MEDDLES WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 13th day of March, 1991, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Robert M. Meddles, 3690 Weld County Road 7, Erie, Colorado 80516, for a Site Specific Development Plan and Use by Special Review Permit for a horse boarding and training facility (maximum of 35 horses) in the A (Agricultural) Zone District (Amendment to CUP 1134) on the following described real estate, to-wit: Part of the NW/4, Section 15, Township 1 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by James and Laurie Wait, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Agricultural Goals and Policies and the Urban Growth Boundary Goals and Policies of the Weld County Comprehensive Plan. The proposed Special Review Permit area is located within the urban growth boundary area of the Towns of Erie and Dacono, and the Cities of Northglenn, Thornton, and Broomfield. All of these municipalities have stated they have no objections to this request. 910168 RI-OG-(9 Page 2 RE: USR - MEDDLES b. The proposal is consistent with the intent of the Agricultural Zone District and, as an Agricultural Service Establishment, is provided for as a Use by Special Review. c. The proposed Use would be compatible with the existing surrounding land uses which include rural residences, pasture, and agricultural production. The proposed Use would also be compatible with the future development of the surrounding area as permitted by the Agricultural Zone District. Conditions of Approval and Development Standards will ensure compatibility. d. This property is located in the Geologic Hazard Overlay District. The Colorado Geologic Survey reviewed this site in 1978 when the original application was approved and found that the geologic conditions generally are suitable for the proposed land use. e. Special Review Permit Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a horse boarding and training facility (maximum of 35 horses) in the A (Agricultural) Zone District (Amendment to CUP 434) on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 910168 Page 3 RE: USR - MEDDLES 3. Prior to recording the Special Review Permit plat: a. The recorded exemption application shall be reviewed and approved by the Department of Planning Services' staff or the Board of County Commissioners for creation of the five- acre parcel. 4. Prior to the operation of the facility on the five-acre parcel: a. The applicant shall submit evidence to the Department of Planning Services that the Weld County Health Department has determined the facility to be in compliance with the Colorado Guidelines for Feedlot Runoff Containment. b. Any required Air Emissions Permit shall be obtained from the Air Pollution Control Division, Colorado Department of Health, for fugitive dust and odors. c. The applicant shall submit a plan for disposal of runoff pond effluent to the Weld County Health Department for review and approval. 5. Within 30 days of approval by the Board of County Commissioners: a. An I.S.D.S. Evaluation shall be conducted on all existing septic systems prior to issuing the required septic permits on the existing systems. 6. Prior to the issuance of building permits for the arena, a complete set of building plans shall be submitted to the Longmont Fire Protection District for review. 7. H. ebster 910168 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS ROBERT M. MEDDLES 1. The Site Specific Development Plan and Special Review Permit is for a horse boarding and training facility in the Agricultural Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. A maximum of 35 horses shall be permitted on the site. 2. Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 C.R.S. , as amended. 3. The applicant shall remove, handle, and stockpile manure from the livestock area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies or insect pests, or pollutant runoff. The manure storage site shall have a water-tight surface which does not permit seepage or percolation of manure pollutants into the ground. 4. The facility shall be maintained in compliance with the Colorado Guidelines for Feedlot Runoff Containment. 5. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 6. No permanent disposal of wastes shall be permitted at this site. 7. Wood shavings, sawdust, and waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 8. Fugitive dust shall be controlled on this site. 9. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 10. A bathroom with adequate toilet facilities served by an individual sewage disposal system is required for the proposed arena, and the system shall be installed according to the Weld County Individual Disposal Regulations. 11. The septic system for the arena shall be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 12. An all-weather road, which is a minimum of 16 feet in width, shall be provided within 150 feet of the arena. 13. The property shall be maintained in compliance with Sections 45.1 and Section 47 of the Weld County Zoning Ordinance. 910168 '� 7 Page 2 RE: DEVELOPMENT STANDARDS - MEDDLES 14. Any uncovered hay storage shall be no closer than the height of the pile to any building and no closer than 10 feet to any property line. 15. The Community Ditch easement, which is 25 feet from the centerline of the ditch, shall not be used as a pedestrian or horse path. 16. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 17. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 18. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 19. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 20. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 21. The property owner or operator shall be responsible for complying with all of the foregoing Standards. Meddles, stating a single family dwelling, and training stable was to be constructed on the property. This house would provide residency, and a convenient place to conduct both businesses as outlined in the C.U.P. These businesses were to be operated by the Meddles, and their daughter, Laura L. The training, breeding, and boarding management would be conducted by Laura L. In 1986, a permit was granted to place a mobile home on the property to allow a place of residence for Laura L. and her husband James M. Wait. The purpose of the permit was for the Meddles to acquire help with the horse and farm businesses, while the Waits remained in close proximity to the owners. From 1986 until present, the Wait family has lived in the mobile home that was placed on the Meddles ' property. Laura L. has seen a great deal of success in the horse business since that time, and the farming has proven to be as profitable as outlined in the justification presented by the Meddles for the C.U.P. APPLICATION REQUIREMENTS 1) . A completed application form (see attached) . 2) . A detailed description of the proposed operation and use shall be supplied. Details for the following items, when applicable, are required. — Explain proposed use. Upon approval of the 5 acre Recorded Exemption, and Use by Special Review, a single family dwelling will be placed on the 5 acre parcel. The mobile home will continue to be occupied by the Waits, and will remain on the 5 acres until the single family dwelling is completed. Both horse and farm businesses will be moved to the 5 acre parcel. An indoor riding arena, a horse barn (attached to the riding arena) , an addition to the machine shop, and a structure to store the hay for the horses will be constructed (see attached plot plan) . The maximum number of horses on the property will be 35. The horse business will include training, and boarding, and the farming will include growing various crops. 21.31.61E; - Explain need f.. e use. Since the Meddles are retiring, the Wait's are taking over the horse and farming businesses. They are interested in selling the improvements to Laura L. and James M. In addition, an office for the businesses will be located in the single family dwelling. - Explain the types of existing uses on surrounding properties. Existing uses are limited to rural residential, farming, and horse businesses. Corn and Barley are the predominant crops that have been grown in recent years. - The distance of the proposed use to residential structures in each direction. This reflects the distances from the residential structures to the property line. Laverne Mueller 255 ft. George Ruff 500 ft. Russell Goodwin 600 ft. Richard Gordley 750 ft. - The maximum number of users, patrons, members, and buyers. The maximum number using the horse facilities will be 35 per month, all of which would be for the horse business. - The number of employees, number of shifts, and hours of operation. Initially, one person will be hired during the summer. Ultimately, one full-time person will be the maximum number of employees. - The type of water source for the proposed use. Water for the horse business and single family dwelling will be provided by the existing Left Hand Water district tap. Water for irrigation will be provided by the existing shares through the Farmers Reservoir Irrigation Ditch Company. - Explain the access route(s) to be utilized for the proposed use. Access to the single family dwelling will be provided by an existing road that runs to the mobile home, and the entire length of the property. This section of that road that leads to the mobile home has been upgraded by means of a layer of road base. Gravel will be installed in 1991 after the road base has been compacted. Access to the remaining 35 acres will be provided by a road located east of, and adjacent to the existing irrigation ditch (see attached Plot Plan) . - Explain type, size, weight and frequency of vehicular traffic associated with proposed use. The types of vehicles will consist mainly of cars, pickups, and horse trailers. The heaviest vehicle would be a gooseneck horse trailer weighing approximately 4000 lbs. Frequency will coincide directly to the number of horses being boarded and trained. - The type of sewage facilities for the proposed use. 4 .t .. The existing sewage disposal system is an Individual Disposal System. It was designed by American Eagle Engineering, installed in 1986 by Fehrs Backhoe Service, and inspected by the Weld County Board of Health. (see attached) . - A description of the fire protection measures associated with the proposed use. The Longmont Fire District will provide emergency service to the property. Fire extinguishers will be located in the house, and riding arena. In addition, adequate smoke detection devices will be located in house. - The types and maximum number of animals to be concentrated on the Use By Special Review area at any one time. The maximum number of animals (horses) will be 35. - The type and size of any waste, stockpile or storage areas associated with the proposed use. The type of waste will be limited to normal household waste as created by the single family dwelling. The horse business creates very little waste, the majority being twine from bales when feeding the horses. Farming also generates little waste, including but not limited to sacks left from planting. An enclosed storage area will be utilized until time for removal of such waste. Four-25 gallon barrels with lids will be used for storage until time for removal, which will occur once per month. Therefore, the maximum size of waste will be 100 gallons per month. The horse business will generate approximately 2 cubic yards of manure per month. This will be stockpiled east of the indoor riding arena until it has decomposed to the point suitable for use as fertilizer in the shelter belt, or farmland, and removed about 6 times per year. In a telephone conversation with the Weld County Health Department, that stockpile will not have an adverse affect on the welfare of the land, or the neighbors, providing a water barrier is installed under the manure, and the odor is not offensive. The water barrier will be installed, and because of the location of the stockpile, odor would not be a problem to our neighbors. - Type of storm water retention facilities associated with the proposed use. Because we are not constructing any buildings that will cause water runoff, there is no need for water retention facilities. - The time schedule and method of removal and disposal of debris, junk and other wastes associated with the proposed use. The indoor riding arena, farming operations, and single family dwelling will produce waste that will need to be disposed of once monthly. A monthly removal by pickup will be used. The same 25 gallon barrels with lids used for storage will be used to transport the debris. The manure produced from the horse business will be removed by tractor and spreader to the shelter belt, or farmland, about 6 times per year. c'l().1 G - Explain propose4 landscaping plans and ero:.ion control measures associated with the proposed use. Minor landscaping will be done to accommodate appropriate drainage for the family dwelling, as well as the other proposed structures. As stated earlier, a shelter belt has been planted for erosion control measures. - Reclamation procedures to be employed upon cessation of the Use by Special Review activity. If the horse business should fail for any reason, the riding arena would be sold and moved from the property, and farming would resume where the structure was located. - A time table showing the periods of time required for construction and start-up of the proposed use 1991-1995 Completion of the single family dwelling. 1991-1995 Removal of mobile home. 1994-1996 Completion of the shed and machine shop (including moving) . 1998-2000 Completion of the indoor riding arena. 3) . The following written materials and supporting documents shall be submitted as a part of the application: - A statement explaining how the proposal is consistent with the Weld County Comprehensive Plan. The Weld County Comprehensive Plan states: Agricultural Policies, section 1. Agricultural zone districts shall be established and maintained to protect and promote the County's agricultural industry. The agricultural zone district is intended to preserve prime agricultural land and to provide areas for agricultural activities and uses dependent upon agriculture without interference of incompatible residential, commercial, and industrial land uses. The agricultural industry will be maintained because the horse and farming businesses will still operate in the same manner as the Meddles. Prime Farm land will not be used because the house is located within the shelter belt, and on land that is not irrigated, nor possible to irrigate. Agricultural Policies, section 3. Conversion of agricultural land to residential, commercial, and industrial development shall be discouraged when the subject site is located outside of a municipality's comprehensive plan area, urban growth area, or I-25 mixed-use-development area and activity centers. This policy is intended to promote conversion of agricultural land in an orderly manner that is in harmony with the phased growth plans of a municipality and the County. It is intended to minimize the incompatibilities that occur between uses in the agricultural district and districts that allow urban-type uses. In addition, this policy is intended to minimize the costs to Weld County taxpayers that require service on an urban level. 421.01.6c4^u The horse and farming businesses are promoting the agricultural industry. Conversion of prime land will not occur, because the single family dwelling will be located on non-irrigatable land, within the shelter belt. Agricultural Policies, section 11. The County will require various methods that encourage soil, groundwater, and water aquifer conservation practices and protection. The methods should be consistent with other existing goals and policies. You will note in the soil report and soil map (attached) , the area where the single family dwelling will be located has been designated a capability subclass IVe. Class IV - Very severe limitations that restrict the choice of crops, require very careful management, or both. e - Erosion by wind or water is the major problem. Because of this classification, a shelter belt consisting of approximately 400 trees has been planted as a windbreak, control of soil erosion, and wildlife habitat (see the Recorded Exemption proposal, items 5,7, and 9. ) . An extensive drip watering system has been installed to provide adequate water and fertilizer to the trees. The amount of water to each row may be controlled, depending on the row' s water or fertilizer needs. This shelter belt consists of approximately 60% evergreen trees. Obviously, since there is an established shelter belt, other means of farming are impossible. Therefore, the logical location of the single family dwelling would be within the shelter belt - A statement explaining how the proposal is consistent with the intent of the district in which the use is located. The agricultural businesses are located in an agricultural district. The single family dwelling will not be taking away prime farm land. — If applicable, a statement explaining what efforts have been made, in the location decision for the proposed use, to conserve productive agricultural land in the agricultural zone district. As stated above in the conformance to the Weld County Comprehensive Plan, the area is non-productive farm land where the single family dwelling will be located. In addition, the house will be located within the shelter belt. - A statement explaining there is adequate provision for the protection of the health, safety, and welfare of the inhabitants of the neighborhood and the county. The horse and farming businesses will be operated on the property. Therefore, no uses conducted on the Use by Special Review area will interfere with the health, safety, and welfare of the inhabitants of the neighborhood. E .�. "3)-4 - A statement explaining the uses permitted w_11 be compatible with the existing surrounding land uses (include a description of existing land uses of all properties adjacent to the property) . The existing surrounding land uses are currently limited to rural residential, farming, and horse businesses. Our existing and proposed uses will be the same as the surrounding uses. - A statement explaining the proposed use will be compatible with the future development of the surrounding area as permitted by the existing zone and with future development area as projected by the comprehensive plan of the county or the adopted master plans of affected municipalities. The future development plans of the surrounding area for the county is agricultural. Our plans will not deviate from these plans. In discussing the Erie Comprehensive Plan with Scott Hahn (Town Administrator) , on September 20, 1990, the Erie Comprehensive Plan basically states that the area where we are located will remain non-urban. It might also be noted that at this time Erie would not be interested in annexing the area where this property is located. The town administrator for Dacono (Les Kennedy) states that the area where this land is located is to remain agricultural. Likewise, Dacono is not interested in annexing the property into Dacono at this time. - A statement explaining the use by special review area is not located in a flood plain, geologic hazard and Weld County Airport overlay district area; or that the application complies with section fifty (50) , overlay district regulations as outlined in the Weld County Zoning Ordinance. A Geological Survey was performed in 1978 for the C.U.P. (see attached) . These conditions have not changed since that time. No existing or proposed structures will be located in the Geological Hazard Area. - Proof that a water supply will be available which is adequate in terms of quantity, quality, and dependability (e.g. , a well permit or letter from a water district) . Water will be provided by Left Hand Water (see attached letter) . - A copy of the deed or legal instrument identifying the applicant(s) interest in the property under consideration. If an authorized agent signs the application for the fee owner(s) , a letter granting power of attorney to the agent from the property owner(s) shall be provided. (see attached) - A noise report, unless waived by the Department of Planning Services, documenting the methods to be utilized to meet the applicable noise standards. The noise report has been waived by the Department of Planning Services. - A soil report of the site prepared by the Soil Conservation Service or by the soils engineer or scientist. About 10 -percent of the unit_ is Heldt silty clay and Weld loam. The Wiley soil is a deep, well drained soil. It formed in calcareous eolian -deposits .
