WHEREAS, By Treasurer's Deed from Weld County, Colorado a quasi-muncipal THE BLK 34 TOWN OF HUDSON,
corporation, dated October 2, 1945, recorded in Book 1162 at page 268 of the Weld County records, COLORADO:
Harold H. Seaman, Its Commissioner to execute said deed and as County Treasurer of Weld County 34
conveyed to said FRANK A. ST. MARTIN, certain real estate situate in the County of Weld, Colorado,
described as follows:

Lots Four (4), Five (5), and Six (6) of Block Thirty-four (34),
Town of Hudson, Colorado, according to the recorded may thereof, p°` i
recorded in the Weld County records.
Said deed was made subject to the following exceptions and reservations:
"and reserving therefrom, to grantor, all oil, gas and other
minerals therein or thereunder."
WHEREAS, the present owners of Lots Four (4), Five (5) and Six (6) in Block
Thirty-four (34), Town of Hudson, Colorado contemplates using or causing said lots to be used
for residential purposes and desire that the County relinquish its rights to enter upon the
surface of the above described property and to use the surface thereof pursuant to the rights
reserved under the aforesaid reservation. The County is willing to relinquish, its right of
entry upon the surface to the real estate above described, retaining and preserving, however,
the exclusive and perpetual right to explore for, remove and dispose of said oil, gas and other
minerals by any means or method suitable to the County, its successors, and assigns, in such
manner as not to damage the surface of said lands or to interfere with the use thereof by said
Grantee, his, her, their or its grantees, heirs, successors, or assigns, and without entering
upon or using the surface of the above described lands or removing support thereof.
NOW, THEREFORE, the said County, for and in consideration of the premises
and of One Dollar ($1.00) in hand paid, the receipt whereof is hereby acknowledged, does hereby
REMISE, RELEASE AND QUIT CLAIM unto the said Grantee and to his, her, their or its grantees,
heirs, successors and assigns, forever, with respect to the lands described in the Recitals
herein, the reservation contained in said deed dated October 2, 1945, recorded in Book 1162 at
page 268 of the Weld County records, of the right to enter upon the surface of the lands there-
by conveyed in connection with the exception and reservation in said deed of oil, gas and other
minerals and mineral rights, it being the intent hereof to release only the right to enter upon
the surface of said lands and to leave in full force and effect, all other rights reserved to
the County, in said deed, and to retain and preserve to the County the exclusive and perpetual
right toprospect for and to remove and to dispose of all oil, gas and other minerals reserved
to it by the said deed dated October 2, 1945, recorded in Book 1162 at page 268, of the Weld
County records, by any means or methods suitable to the County, its successors, and assigns,
in such manner as to not damage the surface of said lands or to interfere with the use thereof
by said Grantee, his, her, their or its grantees, heirs, successors or assigns, but without
entering upon or using the surface of the above described lands.
This release and quit claim is made subject to the specific understanding
that all of the terms, conditions, provisions, exceptions and reservations, contained in said
deed, dated October 2, 1945, shall continue in full force and effect with respect to all lands
conveyed thereby and not covered by this release and quit claim and it is further and specifi-
cally understood that all terms, conditions, provisions, exceptions and reservations contained
in said deed dated October 2, 1945, and not released hereunder shall continue in full force
and effect with respect to the lands hereinabove described.
IN WITNESS WHEREOF, The said WELD COUNTY, Colorado has caused this deed
to be signed by its commissioner to execute this deed and as County Treasurer of Weld County,
duly authorized so to do.

NOW, BE IT RESOLVED, by the Board of County Commissioners of Weld County, Colo-
rado, that the Weld County Treasurer be and he is hereby authorized to cancel Tax Sale
certificate Number 249 of the 1957 tax sale for Leasehold interest in the West Half (Si-) of
Section 11, Township 2 North, Range 63 West, account of erroneous assessment and therefore
erroneous tax sale.

Colorado, that consideration be given to the request that the Agreement regarding the Freeway
Project on U. S. Highway #85 (State Highway #3) include a public opening North of the Poudre
River, for the welfare of the County, its people and patrons.

CREATING PUBLIC NORKS FUND TO BE KNOWN AS HOSPITAL ADDITION FOR THE PURPOSE
.11 OF PROVIDING AND ACCUMULATING FUNDS FOR THE CONSTRUCTION AND EQUIPPING SAME:
WHEREAS, the Board of Trustees of the Weld County General Hospital
has requested the construction of an addition to the Weld County General
Hospital, a public building belonging to Weld County, Colorado, and has
demonstrated that such an addition is necessary in the public interest
of the inhabitants of said County to construct such addition.
NOW, THEREFORE, BE IT RESOLVED, that for the purpose of providing
and accumulating funds for the construction and equipping of such addition
to said hospital and to supplement anticipated funds which are expected
to be furnished from federal "Hill-Burton" Funds controlled by the State
Division of Hospital Facilities, a public works fund which shall be
known as the Public Works Fund-Hospital Addition is hereby created and
that a levy of 1* mills be made and levied on each dollar of real property
value in Weld County; that the building to be constructed shall he
located on the site of said Weld County General Hospital, owned by said
County and shall be a three floor, steel, glass and concrete structure
to accommodate eighty-five beds to be used with said hospital and as an
adjunct thereto estimated to cost $1,100,000.00 and requiring an annual r.:

tax levy of 1-- mills as hereinabove stated, which levy shall be made each
year for a period of three consecutive years;
Provided, however, that said levy shall not be effective until after
a public hearing on the said proposal for such proposed levy; that which
such hearing is hereby called and set for October 22, 1958, at the office
of the Board of County Commissioners in the Weld County Court House.

IDistrict, a tax for the maintanence and operation thereof and for the purpose of paying indebtedness,
interest and expenses, and of creating a sinking fund for payments of outstanding bonds, a tax for
the said purposes as certified to this Board by proper officers, as per Certification of Levies and
Revenues to the County Assessor and to the Colorado Tax Commission, which tabulated list and certi-
fication is hereto attached and made a part of this resolution.

WHEREAS, it has been certified to the Board of County Commissioners of Weld RESOLUTION RE: THE HENRYLY?
County, Colorado by the Directors of the THE HENRYLYN IRRIGATION District that the sum of IRRIGATION DISTRICT LEVY
$65,711.36 is required to meet the maintenance, operating and current expenses for the fiscal year FOR 1959:

WHEREAS, the return from the Assessor of Weld County shows the total asses-
silent and valuation for the purposes of said District of the real estate included in the District,
exclusive of improvements and assessable for the purposes of said District is the sum of $328,556.80,
which is at the rate of $10.00 per acre of land in said County subject to assessment for the purpose
of said District in 1959, to-wit 32,855.68 acres,
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Weld
County, Colorado that a levy of $2.00 per acre, which amount includes the 15% required by law for
delinquents, on the lands of the District payable in the year of 1959, will provide sufficient
funds for the operation of the District for the fiscal year of 1959.

A tax to be levied equal to one tenth of one percent upon the assessed
valuation of all producing and non-producing placer and mill sites, to-
gether with claims including lode claims, placer and mill sites, and all

Upon examination of your certification of levies recently forwarded by
you to this Commission, we do not see where you have included these

hereby suggest that a delegation from the area of Platteville, Colorado, meet with the Colorado
