Southard, Attorney, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.3 of the Weld County Zoning Ordinance as follows: A. The proposal is consistent with the Weld County Comprehensive Plan's Urban Growth Boundary goals and policies. A representative of the Town of Milliken has responded the Town has no objection to this request. B. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. PL0830 910132 Page 2 RE: USR - ANNA WYSOWATCKY C. The uses which would be permitted on the property will be compatible with the existing surrounding land uses which include agricultural production, oil and gas production, and the Wysowatcky family residence. The use of the property will be compatible with the future development of the surrounding area as permitted by the Agricultural zone district. D. No overlay districts affect the site. E. Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a greyhound breeding kennel (maximum of 14 dogs) in the A (Agricultural) Zone District, on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Within 30 days of approval by the Board of County Commissioners: A. The plat shall be amended to show the relocation of the water hydrant. B. A noise abatement and response plan shall be submitted to the Department of Planning Services. The Site Specific Development Plan and Special Review Permit is for a greyhound breeding kennel (maximum of 14 dogs) in the Agricultural Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 C. R. S. , as amended. 3. The applicant shall remove, handle, and stockpile manure from the kennel area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies or insect pests, or pollutant runoff. The manure storage site shall have a water-tight surface which does not permit seepage or percolation of manure pollutants into the ground. 4. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 5. No permanent disposal of wastes shall be permitted at this site. 6. Wood shavings, sawdust, and waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 7. Fugitive dust shall be controlled on this site. 8. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to 25-12-102, C. R. S. , as amended. The noise abatement and response plan shall be implemented at the request of the Health Department in the event that noise levels detected off site of the facility meet or exceed the 80dB(A) limit as specified by the use. The plan will also be implemented in the event that the Health Department receives a significant number of noise complaints and in the judgement of the Director of Public Health there exists a noise condition requiring abatement. 9. The property shall be maintained in compliance with Section 45.6 of the Weld County Zoning Ordinance. 10. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 910132 Page 2 RE: DEVELOPMENT STANDARDS - ANNA WYSOWATCKY 11. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 12. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 13. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 14. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the Department of Planning Services. 15. The property owner or operator shall be responsible for complying with all the foregoing Development Standards. Bruce Barker, Assistant County Attorney, made this a matter of record. Lanelle Curry, Current Planner, represented the Department of Planning Services. She asked the recommendation of the staff and the Resolution of the Planning Commission be entered into the record as written, except that Condition of Approval #3-A should be amended to read "the plat shall be amended to show the relocation of the water hydrant". William H. Southard, Attorney, represented the applicant, and stated they were agreeable to the Planning Commission Resolution and staff recommendation being entered into the record, as amended. Commissioner Harbert moved the Board approve the request of Anna Wysowatcky for a Site Specific Development Plan and Special Review permit for a greyhound breeding kennel (maximum of 14 dogs) in the "A" (Agricultural) Zone District based on the recommendation of the staff and the Planning Commission, with Condition of Approval 3-A being amended as herein stated. The motion was seconded by Commissioner Kirby. Motion carried unanimously. This Certification was approved on the 4th day of March, 1991. The applicant shall remove, handle, and stockpile manure from the kennel area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies or insect pests, or pollutant runoff. The manure storage site shall have a water-tight surface which does not permit seepage or percolation of manure pollutants into the ground. 4. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 5. No permanent disposal of wastes shall be permitted at this site. 6. Wood shavings, sawdust, and waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris , and other potential nuisance conditions. 7. Fugitive dust shall be controlled on this site. 8. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. The noise abatement and response plan shall be implemented at the request of the health department in the event that noise levels detected off site of the facility meet or exceed the 80dB(A) limit as specified by the use. The plan will also be implemented in the event that the health department receives a significant number of noise complaints and in the judgement of the Director of Public Health there exists a noise condition requiring abatement. 9. The applicant shall remove, handle, and stockpile manure from the kennel area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, or insect pests, or pollutant runoff. The manure storage site shall have a water- tight surface which does not permit seepage or percolation of manure pollutants into the ground. 2. All liquid and solid wastes, shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 3. No permanent disposal of wastes shall be permitted at this site. 4. Wood shavings, saw dust, and waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 5. Fugitive dust must be controlled on this site. 6. Maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. The Division requires that a noise abatement and response plan be submitted prior to operation of the facility. This plan will be implemented at the request of the health department in the event that noise levels detected off site of the facility meet or exceed the 80 dB(A) limit as specified by the use. The plan will also be implemented in the event that the health department receives a significant number of noise complaints and in the judgement of the Director of Public Health. There exists noise condition requiring abatement. 7. An I.S.D.S. Evaluation on all existing septic systems will be necessary, prior to issuing the required septic permits on the existing systems. The proposed operation is a family owned, family cnerated greyhound breeding kennel. Kennel as defined by Webster's Dictionary is a place where dogs are kept or bred. But various agencies impose various definitions which take the actual use out of context. Therefore, for the purpose of this application the term kennel is defined as a glorified dog pen, consisting of ten (10) individual runs located on 0.56 acre of non-irrigated, non-productive land. The runs constructed out of chain link fencing as well as field fencing are 100 feet long and 10 feet wide. The fencing is buried in cement. The perimeter of the run is surrounded by a 6foot privacy fence constructed from cedar panels. The surrounding property consists of non-irrigated pasture. Neighboring residential structures include one house 3/4 mile to the west, two houses 1/2 mile to the east, more than four miles to the north and more than 3 miles to the south. The family dwelling is approximately 300 feet to the east of the k.-nnel site. The maximum number of users will be three family members. There are not specific hours of operation. The Little Thompson Water District supplies the water and a hydrant located in the pasture is the delivery source. Access to the site is via the private, residential driveway. Vehicular traffic will not change with the proposed use. Personal cars and pickups are the vehicles using the driveway which average an ingress and egress of twice per day. No sewage facilities are required for the proposed use since no grooming or washing takes place. Fire protection to the property is serviced by the Johnstown fire department. Fire protection measures were implemented when the runs were contructed out of steel and cement. Greyhound, canines are not to exceed fourteen (14) at any one time. There are no wastes, stockpiles or storage areas associated with the use. Dog runs are scooped twice daily, and fecal matter is disposed of in a double iron—clad garbage bags which is deposited into a sanitation dumpster. The dumspter is emptied weekly by Bunting Trash Removal. As depicted by the CDS survey/plat map a 16X18 area has been reserved in the event of the construction of barn to house supplies and the dogs during inclement weather. This 0.56 acre will be returned to a pasture or horse corral usage upon cessation of the proposed use. PART III APPLICATION REQUIREMENTS The proposed site is three miles to the north of the nearest municipality and is considered within the urban growth boundary. The neighboring property to the West owned by .Weideman is non-productive pasture land that has been turned into a waste pond for milk whey. Since the property is currently zoned agric vltural and has been in the family for thirty-six years and is the intent to remain in the same family for years to come there is no forseeable changes in the zoning which does not conflict with county comprehensive plan.
