Road 7, just north of the bridge across the Little Thompson River. 11.3.15 A sketch map is submitted. Section 11.8 - Recorded Exemption Standards 11.8.1 The water supply for the proposed recorded exemption will be supplied by the Little Thompson Water District. 11.8.2 The proposed recorded exemption will utilize a septic system. The septic system will comply with the Weld County ISDS regulations. 11.8.3 Adequate legal access to a public road exists for both proposed lots. An easement to Lot A is included in the deed for the property. Lot B has direct access to both Weld County Road 7 and Weld County Road 42. 11.8.4 The recorded exemption complies with Section 50 of the Weld County Zoning Ordinance. The site is not located in a Geologic Hazard Area nor in the Airport Zone. The site lies partially in a flood zone; however, residential structures will not be constructed in a flood zone, or an application for a Flood Hazard Development Permit will be submitted. 11.8.5 Both proposed lots exceed the minimum 1 acre lot size. 11.8.6 It is understood by the applicant that conditions may be applied to the recorded exemption approval in order to address concerns of referral agencies or to mitigate impacts. 2 11.8.7 This recorded exemption submittal is the total contiguous land ownership of -the applicant. 11.8.8 The proposed recorded exemption is not part of recorded exemption application submitted within the last five (5) years. 11.8.9 The proposed recorded exemption is not part of an approved subdivision, or recorded subdivision plat or unincorporated community. 11.8.10 The proposed recorded exemption does not evade the purposes of the Subdivision Ordinance. Currently we have a 1" diameter water line in the area with no additional capacity available. A main line extension consisting of about 2500 ft of 6" diameter water line will have to be installed in order to provide domestic water service. If fire flow is to be addressed, more extensive improvements will be necessary. As per our discussion yesterday, the District will participate in a line extension to provide domestic water service. Our cost share policy defines your participatory amount as $3 .50 per foot of line extension necessary. This amount DOES NOT include a tap fee (currently $4, 000 for a standard 5/8" X 3/4" residential tap) . We are limited as to the number of projects per year that we can participate in (budget restrictions) , and these requests are handled on a first-come, first-serve basis. Stumpf sold an 80 acre parcel of land located south of your land to Mr . Louis Hart . It was understood at the time of the transaction that a right of way to a parcel of land which is approximately seven acres had been in existence and use for a long period of time far in excess of twenty years . The right of way that is being made reference to cuts across the southeast corner of your parcel of land . The Stumpf estate still holds a deed of trust against said land . Mr . Hart has advised us that you have recently plowed up the right of way and bulldozed several ditches across the right of way which actions prevent Mr . Hart from making use of the right of way . Under Colorado law, the use of this right of way would have brought about an easement by prescription which easement and right of way would be conveyed to Mr . Hart when the land was sold . It is this firm ' s opinion that the right of way would be quite valuable to this 7 acre piece of land . The land is easily accessable by this right of way and , therefore , convenient to farm . I have discussed this matter with Mr . Hart . He has offered to place a gate along the County road where the right of way enters into your land at no expense to yourself . Mr . Hart is also willing to furnish you with a key to said gate . Mr . Hart is also willing to fill in the ditches so he can make use of the right of way . It would be appreciated if you would contact this office within ten days from the date of this letter to determine your willingness to resolve the matter as set forth above .
