Condition of Approval 116: No additional storage or uses shall occur on the Special Review Permit property until the approved landscaping and screening plan has been completed. 2. Condition of Approval 117: The berming and fencing required by the landscaping and screening plan and the requirements of the State Highway Department Junkyard Permit shall be installed and completed within one year of approval by the Board of County Commissioners and the landscaping shall be installed and completed within 18 months of approval by the Board. The screening plan along the east side of the property shall be according to the approved State Highway Department Junkyard Permit. The landscaping and screening plan along Weld County Road 8 shall consist of 60-foot intervals in an alternating patter of: 1) a 6-foot solid wood fence on a 3-foot berm; and 2) Russian Olive trees on a 5-foot berm. Development Standard 711: The Site Specific Development Plan and Amended Special Review Permit is for a salvage, storage, and recycling facility as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 4. Development Standard 718: The approved landscaping and screening plan and the requirements of the State Highway Department Junkyard Permit shall be maintained at all times. Maintenance shall include the regular irrigation, weeding, fertilization, mowing, trash cleanup and pruning of all landscaping, the treatment or repair of all diseased, insect-ridden, broken or vadalized landscaping and fencing, and the replacement of dead or irreparable landscaping in substantially similar kind. 5. Development Standard 7119: The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. The inspection revealed violations of Condition of Approval #6, 7 and Development Standards # 1, 8, 19 and 20. A copy of these items from the approved resolution are enclosed. Weld County, Colorado DATE: January 15, 1991 ZCH# 71 After reviewing the conditions of approval and development standards that were approved by the Board of County Commissioners on November 9, 1988, I inspected the property. The property is not in compliance with conditions of approval #6 and 7 and development standards #1, 8, 19 and 20 as follows: Condition #6 states: 6. No additional storage or uses shall occur on the Special Review Permit Property until the approved landscaping and screening plan has been completed. The landscaping and screening plan has not been completed and other uses of the property are being conducted. Condition #7 states: 7. The berming and fencing required by the landscaping and screening plan and the requirements of the State Highway Department Junkyard Permit shall be installed and completed within one year of approval by the Board of County Commissioners and the landscaping shall be installed and completed within 18 months of approval by the Board. The screening plan along the east side of the property shall be according to the approved State Highway Department Junkyard Permit. The landscaping and screening plan along Weld County Road 8 shall consist of 60 foot intervals in an alternating pattern of: 1) a 6-foot solid wood fence on a 3-foot berm; and 2) Russian olive trees on a 5-foot berm. The Russian olive trees shall be a minimum of 4 feet in height of the time of planting with a maximum spacing of 4 feet between trees. The landscaping and screening plan and the state highway Department Junkyard permit have not been completed or installed as required. The portion of the screening plan that is in place appears to be within the right-of-way of Weld County Road 8. The State Highway Department junkyard permit has not been obtained. Development standard # 1 states: The Site Specific Development Plan and amended Special Review Permit is for a salvage, storage, and recycling facility as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. The property is not as submitted in the application materials and is not in (111.411 compliance with the approved standards. Development standard # 8 states: The approved landscaping and screening plan and the requirements of the State Highway Department Junkyard Permit shall be maintained at all times. Maintenance shall include the regular irrigation, weeding, fertilization, mowing, trash cleanup and pruning of all landscaping, the treatment or repair of all diseased, insect-ridden, broken or vandalized landscaping and fencing, and the replacement of dead or irreparable landscaping in substantially similar kind. The required landscaping and screening plan has not installed or maintained. The State Highway Department Junkyard permit has not been obtained. Development Standard # 19 states: 19. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filled in the office of the Department of Planning Services. The property is not being maintained in compliance with the approved development standards and no amendment has been approved. Development Standard # 20 states: 20. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the permit by the Board of County Commissioners. The property is not in compliance with approved Development Standards.
