RE: APPROVE NINE NON-FINANCIAL COORDINATION AGREEMENTS BETWEEN EMPLOYMENT
SERVICES AND VARIOUS EDUCATIONAL INSTITUTIONS IN WELD COUNTY AND AUTHORIZE
CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with nine Non-Financial Coordination
Agreements between the County of Weld, State of Colorado, by and through the
Board of County Commissioners of Weld County, on behalf of Employment Services,
and various educational institutions in Weld County as follows:
Aims Community College School District RE-8
School District RE-5J School District RE-7
School District RE-1 School District RE-10
School District RE-12 School District RE-3J
School District RE-2
WHEREAS, said agreements are subject to the terms and conditions being as
stated in said agreements, and
WHEREAS, after review, the Board deems it advisable to approve said
agreements, copies of which are attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that nine Non-Financial Coordination Agreements between the
County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of Employment Services, and various
educational institutions in Weld County as listed above be, and hereby are,
approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said agreements.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 21st day of March, A.D. , 1994.

Subject: Non-Financial Coordination Agreements with Educational Institutions
Enclosed for Board approval are nine (9) Non-Financial Coordination Agreements between
Employment Services and the following educational institutions in Weld County:
Aims Community College School District RE-8
School District RE-5J School District RE-7
School District RE-1 School District RE-10
School District RE-12 School District RE-3J
School District RE-2
The Non-Financial Coordination Agreements outline the different areas in which services
to youth can be provided through coordination between the various schools and
Employment Services. Services to adults and youth will be provided through
coordination between Aims Community College and Employment Services.
The Agreements also describe different areas of responsibility and expectations which
provide youth who drop out of school with an avenue through which they can access
services.

NON-FINANCIAL AGREEMENT
BETWEEN SCHOOL DISTRICT RE-3J AND
EMPLOYMENT SERVICES OF WELD COUNTY
THIS AGREEMENT, made and entered into this 22 day of February , 1994, by
and between the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, on behalf of Employment Services of Weld
County, hereinafter referred to as "Employment Services", and Weld County School
District RE-3J, hereinafter referred to as "School District RE-3J".
Employment Services offers employment and training services to unemployed,
underemployed, and economically disadvantaged youth (ages 14-21) and adults of
Weld County.
Employment Services wishes to expand its competency program efforts and
placement activities on behalf of youth who are eligible to participate in the
Youth Programs, Summer Job Hunt Program, and Summer Employment and Training
Program.
School District RE-3J has expressed the desire to work with Employment
Services to assist youth in accessing the above mentioned services.
In consideration of the mutual promises and covenants contained herein, the
parties hereto agree as follows:
I. TERM
The term of this agreement shall be for a period beginning February 1994
and is subject to the provisions of paragraph V herein and future written
modifications requested by either of the parties.
II. ELIGIBILITY
Services shall be provided to economically disadvantaged youth who are
enrolled in or are returning to School District RE-3J and who meet the
criteria and demonstrate the motivation to complete the program in which
they may be enrolled.
The School District RE-3J contact shall target outreach efforts to those
at-risk who have additional barriers such as teen parents, offenders, and
youth who are in foster/group home care.
III. SCHOOL DISTRICT RE-3J RESPONSIBILITIES
The following roles and responsibilities shall be assigned to School
District RE-3J in the implementation of this Agreement.
A. School District RE-3J shall establish a school contact in the
district, which will provide the following services:
1. Assist in initial assessment and outreach to identify youth
which may benefit from programs under the Job Training
Partnership Act (JTPA) . The youth will be screened using the
JTPA In-School Student Profile located as Attachment A.

2. Refer youth to Employment Services staff, when appropriate, to
complete JTPA applications.
3. Assist Employment Services staff, as appropriate, in obtaining
necessary eligibility documentation (see Attachment B) and
initial assessment information, such as attendance records,
transcripts and achievement test scores needed for initial
assessment.
4. Initiate Educational/Supportive Services Plan, located as
Attachment C, for each youth determined to be eligible for
JTPA youth services. A copy of this Plan will be provided to
Employment Services within two weeks of eligibility
determination by Employment Services staff.
5. Whenever possible, assist with coordinating services as needed
with other area agencies.
6. Assist with updates on Educational/Supportive Services Plan,
approximately every six months.
7. Assign support staff, as necessary, to assist school contact
with information gathering and coordination of services.
8. Provide advisory services or referral to counseling services
as needed by the youth.
9. Assist in the development of working relationships between the
School District RE-3J staff and Employment Services Youth
Staff.
10. Assist with bi-monthly school performance reports for those
youth who are placed on subsidized job training.
11. Assist Employment Services Youth Staff with accessing school
space for counseling and/or testing students if needed.
12. Identify to Employment Services Youth Staff the names and
contact information of students when they drop out.
IV. EMPLOYMENT SERVICES RESPONSIBILITIES
A. Employment Services shall provide to the school contact the
following services:
1. Participate in the common assessment and appraisal of each
applicant including the determination of the appropriateness
of Employment Services Programs.

2. Assist in determining what services are needed by youth based
on information obtained in assessments and arrangements for
such services as available.
3. Develop the employment and training plan for the youth and
forward copies of the Plan to the school contact.
4. Provide competency training to youth, when appropriate, in
pre-employment and work maturity skills, basic skill
development, work experience, and other program activities as
appropriate and identified in the Plan.
5. Assist in selecting and referring, where appropriate,
qualified youth applicants for available subsidized and
unsubsidized placement openings and competency program
openings provided by Employment Services.
6. Refer youth not eligible or appropriate for JTPA Programs to
Job Services or other agency services.
7. Follow-up, under the direction of the school contact, with
each client and verify services provided or the lack of
services provided.
8. Assign a staff person to work with School District RE-3J.
9. Provide training for the school contact and other interested
School District RE-3J personnel.
10. Explore and make available opportunities for qualified youth
in all services of Employment Services (Job Opportunities and
Basic Skills Program, The Educational Opportunity Center,
etc.) .
11. Support school contact in developing positive relationships
with school personnel.
12. Contact employers to develop employment training sites for the
youth when appropriate.
13. Maintain records for employment training incentive awards and
issue checks to youth.
14. Intervene and/or counsel youth with employment related
problems.
15. Intervene and counsel youth to provide incentive to improve
school performance.
16. Continually assess the effectiveness of the Agreement.

V. TERMINATION OF AGREEMENT
Either party may terminate this Agreement without cause be giving 30
calendar days written notice to the other party. Termination may also
result automatically upon loss of funding for the services contemplated
herein by either the County of Weld, State of Colorado, or School District
RE-3J.
VI. MODIFICATION OF AGREEMENT
All modifications to this Agreement shall be in writing and signed by both
parties.
VII. ASSURANCES
A. School District RE-3J agrees that its officers, employees, and
clients do not become employees of the County of Weld, State of
Colorado and, therefore, are not entitled to any employee benefits
as Weld County employees as a result of the execution of this
Agreement. Similarly, the County of Weld, State of Colorado agrees
that its officers, employees, and clients do not become employees of
School District RE-3J and, therefore, are not entitled to employee
benefits of School District RE-3J as a result of the execution of
this Agreement.
B. The County of Weld, State of Colorado, the Board of County
Commissioners of Weld County, its officers, and employees shall not
be held liable for injuries or damages caused by any negligent acts
or omissions of School District RE-3J, or of its employees,
volunteers, or agents while performing the tasks as set forth in
this Agreement. School District RE-3J shall indemnify, defend, and
hold harmless the County of Weld, State of Colorado, the Board of
County Commissioners of Weld County, its officers, and employees for
any loss occasioned as a result of the performance of the services
set forth in this Agreement by its employees, volunteers, clients,
and agents. Similarly, School District RE-3J shall not be held
liable for injuries or damages caused by any negligent acts or
omissions of the County of Weld, State of Colorado, the Board of
County Commissioners of Weld County, its employees, volunteers, or
agents while performing the tasks as set forth in this Agreement.
The County of Weld, State of Colorado shall indemnify, defend, and
hold harmless School District RE-3J, its officers and employees for
any loss occasioned as a result of the performance of the services
set forth in this Agreement by its employees, volunteers, clients,
and agents. Both parties shall provide adequate liability and
workers' compensation insurance for all of their employees and
volunteers who engage in the performance of services set forth in
this Agreement.

C. No portion of this Agreement shall be deemed to constitute a waiver
of any immunities the parties or their officers or employees may
possess, nor shall any portion of this Agreement be deemed to have
created a duty of care with respect to any persons not a party to
this Agreement.
D. No portion of this Agreement shall be deemed to create an obligation
on the part of the County of Weld, State of Colorado, or upon School
District RE-3J to spend funds not otherwise appropriated in each
succeeding year.
E. If any section, subsection, paragraph, sentence, clause, or phrase
of this Agreement is for any reason held or decided to be invalid or
unconstitutional, such decision shall not affect the validity of the
remaining portions herein. The parties hereto declare that they
would have entered into this Agreement and each and every section,
subsection, paragraph, sentence, clause, or phrase thereof
irrespective of the fact that any one or more sections, subsections,
paragraphs, sentences, clauses, or phrases might be declared to be
unconstitutional or invalid.

VIII. ENTIRE AGREEMENT
This Agreement constitutes the entire understanding between the parties
hereto with respect to the subject matter hereof and may not be changed or
modified, except as stated in Section VI herein.
IN WITNESS WHEREOF, the parties hereto have duly executed this agreement
as of the day, month, and year first above written.

IV. EMPLOYMENT SERVICES RESPONSIBILITIES
A. Employment Services shall provide to the school contact the
following services:
1. Participate in the common assessment and appraisal of each
applicant including the determination of the appropriateness
of Employment Services Programs.

on information obtained in assessments and arrangements for

4. Provide competency training to youth, when appropriate, in
pre-employment and work maturity skills, basic skill
development, work experience, and other program activities as
appropriate and identified in the Plan.
5. Assist in selecting and referring, where appropriate,
qualified youth applicants for available subsidized and
unsubsidized placement openings and competency program
openings provided by Employment Services.
6. Refer youth not eligible or appropriate for JTPA Programs to
Job Services or other agency services.
7. Follow-up, under the direction of the school contact, with
each client and verify services provided or the lack of
services provided.
8. Assign a staff person to work with School District RE-7.
9. Provide training for the school contact and other interested
School District RE-7 personnel.
10. Explore and make available opportunities for qualified youth
in all services of Employment Services (Job Opportunities and
Basic Skills Program, The Educational Opportunity Center,
etc.) .
11. Support school contact in developing positive relationships
with school personnel.
12. Contact employers to develop employment training sites for the
youth when appropriate.
13. Maintain records for employment training incentive awards and
issue checks to youth.
14. Intervene and/or counsel youth with employment related
problems.
15. Intervene and counsel youth to provide incentive to improve
school performance.
16. Continually assess the effectiveness of the Agreement.

V. TERMINATION OF AGREEMENT
Either party may terminate this Agreement without cause be giving 30
calendar days written notice to the other party. Termination may also
result automatically upon loss of funding for the services contemplated
herein by either the County of Weld, State of Colorado, or School District
RE-7.
VI. MODIFICATION OF AGREEMENT
All modifications to this Agreement shall be in writing and signed by both
parties.
VII. ASSURANCES
A. School District RE-7 agrees that its officers, employees, and
clients do not become employees of the County of Weld, State of
Colorado and, therefore, are not entitled to any employee benefits
as Weld County employees as a result of the execution of this
Agreement. Similarly, the County of Weld, State of Colorado agrees
that its officers, employees, and clients do not become employees of
School District RE-7 and, therefore, are not entitled to employee
benefits of School District RE-7 as a result of the execution of
this Agreement.
B. The County of Weld, State of Colorado, the Board of County
Commissioners of Weld County, its officers, and employees shall not
be held liable for injuries or damages caused by any negligent acts
or omissions of School District RE-7, or of its employees,
volunteers, or agents while performing the tasks as set forth in
this Agreement. School District RE-7 shall indemnify, defend, and
hold harmless the County of Weld, State of Colorado, the Board of
County Commissioners of Weld County, its officers, and employees for
any loss occasioned as a result of the performance of the services
set forth in this Agreement by its employees, volunteers, clients,
and agents. Similarly, School District RE-7 shall not be held
liable for injuries or damages caused by any negligent acts or
omissions of the County of Weld, State of Colorado, the Board of
County Commissioners of Weld County, its employees, volunteers, or
agents while performing the tasks as set forth in this Agreement.
The County of Weld, State of Colorado shall indemnify, defend, and
hold harmless School District RE-7, its officers and employees for
any loss occasioned as a result of the performance of the services
set forth in this Agreement by its employees, volunteers, clients,
and agents. Both parties shall provide adequate liability and
workers' compensation insurance for all of their employees and
volunteers who engage in the performance of services set forth in
this Agreement.

C. No portion of this Agreement shall be deemed to constitute a waiver
of any immunities the parties or their officers or employees may

D. No portion of this Agreement shall be deemed to create an obligation
on the part of the County of Weld, State of Colorado, or upon School
District RE-7 to spend funds not otherwise appropriated in each
succeeding year.
E. If any section, subsection, paragraph, sentence, clause, or phrase
of this Agreement is for any reason held or decided to be invalid or
unconstitutional, such decision shall not affect the validity of the
remaining portions herein. The parties hereto declare that they
would have entered into this Agreement and each and every section,
subsection, paragraph, sentence, clause, or phrase thereof
irrespective of the fact that any one or more sections, subsections,
paragraphs, sentences, clauses, or phrases might be declared to be
unconstitutional or invalid.

EMPLOYMENT SERVICES OF WELD COUNTY
THIS AGREEMENT, made and entered into this 1 day of March , 1994, by
and between the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, on behalf of Employment Services of Weld
County, hereinafter referred to as "Employment Services", and Weld County School
District RE-B, hereinafter referred to as "School District RE-8".
Employment Services offers employment and training services to unemployed,
underemployed, and economically disadvantaged youth (ages 14-21) and adults of
Weld County.
Employment Services wishes to expand its competency program efforts and
placement activities on behalf of youth who are eligible to participate in the
Youth Programs, Summer Job Hunt Program, and Summer Employment and Training
Program.
School District RE-B has expressed the desire to work with Employment
Services to assist youth in accessing the above mentioned services.
In consideration of the mutual promises and covenants contained herein, the
parties hereto agree as follows:
I. TERM
The term of this agreement shall be for a period beginning March 15, 1994
and is subject to the provisions of paragraph V herein and future written
modifications requested by either of the parties.
II. ELIGIBILITY
Services shall be provided to economically disadvantaged youth who are
enrolled in or are returning to School District RE-8 and who meet the
criteria and demonstrate the motivation to complete the program in which
they may be enrolled.
The School District RE-8 contact shall target outreach efforts to those
at-risk who have additional barriers such as teen parents, offenders, and
youth who are in foster/group home care.
III. SCHOOL DISTRICT RE-8 RESPONSIBILITIES
The following roles and responsibilities shall be assigned to School
District RE-8 in the implementation of this Agreement.
A. School District RE-8 shall establish a school contact in the
district, which will provide the following services:
1. Assist in initial assessment and outreach to identify youth
which may benefit from programs under the Job Training
Partnership Act (JTPA) . The youth will be screened using the
JTPA In-School Student Profile located as Attachment A.

2. Refer youth to Employment Services staff, when appropriate, to
complete JTPA applications.
3. Assist Employment Services staff, as appropriate, in obtaining
necessary eligibility documentation (see Attachment B) and
initial assessment information, such as attendance records,
transcripts and achievement test scores needed for initial
assessment.
4. Initiate Educational/Supportive Services Plan, located as
Attachment C, for each youth determined to be eligible for
JTPA youth services. A copy of this Plan will be provided to
Employment Services within two weeks of eligibility
determination by Employment Services staff.
5. Whenever possible, assist with coordinating services as needed
with other area agencies.
6. Assist with updates on Educational/Supportive Services Plan,
approximately every six months.
7. Assign support staff, as necessary, to assist school contact
with information gathering and coordination of services.
8. Provide advisory services or referral to counseling services
as needed by the youth.
9. Assist in the development of working relationships between the
School District RE-8 staff and Employment Services Youth
Staff.

NON-FINANCIAL AGREEMENT
BETWEEN SCHOOL DISTRICT RE-12 AND
EMPLOYMENT SERVICES OF WELD COUNTY
THIS AGREEMENT, made and entered into this / day of ///QR , 1994, by
and between the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, on behalf of Employment Services of Weld
County, hereinafter referred to as "Employment Services", and Weld County School
District RE-12, hereinafter referred to as "School District RE-12".
Employment Services offers employment and training services to unemployed,
underemployed, and economically disadvantaged youth (ages 14-21) and adults of
Weld County.
Employment Services wishes to expand its competency program efforts and
placement activities on behalf of youth who are eligible to participate in the
Youth Programs, Summer Job Hunt Program, and Summer Employment and Training
Program.
School District RE-12 has expressed the desire to work with Employment
Services to assist youth in accessing the above mentioned services.
In consideration of the mutual promises and covenants contained herein, the
parties hereto agree as follows:
I. TERM
The term of this agreement shall be for a period beginning March 15 , 1994
and is subject to the provisions of paragraph V herein and future written
modifications requested by either of the parties.
II. ELIGIBILITY
Services shall be provided to economically disadvantaged youth who are
enrolled in or are returning to School District RE-12 and who meet the
criteria and demonstrate the motivation to complete the program in which
they may be enrolled.
The School District RE-12 contact shall target outreach efforts to those
at-risk who have additional barriers such as teen parents, offenders, and
youth who are in foster/group home care.
III. SCHOOL DISTRICT RE-12 RESPONSIBILITIES
The following roles and responsibilities shall be assigned to School
District RE-12 in the implementation of this Agreement.
A. School District RE-12 shall establish a school contact in the
district, which will provide the following services:
1. Assist in initial assessment and outreach to identify youth
which may benefit from programs under the Job Training
Partnership Act (JTPA) . The youth will be screened using the
JTPA In-School Student Profile located as Attachment A.

2. Refer youth to Employment Services staff, when appropriate, to
complete JTPA applications.
3. Assist Employment Services staff, as appropriate, in obtaining
necessary eligibility documentation (see Attachment B) and
initial assessment information, such as attendance records,
transcripts and achievement test scores needed for initial
assessment.
4. Initiate Educational/Supportive Services Plan, located as
Attachment C, for each youth determined to be eligible for
JTPA youth services. A copy of this Plan will be provided to
Employment Services within two weeks of eligibility
determination by Employment Services staff.
5. Whenever possible, assist with coordinating services as needed
with other area agencies.
6. Assist with updates on Educational/Supportive Services Plan,
approximately every six months.
7. Assign support staff, as necessary, to assist school contact
with information gathering and coordination of services.
8. Provide advisory services or referral to counseling services
as needed by the youth.
9. Assist in the development of working relationships between the
School District RE-12 staff and Employment Services Youth
Staff.
10. Assist with bi-monthly school performance reports for those
youth who are placed on subsidized job training.
11. Assist Employment Services Youth Staff with accessing school
space for counseling and/or testing students if needed.
12. Identify to Employment Services Youth Staff the names and
contact information of students when they drop out.
IV. EMPLOYMENT SERVICES RESPONSIBILITIES
A. Employment Services shall provide to the school contact the
following services:
1. Participate in the common assessment and appraisal of each
applicant including the determination of the appropriateness
of Employment Services Programs.

2. Assist in determining what services are needed by youth based
on information obtained in assessments and arrangements for
such services as available.
3. Develop the employment and training plan for the youth and
forward copies of the Plan to the school contact.
4. Provide competency training to youth, when appropriate, in
pre-employment and work maturity skills, basic skill
development, work experience, and other program activities as
appropriate and identified in the Plan.
5. Assist in selecting and referring, where appropriate,
qualified youth applicants for available subsidized and
unsubsidized placement openings and competency program
openings provided by Employment Services.
6. Refer youth not eligible or appropriate for JTPA Programs to
Job Services or other agency services.
7. Follow-up, under the direction of the school contact, with
each client and verify services provided or the lack of
services provided.
8. Assign a staff person to work with School District RE-12.
9. Provide training for the school contact and other interested
School District RE-12 personnel.
10. Explore and make available opportunities for qualified youth
in all services of Employment Services (Job Opportunities and
Basic Skills Program, The Educational Opportunity Center,
etc. ) .
11. Support school contact in developing positive relationships
with school personnel.
12. Contact employers to develop employment training sites for the
youth when appropriate.
13. Maintain records for employment training incentive awards and
issue checks to youth.
14. Intervene and/or counsel youth with employment related
problems.
15. Intervene and counsel youth to provide incentive to improve
school performance.
16. Continually assess the effectiveness of the Agreement.

V. TERMINATION OF AGREEMENT
Either party may terminate this Agreement without cause be giving 30
calendar days written notice to the other party. Termination may also
result automatically upon loss of funding for the services contemplated
herein by either the County of Weld, State of Colorado, or School District
RE-12.
VI. MODIFICATION OF AGREEMENT
All modifications to this Agreement shall be in writing and signed by both
parties.
VII. ASSURANCES
A. School District RE-12 agrees that its officers, employees, and
clients do not become employees of the County of Weld, State of
Colorado and, therefore, are not entitled to any employee benefits
as Weld County employees as a result of the execution of this
Agreement. Similarly, the County of Weld, State of Colorado agrees
that its officers, employees, and clients do not become employees of
School District RE-12 and, therefore, are not entitled to employee
benefits of School District RE-12 as a result of the execution of
this Agreement.
B. The County of Weld, State of Colorado, the Board of County
Commissioners of Weld County, its officers, and employees shall not
be held liable for injuries or damages caused by any negligent acts
or omissions of School District RE-12, or of its employees,
volunteers, or agents while performing the tasks as set forth in
this Agreement. School District RE-12 shall indemnify, defend, and
hold harmless the County of Weld, State of Colorado, the Board of
County Commissioners of Weld County, its officers, and employees for
any loss occasioned as a result of the performance of the services
set forth in this Agreement by its employees, volunteers, clients,
and agents. Similarly, School District RE-12 shall not be held
liable for injuries or damages caused by any negligent acts or
omissions of the County of Weld, State of Colorado, the Board of
County Commissioners of Weld County, its employees, volunteers, or
agents while performing the tasks as set forth in this Agreement.
The County of Weld, State of Colorado shall indemnify, defend, and
hold harmless School District RE-12, its officers and employees for
any loss occasioned as a result of the performance of the services
set forth in this Agreement by its employees, volunteers, clients,
and agents. Both parties shall provide adequate liability and
workers' compensation insurance for all of their employees and
volunteers who engage in the performance of services set forth in
this Agreement.

C. No portion of this Agreement shall be deemed to constitute a waiver
of any immunities the parties or their officers or employees may
possess, nor shall any portion of this Agreement be deemed to have
created a duty of care with respect to any persons not a party to
this Agreement.
D. No portion of this Agreement shall be deemed to create an obligation
on the part of the County of Weld, State of Colorado, or upon School
District RE-12 to spend funds not otherwise appropriated in each
succeeding year.
E. If any section, subsection, paragraph, sentence, clause, or phrase
of this Agreement is for any reason held or decided to be invalid or
unconstitutional, such decision shall not affect the validity of the
remaining portions herein. The parties hereto declare that they
would have entered into this Agreement and each and every section,
subsection, paragraph, sentence, clause, or phrase thereof
irrespective of the fact that any one or more sections, subsections,
paragraphs, sentences, clauses, or phrases might be declared to be
unconstitutional or invalid.

VIII. ENTIRE AGREEMENT
This Agreement constitutes the entire understanding between the parties
hereto with respect to the subject matter hereof and may not be changed or
modified, except as stated in Section VI herein.

as of the day, month, and year first above written.

B. The County of Weld, State of Colorado, the Board of County
Commissioners of Weld County, its officers, and employees shall not
be held liable for injuries or damages caused by any negligent acts
or omissions of School District RE-5J, or of its employees,
volunteers, or agents while performing the tasks as set forth in
this Agreement. School District RE-5J shall indemnify, defend, and
hold harmless the County of Weld, State of Colorado, the Board of
County Commissioners of Weld County, its officers, and employees for
any loss occasioned as a result of the performance of the services
set forth, in this Agreement by its employees, volunteers, clients,
and agents. Similarly, School District RE-5J shall not be held
liable for injuries or damages caused by any negligent acts or
omissions of the County of Weld, State of Colorado, the Board of
County Commissioners of Weld County, its employees, volunteers, or
agents while performing the tasks as set forth in this Agreement.
The County of Weld, State of Colorado shall indemnify, defend, and
hold harmless School District RE-5J, its officers and employees for
any loss occasioned as a result of the performance of the services
set forth in this Agreement by its employees, volunteers, clients,
and agents. Both parties shall provide adequate liability and
workers' compensation insurance for all of their employees and
volunteers who engage in the performance of services set forth in
this Agreement.

C. No portion of this Agreement shall be deemed to constitute a waiver
of any immunities the parties or their officers or employees may
possess, nor shall any portion of this Agreement be deemed to have
created a duty of care with respect to any persons not a party to
this Agreement.
D. No portion of this Agreement shall be deemed to create an obligation
on the part of the County of Weld, State of Colorado, or upon School
District RE-5J to spend funds not otherwise appropriated in each
succeeding year.
E. If any section, subsection, paragraph, sentence, clause, or phrase
of this Agreement is for any reason held or decided to be invalid or
unconstitutional, such decision shall not affect the validity of the
remaining portions herein. The parties hereto declare that they
would have entered into this Agreement and each and every section,
subsection, paragraph, sentence, clause, or phrase thereof
irrespective of the fact that any one or more sections, subsections,
paragraphs, sentences, clauses, or phrases might be declared to be
unconstitutional or invalid.

VIII. ENTIRE AGREEMENT
This Agreement constitutes the entire understanding between the parties
hereto with respect to the subject matter hereof and may not be changed or
modified, except as stated in Section VI herein.

BETWEEN AIMS COMMUNITY COLLEGE AND
EMPLOYMENT SERVICES OF WELD COUNTY
THIS AGREEMENT, made and entered into this 1 day of March , 1994, by
and between the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, on behalf of Employment Services of Weld
County, hereinafter referred to as "Employment Services," and Aims Community
College, hereinafter referred to as "Aims."
WITNESSETH
WHEREAS, Employment Services offers employment and training services to
unemployed, underemployed, and economically disadvantaged individuals of Weld
County, and
WHEREAS, Employment Services wishes to expand its coordination efforts and
placement activities on behalf of individuals who are eligible to participate in
the programs under it's auspices, and
WHEREAS, Employment Services receives authority from the Wagner-Peyser Act,
Employment First Food Stamp Program, Job Opportunities and Basic Skills Program,
and the Job Training Partnership Act to provide employment and training services
and employer relations services and to coordinate such activities with
appropriate agencies, and
WHEREAS, Aims has expressed the desire to work with Employment Services to
assist individuals in accessing services and training.
NOW THEREFORE, in consideration of the mutual promises and covenants
contained herein, the parties hereto agree as follows:
I. PURPOSE
This cooperative agreement is entered into by Aims Community College and
Employment Services of Weld County maximizing the two agencies sources in
a coordinated fashion to:
A. Provide services to those individuals who are seeking employment and
training and are either eligible or may be eligible for JTPA
programs.
B. Establish the means for a practical and effective relationship
between the two agencies for the stated purposes of:
1. Maximizing client vocational potential.
2. Ensuring clients successful participation in training.
3. Establishing cooperation to avoid duplication of funding and
services.
4. Maximizing coordination in the delivery and expansion of
services and programs.
5. Assist employers through developing a skilled work force.

II. TERM
The term of this agreement shall be for a period beginning March 151994,
and ending June 30, 1995, and subject to the provisions of paragraph VI
herein.
III. AIMS RESPONSIBILITIES
A. Aims will provide the following services:
1. Assist in outreach to identify individuals who may benefit
from programs under the Job Training Partnership Act (JTPA) .
Individuals can be screened using the JTPA Eligibility Pre-
Screening Form located as Attachment A.
2. Refer individuals to Employment Services staff, when
appropriate, to complete JTPA applications.
3. Assist in the completion or updates of an Educational
Financial Assistance Plan, located as Attachment B, for each
individual who will receive JTPA assistance. A copy of this
Plan will be signed by the JTPA staff person, the individual
and a representative of Aims. The Aims Financial Aid Officer
will attach a copy of the financial award offer to Financial
Assistance Plan. The plan and financial award offer will be
provided to Employment Services within two weeks of submission
by Employment Services staff to Aims financial aid office. If
the financial award offer is not available at the time of
enrollment, Aims will forward a copy of the final award when
received.
4. Continue to coordinate with Employment Services in the
implementation and delivery of GED and basic skills
development training through the out stationing of staff to
conduct GED classes, and through the utilization of Employment
Services Learning Lab for GED preparation.
5. Ensure that JTPA funds are used for tuition.
IV. EMPLOYMENT SERVICES RESPONSIBILITIES
A. Employment Services shall complete the following services:
1. Complete the common assessment and appraisal of each
applicant including the determination of the appropriateness
of Employment Services Programs.

2. Determine what services are needed by individuals based on
information obtained in assessments and arrange for such
services as available.
3. Develop an Individual Service Strategy (ISS) and document the
ISS with the determination agreed upon with Aims, of the
participant's financial assistance needs for training and the
proper mix of JTPA and HEA Title IV funds.
4. Provide Aims with the names of JTPA participants who are to
attend Aims and for whom JTPA payments will be made.
5. Document the ISS to show sufficient coordination with other
resources available, to ensure to the extent practicable, that
there is sufficient funding for the participant to
successfully complete the agreed upon program.
6. Provide Aims with a release of information signed by the
participant which will allow Employment Services to release
JTPA assistance information to Aims, and which will allow Aims
to release HEA financial assistance information back to
Employment Services.
7. Provide the participant who receives a Federal Pell grant with
an Educational Financial Assistance Plan which will indicate
the portion of the HEA grant to be applied to the cost of
tuition, fees, and books. This plan will be signed by a JTPA
staff person, the participant and a representative from Aims.
8. Complete the Financial Assistance Plan based upon information
contained in the financial award offer which is provided by
Aims Community College Financial Aid Office.
9. Agree to coordinate for the provision of space for the GED
classes for client groups, and for the utilization of the
Employment Services Learning Lab to assist clients in gaining
the skills necessary to acquire a GED or required enhancement
areas.
V. CONTINUATION OF EFFORTS
Employment Services and Aims Community College agree to continue to
coordinate and work together in the development of collaborative efforts
to serve the citizens of Weld County.

VI. TERMINATION OF AGREEMENT
Either party may terminate this Agreement without cause by giving 30
calendar days written notice to the other party. Termination may
also result automatically upon loss of funding for the services
contemplated herein by either the County of Weld, State of Colorado;
or Aims.
VII. MODIFICATION OF AGREEMENT
All modifications to this Agreement shall be in writing and signed
by both parties.
VIII. ASSURANCES
A. Aims agrees that its officers, employees, and clients do not become
employees of the County of Weld, State of Colorado and, therefore,
are not entitled to any employee benefits as Weld County employees
as a result of the execution of this Agreement. Similarly, the
County of Weld, State of Colorado Agrees that its officers,
employees, and clients do not become employees of Aims and,
therefore, are not entitled to employee benefits of Aims as a result
of the execution of this Agreement.
B. The County of Weld, State of Colorado, the Board of County
Commissioners of Weld County, its officers, and employees shall not
be held liable for injuries or damages caused by any negligent acts
or omissions of Aims, or of its employees, volunteers, or agents
while performing the tasks as set forth in this Agreement. Aims
shall indemnify, defend, and hold harmless the County of Weld, State
of Colorado, the Board of County Commissioners of Weld County, its
officers, and employees for any loss occasioned as a result of the
performance of the services set forth in this Agreement by its
employees, volunteers, clients, and agents. Similarly, Aims shall
not be held liable for injuries or damages caused by any negligent
acts or omissions of the County of Weld, State of Colorado, the
Board of County Commissioners of Weld County, its employees,
volunteers, or agents while performing the tasks as set forth in
this Agreement. The County of Weld, State of Colorado shall
indemnify, defend, and hold harmless Aims, its officers and
employees for any loss occasioned as a result of the performance of
the services set forth in this Agreement by its employees,
volunteers, clients, and agents. Both parties shall provide
adequate liability and workers' compensation insurance for all of
their employees and volunteers who engage in the performance of
services set forth in this Agreement.
