RESOLUTION
RE: APPROVE INCREASED FEE SCHEDULE FOR FEES COLLECTED BY THE WELD COUNTY
DEPARTMENT OF PLANNING SERVICES FOR PROCESSING AND REVIEWING LAND-USE
PERMIT APPLICATIONS
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 3rd day of January, 1994, at 9:00
a.m. , in the Chambers of the Board for the purpose of considering an increased
fee schedule for fees collected by the Weld County Department of Planning
Services for processing and reviewing land-use permit applications, and
WHEREAS, after study and review, the Board deems it advisable to approve
the proposed fee schedule, effective January 1, 1994, a copy of which is attached
hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the attached fee schedule for fees collected by the Weld
County Department of Planning Services for processing and reviewing land-use
permit applications be, and hereby is, approved, effective January 1, 1994.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 3rd day of January, A.D. , 1994, nunc pro
tunc January 1, 1994.

An amendment to any of the above applications shall be treated as a new application
and will be charged the appropriate application fee unless otherwise noted. Once an
application is accepted for processing, the application fee is not refundable. Fee
for the Hazardous Waste Disposal Site may be refunded in whole or in part by a
decision of the Board of County Commissioners. The amount of the refund, if any,
shall be determined, in part, based upon the cost incurred by the County in reviewing
the application and shall include, but not be limited to, outside consultant work,
staff time, and state and local agency fees.

The following business was transacted:
I hereby certify that pursuant to a notice dated December 20, 1993, and
duly published December 23, 1993, in the Windsor Beacon, a public hearing
was conducted to consider an increased fee schedule for fees collected by
the Weld County Department of Planning Services for processing and
reviewing land-use permit applications. Bruce Barker, County Attorney,
made this a matter of record. Chuck Cunliffe, Department of Planning
Services Director, entered the favorable recommendation of the Planning
Commission into the record as written. He said the new fees will be
effective January 1, 1994. No public testimony was offered concerning
this matter. Commissioner Kirkmeyer moved to approve the increased fee
schedule for fees collected by the Weld County Department of Planning
Services for processing and reviewing land-use permit applications, based
on the recommendations of the Planning staff and the Planning Commission.
The motion was seconded by Commissioner Harbert, and it carried
unanimously.
This Certification was approved on the 5th day of January, 1994.

The Board of County Commissioners of Weld County, Colorado, will conduct a public
hearing at 9:00 a.m. , on Monday, January 3, 1994, in the Chambers of the Board
of County Commissioners, Weld County Centennial Center, 915 10th Street, First
Floor, Greeley, Colorado, for the purpose of considering an increased fee
schedule for fees collected by the Weld County Department of Planning Services
for processing and reviewing land-use permit applications.
All persons in any manner interested in the proposed fee schedule are requested
to attend and may be heard.
Should any interested party desire the presence of a court reporter to make a
record of the proceedings, in addition to the taped record which will be kept
during the hearing, the Clerk to the Board's Office shall be advised in writing
of such action at least five days prior to the hearing. The cost of engaging a
court reporter shall be borne by the requesting party.
BE IT ALSO KNOWN that copies of the proposed increased fee schedule may be
examined in the office of the Clerk to the Board of County Commissioners, located
in the Weld County Centennial Center, 915 10th Street, Third Floor, Greeley,

RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS
Moved by Ron Sommer that the following resolution be introduced for passage by
the Weld County Planning Commission. Be it resolved by the Weld County Planning
Commission that the proposed land-use fees be recommended favorably to the Board
of County Commissioners. The new fees are recommended to become effective
January 1, 1994.

Subject:
Application fees should bear some relationship to the actual costs involved in
the processing of land-use and development applications. Two philosophies exist
as to who benefits and should pay for the processing of applications. The first
philosophy is that the applicant, developer, or users are the beneficiaries of
the processing and should pay all the costs associated with the processing. The
second philosophy is that the applicant and community in general are the
beneficiaries and that both should bear the costs of processing with application
fees and dollars collected by general taxation. The fees recommended for 1994
were developed utilizing the philosophy that the applicant or developer benefits
the most from the approval of the application through increased market value of
the property or increased uses on the property and should pay for at least 50%
or more of the application processing and the remainder coming from the general
fund.
The attached materials indicate the amount needed to recover 100% of the direct
and indirect processing costs for each type of application and the proposed fees
for 1994. The new fees are recommended to become effective January 1, 1994.
