APPROVED WITH CONDITIONS
The Department of Planning Services has determined through the review that the standards of
Sections 11.5.1 through 11.5.6 of the Weld County Subdivision Ordinance have been met. This
Recorded Exemption is approved with the following conditions in accordance with information
submitted in the application and the policies of the County.
A Weld County septic permit is required for any proposed home. The septic system shall be
installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations.
Any change in use of the property will require an evaluation by the Department of Transportation.
Prior to recording the plat:
a. The applicant shall submit evidence that an ISDS evaluation has been completed by the
Weld County Health Department on all existing septic systems.
b. The right-of-way for both SH 71 and SH 14 shall be shown on plat, as noted in the referral
from the Department of Transportation, dated October 10, 1994.
c. The easements for the well located on Lot B shall be shown on plat.
The Individual Sewage Disposal System permit shall be finalized and approved by an Environmental
Protection Specialist within one (1) year of the application date.
The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in
the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with
the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be
submitted within sixty (60) days from the date of approval by the Department of Planning Services.

On October 21, 1994, an evaluation of the existing individual septic disposal
system at 41355 State Highway 71, Stoneham, Colorado; E2 of Section 02, Township
07N, Range 56W, was conducted by Jeffrey L. Stoll, Director, Environmental
Protection Services.
The existing individual septic disposal system is not of sufficient size and
capacity to adequately handle the proposed load.
Therefore, be advised that you are required to have the following alteration(s)
made to accommodate the proposed alterations to the structures(s) served:
The mobile home is currently not in use. A repair permit is
required and the system will need to be replaced prior to
occupation. A site evaluation will be needed to determine the
required size.
A copy of the evaluation has been forwarded to the Department of Planning

Dear Mr. Hodges:
We have reviewed the above referenced proposal to split a 6 acre lot from a 306 acre parcel.
The proposed water supply is to be from wells. The applicant has one well, permit No. 50196,
issued in 1971 for domestic use. This well will serve the existing dwellings on the 6 acre lot. A
permit for a domestic well may be obtained for the larger parcel, the same as for any parcel of 35
acres or more. We have no objection to this proposal.

Dear Todd,
I have reviewed the Louis and Lorrain Bornhoft Recorded Exemption
and offer the following comments :
RIGHT-OF-WAY Right-of-way has not been addressed by the submittal ;
however, projected traffic along SH 71 indicates the need for a
120 foot total ROW, 60 feet each side of the highway centerline .
Projected traffic along SH 14 indicates the need for a 150 foot
total ROW, 75 feet each side of the highway centerline.
Additional width to meet these projected needs should be protected
by reservation or, preferably, dedication as permitted by County
regulations .
ACCESS The application states that both parcels of the property are
to continue their existing use and that no construction is
planned. The application further states that there are existing
dwellings on Lot A. As a change of use of the property is not
proposed, re-evaluation of access is not necessary at this time .
Access to the state highway is controlled by the State Highway
Access Code, and the subdivision of property requires that access
be brought into conformance with the Code at such time as the
property changes use . Conformance with the Code along this
section SH 71 and SH 14 would require that a single access for the
312 acres be provided by access to SH 71 . The applicant should be
aware that at such time as a change of use for either parcel would
be proposed, the Department would have a warrant to re-evaluate
access . The re-evaluation could require closure, relocation or
improvements to the overall access picture and should result in a
single access for the 312 acres . The plan does not show access to
SH 14 , and shows multiple accesses to SH 71 . Upon development, if
it is not possible to provide access for Lot B by way of a
properly placed single access for both lots, it may be possible to
request an access for Lot B at the west end of the property (at
the 1/2 mile line of Section 2) if the topography and other site
considerations allow for such an access .

RECORDED EXEMPTION QUESTIONNAIRE
•
1. Explain the reason for the proposed recorded exemption and how each
proposed lot will be used. The current owner is selling the existing improvements
from the farmland he owns. The balance of the property will remain as dry
farmland and land signed into the CRP program.
2. Describe the location, size and present use of the area where each
proposed new lot will be created. The proposed parcel to be split where the
existing improvements are is 6 acres, and is located in the NE1/4SE1/4 of Sec. 2
T7N, R56W of the 6th P.M. , and is located adjacent to State Hiway #71. The parcel
that this tract is being split from is the E1/2 of Sec. 2, T7N, R56W of the 6th
P.M. , which is 30b acres of farmland and the land signed into the CRP program.
3. Explain how the proposal is consistent with the Weld County Comprehensive
Plan and any adopted municipal plan, if applicable. This proposal is not
changing the current use of the property and is not removing any lands from
agricultural production. Some of these improvements have been situated on this
property since the early 1900's.
4. Explain how the uses permitted will be compatible with existing uses
surrounding the proposed recorded exemption. We are not proposing new uses or
improvements to the property. The property will remain the same and compatible
to the area.
5. Explain how the proposal is consistent with the intent of the zoning
district it is located within. The area is zoned agricultural and the proposal
does not propose anything different than permitted.
6. Explain how the proposal is consistent with efficient and orderly
development. We are not proposing any new development. The existing
improvements will be sold and the remaining parcel will be dry farmland and
CRP land.
7. Explain how adequate provision for the protection of the health, safety,
and welfare of the inhabitants of the neighborhood and the County will be
accomplished. Nothing will change. The nearest neighbors are 1/4 mile and
1 mile away. It has been this way since the early 1900's. We are not
changing the existing use.
