Box 100 Erie, Colorado 80516 RE: Landfill Expansion Denver Regional Landfill (South) Weld County Dear Mr. Hahn: The Hazardous Materials and Waste Management Division (the Division) of the Colorado Department of Health has received and reviewed your letter of February 28, 1992 regarding the Denver Regional Landfill (South) expansion. The review of the application is performed under the authority of the "Solid Waste Disposal Sites and Facilities Act," Title 30, Article 20, Part 1 of the Colorado Revised Statues, as amended (the Statute), and the "Regulations Pertaining to Solid Waste Disposal Sites and Facilities." The Regulations were adopted for the implementation of the Statute and are contained in the Colorado Code of Regulations, 6 CCR 1007-2 (the Regulations). The intent of the revised landfill application is to provide the site characterization, design and operations plan for the Denver Regional Landfill (South) expansion. The expansion area is contained wholly within the existing Certificate of Designation area. The Division does not view this application as an amended Certificate of Designation, but rather as a substantial change in operations, meaning a redesign or planned construction which would significantly change the planned design performance of the facility as originally designated. A substantial change of the planned design or construction of the solid waste facility necessitates the submittal of an amendment to the Design and Operations Plan, and a Division technical review. For a new solid waste disposal site and facility, the Statute requires that the applicant provide to the governing body having jurisdiction, in this case Weld County, a copy of the application for a Certificate of Designation [Statute 30-20-103]. Also, the Statute requires that the governing body provide a public forum to hear written and oral testimony presented by governmental entities and residents concerning such proposed site or facility [Statute 30- 20-104 (3)] prior the issuance of a Certificate of Designation. Weld County has no Statutory requirement to implement specific procedures or notifications for an amended Design and Operations Plan. As part of the Divisions' technical review process, a News Release has been published in the local newspapers requesting public comment. In addition, the amended Design and Operations Plan has been forwarded by Laidlaw Waste Systems, Inc. to the Weld County Health Department for technical review. The Division is currently in process of completing its technical review. Comments are welcome up to and including March 31, 1992. Since, the Division does not have statutory authority to require Laidlaw Waste Systems, Inc. to comply with your request, it is recommended they you contact Laidlaw directly in an effort to obtain a copy of the amended Design and Operations Plan. A copy of this letter is being forwarded to the Laidlaw Waste Services, Inc. They have informed me that they do not object to providing the Town of Erie with the amended plan.
