H. No. 254 County- Weld - (Boulder) AGREEMENT TO PARTICIPATE IN THE COST OF HIGHWAY .J. 1.li m. ui.. THIS ACCT entered into this 22dday of April, 1953, by and between THE STATE HIGHWAY COMMISSION OF COLORADO, a public corporation, for the use and benefit of the DEPARTMENT OF HIGHWAYS of the STATE OF COLORADO, hereinafter called the "Department", and the COUNTY OF WELD, hereinafter called the "County", WPIIEBSETH that WHEREAS the Department has included in the Budget for 1950; dated January 27, 1950, a Federal Aid Secondary Project designated as S 0072 (1), to consist of improvements on State Highway No. 254, Boulder County Line - Jet. S. H. No. 185. (and West to Longmont in Boulder County), for which the sum of $50,000.00 has been allocated, and in which the County has previously agreed to participate to the extent of twenty-five (25) per cent of the cost of the project, and WHEREAS the Department has included in the Budget for 1953-1954, dated January 2, 1953, an additional allocation in the sum of $170,000.00, and in which the County has previously agreed to participate to the extent of twenty- two (22) per cent of the added amount, and WHEREAS the Department and the County are informed that the current esti- mated cost of the work is $228,000.00, as against a total allocation of $220,000.00, and the County is agreeable to participate also to the extent of twenty-two (22) per cent of the additional $8,000.00 to be matched with Department and Federal funds, NOW, THEREFORE, in consideration of the premises and the mutual covenants and agreements herein contained, and the faithful performance thereof, the parties hereto promise and agree as follows: 1. The Department will prepare the plans, specifications and estimates for the work, will advertise for bids, will award the contract, prepare the monthly and final estimates, and pay the contractor according thereto. Also, the Department will arrange for the force account work by railroad, utility and irrigation companies. 2. The County will secure at its own expense all right of way re- quired for project, as indicated by right of way lines shown on project construction plans. 3. It is the intent of this Agreement that the County will reim- burse the Department in the amount of twenty-five (25) per cent of the first $50,000.00 expended on the work and in the amount of twenty-two (22) per cent of the remainder of the final cost of the project, both exclusive of right of way, and with the understanding that the charges for Engineering will not exceed six (6) per cent of the construction cost. If, after bids are received it appears that the final cost will be materially in excess of -1- / C9/.0/ it-7 (1 n • S 88Zt$l)Weld (Boulder) the estimated cost above named, any obligation of the County, in excess of $51,660.00 will be subject to negotiation. 4. The Department will submit each month a statement covering twenty- five (25) per cent or twenty-two (22) per cent of the cost of the construction work on the project as represented by the progress estimate paid to the con- tractor, as conditioned in Item 3 above. This will not include any charges for engineering, which charges will be billed when the project is completed and final estimate made. The County agrees to promptly pay approved statements submitted as per this paragraph. 5. The County further agrees that when the project is completed and ready for traffic, the County will maintain the same in a satisfactory manner, and if said project is not so maintained the Department is authorized to do said maintenance with its own forces and to bill the County for the cost thereof. If payment is not mode within thirty (30) days after receipt of said bill or bills, the State Treasurer is authorized and requested to trans- fer to the State Highway Fund, from the County's apportionment of the Motor Vehicle Fees, Chapter 16, C.S.A. , 1935, and the Motor Fuel Taxes, Chapters 128 and 130, S. L. 1947, sufficient funds to cover the delinquent payment or payments. 6. This Agreement shall not be deemed valid until it shall have been approved by the Controller of the State of Colorado, or by such assistant as he may designate. 7. This Agreement shall be binding upon and inure to the benefit of the successors and assigns of the parties hereto, respectively. 8. This Agreement is executed under authority of Section 6, Chapter 57, S L. 1952, and with reference to the signatories on behalf of the County by virtue of a resolution passed at a meeting of the Board of County Com- missioners held on , 1953, a certified copy of which is attechedhereto.
