VJ RESOLUTION RE: APPROVE RESUBDIVISION OF LOTS 1 THROUGH 9 , BIRD SUBDIVISION - UNION COLONY BANK AND GARY M. AND KIMBERLY A. WIEDEMAN WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , on the 31st day of January, 1990 , in a public meeting, the Board considered the request of Union Colony Bank and Gary M. and Kimberly A. Wiedeman for the resubdivision of Lots 1 through 9 , Bird Subdivision, Weld County, Colorado, and WHEREAS , the applicants were represented by Bob McComb, and WHEREAS, the Board reviewed the submitted evidence and heard the testimony of those present, and WHEREAS, the Board, having considered the recommendation of the Weld County Planning Commission, finds that the resubdivision request concerning Lots 1 through 9 , Bird Subdivision, shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 6-4 B. of the Weld County Subdivision Regulations. 2 . The applicant has shown compliance with Section 6-4 E. of the Weld County Subdivision Regulations as follows: a. No lot or parcel of land will be created that is less than the minimum requirements for area as established by these regulations or other applicalbe ordinances. b. Drainage easements or rights-of-way reserved for drainage will not be changed. Drainage improvements previously approved for the nine lot subdivision will not be necessary for the proposed two lots which drain to the east. c. The proposed resubdivision plat will not be altered in any way which will adversely affect the character of the plat filed. Reducing the number of lots and increasing the size of the two proposed lots will be compatible with the existing surrounding parcels. Each lot will have one access onto 71st Avenue.
