RE: APPROVAL OF TEMPORARY PERMIT FOR 3.2% BEER LICENSE FOR ALVIN AND ABRAHAM
GARCIA, DBA GARCIA STORE, 1517 NORTH 25TH AVENUE, GREELEY, COLORADO
80631-9508
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, Alvin and Abraham Garcia, d/b/a Garcia Store, 1517 North 25th
Avenue, Greeley, Colorado 80631-9508, have presented to the Board of County
Commissioners of Weld County, Colorado, an application for a Change of Ownership
of a 3.2% Beer License, for the sale of fermented malt beverages, containing not
more than 3.2% of alcohol by weight, for consumption off the premises only, said
License previously held by Alvin and Juanita Garcia, dba Garcia Store, and
WHEREAS, Section 12-47-106.5, C.R.S. , which became effective July 1, 1991,
allows for the issuance by the Board of County Commissioners of a temporary
permit to the transferee of an existing liquor license to authorize the
transferee to conduct business and sell alcoholic beverages at retail in
accordance with said license, subject to compliance with certain conditions, and
WHEREAS, Mr. Garcia has complied with all of the conditions set forth in
said Section, and
WHEREAS, Mr. Garcia has also submitted the required application fee for
said temporary permit of $100.00.
NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners of
Weld County, Colorado, having examined Mr. Garcia's application and other
qualifications for the transfer of the 3.2% Beer License, and having considered
Mr. Garcia's request for a temporary permit does hereby grant to Alvin and
Abraham Garcia, dba Garcia Store, 1517 North 25th Avenue, Greeley, Colorado
80631-9508, a Temporary Permit to conduct business and sell 3.2% fermented malt
beverages for consumption off the premises, only at retail at said location in
accordance with the license of the transferors, Alvin and Juanita Garcia, dba
Garcia Store, subject to all other rules and regulations set forth by the Board
of County Commissioners of Weld County, Colorado, for a period of 120 days, or
until such time as the application for Change of Ownership is approved by the
State of Colorado, whichever shall occur first.
