Dear Assessor:
On behalf of Children's World Learning Centers, please accept this as a protest of the
1994 assessment in place upon the referenced property. This property is a Class C
construction daycare center built in 1975, located in a purely residential area.
It has been valued by the County on a cost approach basis, with a base cost of$50.07/sf
and a 45 year life expectancy. Physical depreciation in the amount 14% was allowed,
while no economic or functional obsolescence was applied. The resulting improvements
value jt$44.95/sf

Two other daycare properties at 4601 W. 9th Street and 4059 W. 11th Street are also
valued on a cost approach basis. 4601 W. 9th Street is assigned a 35 year life, a base cost
of$38.48/sf and 17% depreciation. It was built in 1979 and thus is newer than the
property under protest. Its resulting improvements value is $41.47/sf.
The daycare at 4059 W. 11th Street is assigned a 40 year life, a base cost of$45.71/sf and
5% depreciation. It was built in 1985 and its resulting improvement value is $43.01/sf.
Following is a comparison of the above referenced properties:

This comparison indicates that although the subject is the older of the three buildings it is
being assigned the higher value/sf, even higher than the considerable newer, nicer
Kindercare at 4059 W. 11th Street.
Per Marshall Swift, it appears the subject would qualify for physical depreciation of 26%,
based on the County's 40 year life.
The subject should qualify for some obsolescence deduction due to its single purpose use
category. Being located in a strictly residential area, the property can lend itself only to a
daycare or school use. If the daycare use were to cease, the property would basically have
very little commercial use potential
In order to equalize the subject property's value with the other two properties mentioned
above, and to recognize its economic obsolescence, we respectfully request the County to
deduct an additional 15% depreciation from its improvements value. This would result in
an improvements value of$136,931 ($192,861 less 29%), resulting in a total property
value of$159,931.
Thank you for your consideration of this request for adjustment of the referenced
property's 1994 assessment to $159,931. No 1993 abatement will be filed by this office.

Dear Petitioner(s) :
The Weld County Board of Equalization has set a date of Thursday, July 28,
1094, at or about the hour of 10: 00 A.M. , to hold a hearing on your
valuation for assessment. This hearing will be held at the Weld County
Centennial Center, 915 10th Street, Greeley, Colorado, in the First Floor
Hearing Room.
You have a right to attend this hearing and present evidence in support of
your petition. The Weld County Assessor will be present before the Board.
The Board will make their decision on the basis of the record made at the
aforementioned hearing, as well as your petition, so it would be in your
interest to have a representative present. If you plan to be represented
by an agent or an attorney at your hearing, prior to the hearing you shall
provide, in writing to the Clerk to the Board's Office, an authorization
for the agent or attorney to represent you. If you do not choose to
attend this hearing, a decision will still be made by the Board by the
close of business on August 5, 1994, and mailed to you on or before
August 10, 1994.
Because of the volume of cases before the Board of Equalization, all cases
shall be limited to 15 minutes. Also due to volume, cases cannot be
rescheduled. It. is imperative that you provide evidence to support your
position. This may include evidence that similar homes in your area are
valued less than yours or you are being assessed on improvements you do
not have. Please note: The fact that your valuation has increased cannot
be your sole basis of appeal. Without documented evidence as indicated
above, the Board will have no choice but to deny your appeal .
