RE: CERTIFICATION OF CLAIM TO WELD COUNTY TREASURER, PURSUANT TO
SECTION 35-4-107 (3) , C.R.S.
WHEREAS, the Board of County Commissioners o£ Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, pursuant to Section 35-4-107 (1) , C.R.S. , Mr. Ron
Erode, the Weld County Pest Inspector, mailed to Phillip and Reba
Lukas, P. O. Box 84 , Severance, Colorado 80646 , a "Ten Day
Notice, " requiring the Lukases to remove a diseased tree located
on property owned by them and described as the Southeast Quarter,
Southeast Quarter of Section 35 , Township 7 North, Range 67 West
of the 6th P.M. , Weld County, Colorado, and
WHEREAS, a copy of said Ten Day Notice was also attached to
the front door of their residence located at 10845 Weld County
Road 74 , Severance , Colorado, and
WHEREAS, the Lukases failed to remove said tree , and
therefore, Mr. Broda requested that the Board of County
Commissioners of Weld County grant him a right of entry onto the
property in order to remove said tree, and
WHEREAS , the Board granted said right of entry by Resolution
on July 9 , 1990 , and
WHEREAS, said diseased tree was cut down and removed by
Jackson Tree Service on July 11 , 1990 , and
WHEREAS, a bill for said services by Jackson Tree Service was
given to the Weld County Pest and Weed Department on July 12 ,
1990 , and
WHEREAS , a bill requesting that the Lukases pay the bill
submitted by Jackson Tree Service was mailed by certified mail to
the Lukases on August 2.1, 1990, and
WHEREAS, said bill was returned unclaimed on September 4 ,
1990 .

NOW, THEREFORE, BE IT RESOLVED by the Board o£ County
Commissioners of Weld County, Colorado, that pursuant to the
provisions of Section 35-4-107 (3) , C.R.S. , the Board finds that
Phillip and Reba Lukas were notified of the bill to be paid for
the tree removal in the amount of $195 .00; however, the Lukases
have failed to pay said bill , and therefore, it shall be extended
to the Weld County Treasurer and shall be collected thereby as
delinquent taxes , pursuant to Section 35-4-107 (3) , C.R.S.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 24th day of
September,, A.D. , 1990 .

RE: Bill for enforced control of Dutch Elm diseased tree on Phillip and
Reba Lukas' property
As you are aware Bruce, the Pest and Weed Department had a Dutch Elm
diseased tree cut down and removed from the Lukas' property, as per CRS
35-4-107(2) . The following information outlines the chain of events from
initial contact with the Lukas' to submission of the enforcement bill .
1) Personally spoke with landowner at their property on
September 25 and December 5, 1989.
2) A ten-day notice for removal of tree was mailed to Lukas'
on 6/19/90 and a copy was put on their front door
(attached) .
3) Request for Right of Entry was submitted to County
Commissioners on June 28, 1990 (attached) .
4) I know that a Right of Entry was requested but I do not
have a copy of the resolution.
5) The diseased tree was cut down and removed by Jackson Tree
Service on 7/11/90 (bill attached) .
6) Bill was sent by certified mail to the Lukas' on 8/21/90.
7) Bill was returned unclaimed on 9/4/90 (attached) .
This bill now needs to go through the County Commissioners and then to
the County Treasurer's Office to be added to the taxes of the property, as
per CRS 35-4-107(3) .

OF THE NEED FOR REMOVAL OF

This notice is in accordance with C.R.S. Section 35-4-107 (1984 Repl. Vol.
14) . Dutch Elm Disease was discovered to infect a tree on your property
at:
SE4 SE4 of SEC 35 T7N R67W
Parcel x/07053540011 and 07053540005
The diseased tree has been marked with orange iridescent paint. This Dutch
Elm diseased tree must be eliminated by cutting the tree down at ground
level and either debarked, burned or buried.
If the tree is not cut down by June 29, 1990, then the County Pest
Inspector will cause the work to be done pursuant to Section 35-4-107(2) .
You will be billed for the cost of the control in accordance with Section
35-4-107(3) .
You have a right to request in writing a hearing before the Board of County
Commissioners within ten (10) days of the notice should you wish to dispute
the findings of infection/infestation of the Pest Inspector.

Dear Weld County Commissioners ,
I am seeking your approval under the Pest Control Law, CRS
35-4-107(1) , to enter upon the land listed below, to remove a Dutch Elm
Diseased tree. The diseased tree is located at:
Phillip & Reba Lukas
T7N R67W SEC 35 SE4 SE4
Parcel #07053540011 and 070535400005
I personally contacted the landowner three (3) times in the Fall of
1989 and no action was taken by the landowner. A notice for removal of the
tree has since been sent to the landowner and again no action has been
taken. If this tree is allowed to stand it will be a source of infection
for other elms in northern Weld County, I wish to have this tree removed
at the landowners expense, pursuant to CRS 35-4-107(3) .

If this bill is not paid within 30 (thirty) days, this bill
will be given to the County Assessors office to be added to the
tax rolls of the property, as per CRS 35-4-107(3) .
You may file a written protest to appear before the Board of
County Commissioners. The written protest must be filed with the
Board within 30 (thirty) days of the date of this notice. If you
decide to file such a notice within the 30 (thirty) day period, the
Board will establish a hearing no later than 90 (ninety) days hereafter.
