EI.F£Fcl EEsic Fe Fi 4 a;I rF r RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A GRAVEL MINING OPERATION IN THE AGRICULTURAL ZONE DISTRICT - DANIEL AND MILDRED BUXMAN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 7th day of March, 1990, at the hour of 10: 00 a.m. in the Chambers of the Board for the purpose of hearing the application of Daniel and Mildred Buxman, 30598 Weld County Road 29, Greeley, Colorado 80634, for a Site Specific Development Plan and Special Review Permit for a gravel mining operation in the Agricultural Zone District on the following described real estate, to-wit: Part of the SEi NW} and NE$ SWI of Section 33, Township 6 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Vern Nelson, of Nelson Engineers, and WHEREAS, Section 24 .4 .2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Sections 24 .7 , 44 . 1 , 44 .2 and 44 .3 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4. 2 of the Weld County Zoning Ordinance as follows: a. This proposal is consistent with the Weld County Comprehensive Plan' s Mineral Resource Goals and Policies, the Urban Growth Boundary Area Goals and Policies, and the Transportation Goals and Policies. The Conditions of Approval and Tit Qsqs 900222 Page 2 RE: USR - BUXMAN Development Standards will ensure that these goals and policies are met. The Comprehensive Plan encourages the extraction of mineral resources when the mining plan promotes reasonable and orderly development of the mineral resources. b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c. Conditions of Approval and Development Standards will ensure compatibility with the existing surrounding land uses. Surrounding land uses include agricultural production, pasture, the Cache La Poudre River, and rural residential home sites. d. The proposed use will not have an adverse effect on the existing and future development of the surrounding area as permitted by Weld County and the City of Greeley' s Comprehensive Plans. The City of Greeley Planning Commission has reviewed this proposal and recommended conditional approval. The conditions are addressed in the attached Conditions of Approval and Development Standards. e. The Special Review Permit site is located in the 100-year flood plain. Special Review Permit Development Standards address the overlay district requirements. No other overlay districts affect the site. f. Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a gravel mining operation in the Agricultural Zone District on the hereinabove described parcel of land be, and hereby is , granted subject to the following conditions: 1 . The attached Development Standards for the Special Review Permit shall be placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the office of the Weld County Clerk and Recorder within 15 days of approval by the Board of County Commissioners. 900222 Page 3 RE: USR - BUXMAN 2 . The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . Prior to the Special Review Permit activity occurring on the site, evidence shall be submitted to the Department of Planning Services that: a. The Division of Water Resources has approved a well permit or other legal water supply for the mining operation. b. A 404 permit has been issued by the Army Corps of Engineers, if applicable. c. An emissions permit has been obtained from Air Pollution Control Division, Colorado Department of Health, for fugitive dust and odors, if required. d. -The Use by Special Review activity will not cause _injury to vested or conditional water rights as set forth in Section 44 . 4 . 11 of the Weld County Zoning Ordinance. 4 . Prior to recording the Special Review Permit plat: -a. An o₹f-site road improvements and maintenance agreement shall approved by the Board of County Commissioners to mitigate impacts generated by the operation to County roads. A copy of the agreement shall be submitted to the Department of Planning _Services. b. The Special Review Permit plat shall be amended to show a total of fifty feet right-of-way reservation from the centerline of Weld County Road 29 . c. 72he applicant shall amend the plat to show setback of the excavation boundaries to be in compliance with requirements of the Mined Land Reclamation Board. 900222 Page 4 RE: USR - BUXMAN 5 . The following note shall be placed on the Special Review Permit plat: NOTE : The Mined Land Reclamation Board has the authority to issue permits for mining and reclamation activities. Activities related to mining and reclamation are, therefore, under the jurisdiction of the Mined Land Reclamation Board. However, Weld County has jurisdiction of those matters outlined in the Development Standards. The Site Specific Development Plan and Special Review Permit is for a gravel mining operation as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 3 . Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 , C.R.S. , as amended. 3 . The gravel mining operation shall comply with Section 44 .4 of the Weld County Zoning Ordinance. Any violation of these regulations shall be grounds for enforcement of Section 44 .6 of the Weld County Zoning Ordinance. 4 . The haul route for the mining operation shall be Weld County Road 29 (71st Avenue) north to Weld County Road 64 . No hauling shall be allowed south on Weld County Road 29 . The applicant shall post a sign at the exit from the pit explaining this Standard. 5 . The property shall be maintained in compliance with the Weld County Flood Hazard Overlay District requirements. 6 . The property shall be maintained in compliance with Section 404 of the Clean Water Act, if applicable. 7 . The mining activity shall be maintained in compliance with the requirements of the Oil and Gas Conservation Commission. 8 . Waste oil and other associated liquid and solid wastes shall -be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 9. No permanent disposal of wastes shall be permitted at this site. 10. All waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 11 . The Special Review Permit site shall be maintained in compliance with the required emissions permit obtained from the Air -Pollution Control Division, Colorado Department of Health, for fugitive dust and odors. 900222 Page 2 DEVELOPMENT STANDARDS - BUXMAN 12 . Fugitive dust shall be controlled on this site -at all times. 13 . The maximum permissible noise level shall not exceed the light industrial limit of 70 dB (A) , as measured according to 25-12-102, Colorado Revised Statutes. 14 . an individual sewage disposal system or a vault shall be used as the sewage disposal system for the site. The system or vault shall to installed according to the Weld County Individual Sewage Disposal Regulations. 15 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 16- The property owner or operator shall be responsible for complying with the Design Standards of Section 24 .3 of the Weld County Zoning Ordinance. 17. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 .6 of the Weld County Zoning Ordinance. 18. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted -access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 19. The Special Review area shall to limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. -Any -other changes shall be filed in the office of the Department of Planning Services. 20 . The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. During a December 18, 1989 site visit conducted by me, it was found that approximately 0.7 acres of wetland exist within the proposed mining area. See attached map showing approximate wetland area. Based on the information provided, this office has determined that the proposed work is authorized by the Department of the Army Nationwide Permit found at 33 CFR Part 330.5(a)(26). Enclosed is a fact sheet which fully describes this Nationwide Permit and lists the Special Conditions which must be adhered to for this authorization to remain valid. Although an Individual Department of the Army Permit will not be required for the project, this does not eliminate the requirement that other applicable Federal, State or Local Permits be obtained as required. Please note that deviations from the original plans and specifications of the project could require additional authorization from this office. We cannot recommend approval of this proposal until the well permit has been obtained. We could not issue a well permit without an augmentation plan approved in Water Court or a substitute water supply plan approved by the State Engineer because the proposed well (ground water lake) is located in an over-appropriated basin, . The statute (Section 37-90-137 (II) (e) (II) , C.R.S. (1973) (1989 Supp. )) also imposes a fee to be collected with the plan for augmentation or plan of substitute supply. The setback requirements by the Mined Land Reclamation Division are 100 feet from highways and property lines, and 200 feet from rivers. The application materials state there will be no impact on Weld County Road 29. The site is located east of Weld County -Road 29 , one mile north of Fourth Street, Greeley, Colorado, and the site abuts the north side of the Cache La Poudre River. Properties along the Cache La Poudre River have a high commercial value for sand and gravel as seen by the number of gravel mines in the area. As the Weld County Comprehensive Plan states , the present economy along the front range corridor is causing an increased demand for sand and gravel extraction in Weld County. To be con- sistent with the Comprehensive Plan, extraction must follow a rehabilitation plan, which is presented in the application. The location is consistent with surrounding mines and is compatible -with the Comprehensive Plan guidelines on mineable lands . The area has been investigated for its potential use as farm- land. Due to the relatively thin layer of overburden and poor surface drainage, grasses and weeds are primary source of vegeta- tion. Table 5 of the U. S. Soil Conservation Service ' s "Soil Survey, Weld County, Southern Part" reveals yields of crops to be poor to marginal. The land to the north of the site is agricultural . The land to the south of the site on the bluffs overlooking the river has been urbanized. The site lies within the 100-year floodprone zone; however, the applicant proposes mitigation to minimize damage to permanent structures. The site does not lie in a geologic hazard zone or the Weld County airport overlay district area. The operator intends to begin mining immediately after application approval, approximately January 1990 , and operate for approximately 16 years, selling 25 , 000 tons per year, which will vary due to economics . 2. and 3 . The overburden averages about 3 feet thick and will be stockpiled on the westerly portion of the site until operator begins to reclaim the east half . Then excess overburden will be used to create an irregular shoreline in the excavated area. Topsoil will be stockpiled on Buxman' s farm adjacent to the 9 . 6 acres and out of the 100-year floodprone zone. 4. The gravel thickness to be mined averages approxi- mately 10 feet. 5 . Ingress and egress will be located on Weld County Road 29 at the northwest corner of the site . No major components are anticipated. Any processing will be handled offsite by the operator ' s clients . 6 . See Exhibit E. The mineable area comprises 7 . 7 acres ( 335 , 412 s . f . ) , constituting a five-sided figure with the longest reach being the boundary along the Cache La Poudre River. 7 . No proposed roads are anticipated since the mined area lies along Weld County Road 29 . Access will be directly from a public road. Due to the low production anticipated, no additional stress to the county road is contemplated. 8 . No water is to be used in conjunction with the mining operation . 9 . No dewatering will be used for the mining opera- tion. Gravel will be mined underwater and deposited on a stockpile with slopes allowing water to drain back into the excavation . 10 . The operator intends to comply with applicable Colorado water laws and regulations governing water rights through use of existing water rights for augmentation, if required . No water is con- sumed or generated as a result of the mining operation. 900222 11 . No on-site processing of mined gravel is antici- pated. Overburden will be used to widen and stablize the existing Cache La Poudre River embankment.
