HomeMy WebLinkAbout911693.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO JULY 17, 1991 TAPE 1191-18 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the law and bylaws of said Board at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, July 17, 1991, at the hour of 9:00 A.M. ROLL CALL: The meeting was called to order by the Chairman and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Gordon E. Lacy, Chairman Commissioner George Kennedy, Pro-Tem Commissioner Constance L. Harbert Commissioner C. W. Kirby Commissioner W. H. Webster Also present: Assistant Weld County Attorney, Lee Morrison Acting Clerk to the Board, Cathy Flot Finance and Administration Director, Don Warden MINUTES: Commissioner Harbert moved to approve the minutes of the Board of County Commissioners meeting of July 15, 1991, as printed. Commissioner Kennedy seconded the motion, and it carried unanimously. CERTIFICATION OF PUBLIC FORUM: Commissioner Kennedy moved to approve the Certification of the Public Forum conducted on July 15, 1991, re: Move of County Offices. Commissioner Kirby seconded the motion, and it carried unanimously. ADDITIONS: Chairman Lacy added as 113 under New Business: Consider Approval of Letter of Credit re: Baldridge PUD 1st Filing. CONSENT AGENDA: Commissioner Kennedy moved to approve the consent agenda as printed. Commissioner Harbert seconded the motion, and it carried unanimously. DEPARTMENT HEADS/ ELECTED OFFICIALS: Chuck Cunliffe, Planning Director, reported the number of land-use cases requiring public hearings is down 18.17 compared to the total number of cases processed during the same period in 1990. Planning personnel also responded to a total number of 6,061 public inquiries, including 4,803 telephone calls and 1,258 personal walk-ins; comparing with a total of 5,669 during the same time period in 1990, representing a 6.92 increase. Mr. Cunliffe also reported the Department issued 627 building permits, 143 electrical permits, and 69 mobile home permits, reflecting a 3.27 increase over 1990. The Planning Department conducted 4, 760 construction inspections, processed 71 building code violations, investigated 112 zoning complaints and processed 115 zoning violations. Commissioner Webster commended Mr. Cunliffe for a job well done by the Planning staff. 911693 COMMISSIONER Curt Probert, Extension Director, reported on the 4-H Youth programs including the 4-H Conference, Creative Cooks" demonstration, the softball program, exchange trip with Michigan and the State 4-H Dairy Judging Champion Team. Jerry Alldredge, Weld County Extension Agronomist, reported on the research plots for onions, alfalfa, potatoes, beans and wheat. Mr. Alldredge also discussed the joint waste management project with Weld, Adams, Larimer and Boulder Counties, as well as the water quality of Weld County. Commissioners directed questions to Mr. Alldredge concerning the lettuce, onion, and corn crops here in Weld County. WARRANTS: Don Warden presented the following warrants for approval by the Board: General fund $411,098.14 Payroll 34,608.59 Handwritten warrants: General fund $ 80.00 Payroll $ 188.39 Commissioner Kennedy moved to approve the warrants as presented by Mr. Warden. Commissioner Kirby seconded the motion which carried unanimously. Let the record reflect that a recess was taken at this time to allow the Board to convene as the Board of Social Services. BIDS: APPROVE COPIER - HEALTH DEPARTMENT: Mr. Warden asked that this bid be continued for two weeks so final neogations can be done. APPROVE JANITORIAL SUPPLIES - BUILDINGS AND GROUNDS DEPARTMENT: Mr. Warden stated staff has recommended accepting the low bids on each item as follows: Items 111-4, 6-8, 13-15, 17 and 19 to Northern Colorado Paper in the amount of $2,560.49; Items 119, 11, 12, 16, 20 and 21 to Century Papers, Inc. , in the amount of $6,324.17; Item 1110 to Columbine Paper and Maintenance Supply Company in the amount of $93.17; and Items 115 and 18 to Huntington Laboratories-Mountain States Division in the amount of $1,325.02. Commissioner Kennedy moved to approve said bids, as recommended. Commissioner Harbert seconded the motion which carried unanimously. BUSINESS: NEW: CONSIDER REQUEST FOR RENEWAL OF TAVERN LIQUOR LICENSE FROM DONALD EDICK, DBA RAFFERTY'S, INC. : Chairman Lacy read the Sheriff's Office report stating no violations have been received on this establishment. Commissioner Webster moved to approve said request. Commissioner Kennedy seconded, and the motion carried unanimously. CONSIDER STIPULATION OF INTEREST AND AGREEMENT FOR SETTLEMENT OF CLAIMS - FINA OIL AND CHEMICAL COMPANY: Assistant County Attorney, Lee Morrison, explained there was a disputed claim arising out of the County's acquisition and subsequent sale of the surface of this property. The stipulation pertains to interest in the mineral royalty for the monies which were put into an expense account as a result of this dispute. The County was assigned a 3/5 interest. These are held by the Court, and the County will get almost 90% of those monies. Mr. Morrison recommended approval of this Stipulation. Commissioner Kennedy moved to approve said Stipulation and Commissioner Harbert seconded. The motion carried unanimously. Minutes - July 17, 1991 Page 2 CONSIDER LETTER OF CREDIT RE: BALDRIDGE PUD 1ST FILING - Mr. Morrison explained that the original Agreement and Letter of Credit was for $65,500.00. Some of the work has been performed on the site so the amount left to guarantee is substantially less. The $15, 000 is intended to cover the portion of landscaping remaining. Commissioner Kirby moved to approve said Letter of Credit. Commissioner Harbert seconded the motion, which carried unanimously. PLANNING: CONSIDER RESOLUTION RE: BUILDING CODE AND ZONING VIOLATIONS - RURAL DITCH COMPANY, HIATT, FAHRENHOLTZ, BURGE, HYENG, BURGER, CONOCO, INC. , AND CARLSON: Commissioner Webster moved to approve this Resolution authorizing the County Attorney to proceed with legal action against the Rural Ditch Company, Ron and Darlene Fahrenholtz, Ricky L. Hiatt, Arnold Burger, Yoo Jin Hyeng, Conoco, Inc. , Stener and Frances Carlson, Arnold and Dorothy Burger, and Conoco, Inc. , for violations of the Weld County Zoning and Building Code Ordinances. Commissioner Kennedy seconded the motion, and it carried unanimously. RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the consent agenda. There were no Ordinances. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board. Webster Minutes - July 17, 1991 Page 3 DEPARTMENT OF PLANNING SERVICES SUMMARY OF ACTIVITIES For period ending June 30, 1991 CURRENT PLANNING The department received and processed a total number of 104 land-use cases that required public hearings. This figure is a 18.1% decrease from the total number of cases processed during the same period in 1990. The department processed 127 cases during 1990. The department also reviewed a total of 42 staff-issued applications. This figure is a 1.4% increase in the total number as applications reviewed during the same period in 1990. The department reviewed 37 during 1990. The staff reviewed and approved a total of 68 different applications utilizing the administrative review process for reviewing recorded exemptions, subdivision exemptions, and zoning permits for mobile and manufactured homes. This figure represents 65% of the total cases submitted that required public hearings. PUBLIC ASSISTANCE Planning personnel responded to a total number of 6,061 public inquiries. These included 4,803 telephone calls and 1,258 personal walk-ins. This compares with a total number of 5,669 inquiries during the same time period in 1990 and represents a 6.9% increase. These figures do not include inquiries with the Director, administrative support staff, or building inspection personnel. BUILDING PERMITS, INSPECTIONS. AND COMPLIANCE The department issued 839 permits. These included 627 building permits, 143 electrical permits, and 69 mobile home permits. These figures reflect a 3.2% increase when compared to the number of permits issued during the same time period in 1990. (813 permits issued in 1990.) Total valuation of permits decreased 23.6% when compared to the valuation of permits issued during the same time period in 1990. ($15,417,582 in 1991 and $20,180,547 in 1990.) The department conducted 4,760 construction inspections. This figure is a 16.4% decrease in the number of inspections compared to those conducted during the same time period in 1990. (5,694 in 1990). As of June 30th, there were 1,309 active permits. This figure includes 418 town permits, 81 mobile home permits, and 810 county permits. The department processed 71 building code violations. This figure is a 48.5% decrease when compared to the number of violations processed during the same time period in 1990. (138 in 1990). As of June 30th, there were 69 building code violation cases in progress. ZONING COMPLIANCE The department investigated 112 zoning complaints and processed 115 zoning violations. This is a 13.8% decrease in the number of complaints investigated and a 12.8% decrease in violation cases when compared to those investigated and processed during the same time period in 1990 (130 complaints and 132 violation cases in 1990). As of June 30th, there were 140 zoning violation cases in progress. Livestock Judging Team members (1st year Senior team members) placed 5th among 23 teams . Twenty-four members participated as senators, speech contests and horse judging contests . 2. Approximately 20 members competed in the "Creative Cooks'" demonstration in the Greeley Mall on a Saturday in June and a similar number in "Cake Decorating" . Colorado State University. U.S. Department of Agriculture and Weld County cooperating. Cooperative Extension programs are available to all without discrimination. 3. Weld County 4-H Demonstration Day (June 9) identified 4 of 10 participants to represent us at State Fair in Pueblo. 4. Weld County 4-H Softball program is to conclude on July 25th in Kersey. 5. 4-H Exchange trip with Michigan, July 9-15. 6. Mark Cronquist presented a wildlife conservation program to 4-H members at the State Conservation Camp. 7. STATE 4-H DAIRY JUDGING CHAMPION TEAM - WELD COUNTY (Alvie Rothe, Coach) - July 10, 1991- State 4-H Dairy Judging Contest held in Weld County, hosted by the State 4-H Office and Dairy Specialist; four counties (Weld, Delta, Pueblo and Douglas) participating. 8. Nancy Hardy, a CSU summer intern student (no salary) is identifying projects and schools approximate for short-term 4-H project education in Greeley supervised by Mark Cronquist. She is promoting the after school 4-H project club and obtaining approval from school administration to conduct 4-H in the schools, where appropriate. It will open 4-H to more members of a more diverse audience. 9 . WELD COUNTY FAIR - AUGUST 2-5, 1991. Pre-entry deadline, July 15 - indicated heavy participation for '91. OTHER AG AND HOME ECONOMIC PROGRAMS 1. Colorado Farm Show ( '92) plans for educational programs, Curt Probert, Chairman, are well underway for major programs in General, Ag, Dairy, Beef and Partners in Ag. 2. Inloes - Rotational Beef Pasture Study program in progress with Crow Valley producers and US Forest Service. 3. Liess - Women's second, spring Financial Management program completed - 97 women. 4. Probert - Master Gardeners (9) continue to respond to 15-20 calls daily about Horticulture problems. 5. News Media/Visibility - A 3 to 5 minute radio program is now presented 5 days per week on KFKA and once weekly (Saturday) on KGRE. Local newspapers carry frequent news releases and a Weld County calendar of Events on a regular basis. 6. Pest and Weed Department - (Broda) - Time demands are intense to respond to land owner weed complaints (45-50 in last month) in addition to routine noxious weed control and roadside vegetative management programs.
