HomeMy WebLinkAbout900763.tiff RESOLUTION RE: ACTION OF BOARD CONCERNING DEMOLITION OF DANGEROUS BUILDING - VEGA WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Department of Planning Services informed the Board that Abelardo and Nancy Vega have a building on their property which is considered to be dangerous to persons under the Uniform Code for the Abatement of Dangerous Buildings, and WHEREAS, said property is described as part of the E} SWI SWi of Section 11 , Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado, located at 2850 East 18th Street, Greeley, Colorado, and WHEREAS, this matter was heard by the Board at meetings of April 16 , and June 20 , 1990 , and continued because an investigation was being conducted by the insurance company, and WHEREAS , on August 17, 1990 , Michael S . Williams , insurance agent, informed the Planning staff that the investigation continues , but removal of the foundation should be completed before the August 22 , Board meeting, and WHEREAS , at the meeting of August 22 , the Department of Planning Services advised the Board that the cleanup and removal of the debris has not been completed, and WHEREAS, the Board deems it advisable to authorize the cleanup and removal of the debris; seek bids for said cleanup and removal by a private contractor; and set a hearing date to consider recovering the cost of said work, at which time an itemized account of the expenses incurred will be submitted by the Planning staff. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the cleanup and removal of debris from the hereinabove described property be, and hereby is, approved. 900763 Page 2 RE: DANGEROUS BUILDING - VEGA BE IT FURTHER RESOLVED by the Board that the Purchasing Department be, and hereby is , authorized to seek bids from a private contractor for the cleanup and removal of said debris. BE IT FURTHER RESOLVED by the Board that November 28 , 1990 , be set as the hearing date to consider recovering the cost, as submitted by the Department of Planning Services , of the cleanup work, with said recovery being by special assessment or as a personal obligation of the property owner. The staff would also recommend that the Board set November 28, 1990, as the hearing date to consider recovering the cost of the clean-up work by special assessment or as a personal obligation of the property owner. On November 28, 1990, the staff will present an itemized account of the expense incurred by Weld County to complete the clean up of the property. 900763 A0 ! Williams, American Family Insurance Property Claims Representative, who indicated that the property loss is still under investigation as possible arson. Mr. Williams indicated he would see that the remaining foundation is removed. He will work with the property owner to recover the costs. I informed Mr. Williams that the Board of County Commissioners is scheduled to consider this matter on Wednesday, August 22. Williams, American Family Insurance Property Claim Representative, who indicated that the property loss is still under investigation as possible arson. He would like to request another two month extension of time to settle the claim and begin construction of a new residence on the property. There has been no change to the property from the April 12, 1990, inspection. The foundation remaining on the property will be removed when the new construction begins.
