Box 458 Greeley, CO 80632-0458 HAND DELIVERED RE 1991 and 1992 taxes- Parcel R 1969886 Assessor, During early 1990 or early 1991, the Weld County Assessor's office sent notices to property owners requiring a response proving that certain parcels of land were "agricultural," so that these parcels would continue to be zoned and taxed as agricultural land. Failure to reply meant that the involved parcel would be taxed at a very significantly higher rate. The parcel referenced above was originally purchased by Jim and Virginia Shelton, Glenn and Beverly Webster, and Dorothy Reichert (now Corkran). My wife Lisa and I purchased the Sheltons' interest in the referenced parcel in November of 1990. Tax notices for this parcel were always sent to Mr. Shelton at his office - Shelton, Bedingfield and Kincaide, attorneys at law. As you probably know, Mr. Shelton died in 1989, leaving Mr. Kincaide as executor of his estate. Unfortunately for us, current owners of the parcel, the Weld County Assessor's office sent the land assessment notice to Mr. Kincaide's office. The problems in that office are a matter of public record. As a result, the current owners of the referenced parcel never received the land assessment notice, thus never having an opportunity to document that the parcel was indeed agricultural. I appreciate greatly the help of Phyllis A. Newby who has provided invaluable assistance in determining how this situation came about. We reviewed the improperly addressed land assessment notice. Accompanying this letter please find documents which prove that the referenced parcel of land has been used for agricultural purposes, as defined in the original land assessment notice. There is a notarized statement from Elmer Floyd Weiderspon, the rancher who has leased the land for the past 15 years! Second, I have included copies of the bank statements from the account set up to receive lease payments and pay appropriate fees/taxes, for the years 1989, 1990 and 1991. Finally, I have attached copies of the cancelled checks from Mr. Weiderspon, documenting lease payments for agricultural use of the referenced parcel, for the years 1989, 1990 and 1991. 920390 Francis M. Loustalet Page 2 Please consider this letter to be a formal request by the owners of the referenced parcel to have such parcel formally and properly zoned, assessed and taxed as "agricultural" in keeping with the definitions set forth in the original land assessment notice, for 1991 taxes, 1992 taxes, and all subsequent tax years during which the land continues in agricultural use.
