In Paragraph 1 , you ask for the following; Buisness Hours : I live in Erie and have two lines available to customers, one a metro line and the other an Erie line so I am available at any reasonable hour and as a result I am able to respond to problems within 24 hours and to have any possible problems repaired within 48 hours . My responsibilities are to handle all service related problems . Billing and accounting is handled by my partner, Frank Starr. With currently 225 customers and an estimated 500 within 2 years I feel that the personal management that we as owners offer is far more personal than that of larger companies. In paragraph 3 you ask for clarification on ownership. Starr Communications is a Colorado Corporation with 50% of the shares being owned by myself and the remaining 50% owned by the Starr family. I am enclosing financial information from our CPA firm. In Paragraph 4 you ask if the system will be two way capable and ask about studio equipment. First the system is two way capable. As far as Studio equipment our proposal states that we have donated 2 Camcorders and one channel to the St. Vrain School district for use as they please and one channel to be used by the city of Erie or Weld County for public use. I am sure that the dollars spent on this equipment per customer is greater than that of larger systems . In paragraph 5 you ask for a statement addressing low income residents , I am enclosing the signed statement. I hope that this letter and enclosures gives you all the information you need. Box 330 Erie , CO 80516 RE: Application for Cable TV Franchise in Weld County, Colorado Dear Mr. Johnson: This letter is to inform you that we have reviewed your application for a cable TV franchise in Weld County, Colorado. The application appears to be substantially complete, with a few exceptions. I respectfully request that you provide Weld County with the following information: 1 . Paragraph A (2) on page 11 of Ordinance 94 requires the applicant to state the business hours , operational staff, maintenance procedures , and management and marketing staff, complement and procedures. 2. Paragraph A (4) on page 11 cf Ordinance 94 requires the applicant to provide "a statement explaining any assistance, in terms of personnel, equipment or capacity, to be designated for the programming or programming assistance for the public, educational and governmental access channels. " 3 . Paragraph A (9) on pages 12 and 13 of Ordinance 94 requires the applicant to provide audited financial statements for the applicant' s two latest fiscal years. In addition, the paragraph requires the submission of the "Federal Partnership Income Tax Return" for the applicant' s latest two fiscal years if the applicant is a partnership. Paragraph A(10) on page 13 of Ordinance 94 requires the applicant to inform Weld County whether the system will include two-way operational capability and the following information: "service to be provided and a description of the studio or studios, studio equipment, planned hours of operation and hours of availability, if any, that will be made available to governmental, public and/or educational institutions or agencies. " 5 . Paragraph A (16) of Ordinance 94-B requires the applicant to state to Weld County that "cable service will not be denied to any group of potential residential cable subscribers because of the income of the residents of the local area in which such group resides. " A hearing before the Board of County Commissioners on whether or not to grant the cable TV franchise to Starr Communications will take place on April 2 , 1990 , at 9 : 00 a.m. This hearing will occur during the Board' s regular meeting held in the first floor meeting room of the Centennial Center Complex, 915 Tenth Street, Greeley, Colorado. A notice for the hearing will be published in the New News on March 22, 1990 . In that notice, the area for which a cable TV franchise is proposed will be stated as follows : Within the area bounded by the following roads and highways: State Highway 52 to Interstate 25 , Interstate 25 to Weld County Road 7, Weld County Road 7 to Weld County Road 1 , and Weld County Road 1 to State Highway 52. Box 330 Erie, Colorado 80516 303-665-2231 Frank Starr Lynn Johnson Thursday, March 1, 1990 900349 Statement Starr Communications verifies that all information in this application is accurate, that the system proposed will meet or exceed all requirements of Weld County Ordinance #9-4 dated 12-14-81, and that no officer has ever been convicted of a felony. / L ohnson, President ,7Z-7-e., tarn Communications Date 900349 The System Starr Communications proposes to construct a state of the art cable television system to serve homes adjacent to Erie, Colorado (see map). The system will be fed from a head-end (satellite antennas and terrestrial receiver antennas and associated equipment), located 1/2 mile west of Erie. (Please see attached special use permit granted by the Boulder County Commissioners). The original channel offering shall be 30 channels for basic service and 5 optional premium channels (see channel summary). The system will be constructed of trunk and feeder cables making it capable of carrying 87 channels forward, 7 channels reverse and 50 channels FM. Construction The system shall be constructed with lines underground and overhead depending on availability of poles. Construction would begin no later than April 1, 1990 and be completed by April 1, 1991. The construction will conform to the following: 1. Weld County building and safety codes. 2. Occupational Safety and Health Act. 3. Society of Cable Television Engineers CATV Health and Safety Manual. 4. The National Electrical Safety Code - 1980 Edition, as prepared by the Institute and Electronic Engineers, as amended. 5. The National Electrical Code- 1980 Edition by the National Wire Protection Association, as amended. 6. Bell System Construction Practices and Trilateral License. 7. Federal Communications Commission Rules and Regulations, Parts 15, 72, 74, and 76. 8. Uniform Mechanical Code - International Conference of Building Officials - 1979 Edition, as amended, 9. Uniform Building Code- 1979 Edition. 10. Applicable Federal and State Codes. The system will be constructed to meet the technical description of distribution facilities attached hereto. 900349 System Security Individual customers will be fed from above ground pedestals. These pedestals shall be locked and each subscriber drop shall be numbered to facilitate system audits that shall be done a minimum of once per year. All pay channels shall be negative trapped, no addressable channels, allowing all customers to use their cable-ready television sets not requireing that the use of cable converters be supplied by the company. This requires more work on the part of the cable company but is very preferable on the part of the cable subscriber. Operation Cable television is a service business. A quality cable service consists of two factors. First, quality equipment installed professionally and second, a responsive office for service and billing problems. Starr Communications has an office located in Erie and a service technician that lives in Erie so he can monitor the system and respond to any problems promptly. School System Involvement Starr Communications believes that the cable system can be a valuable tool for the School System, and therefore Starr Communications will donate the following to the St. Vrain School District for use in the Erie School System: 1. 2 (two)portable VHS camera and recorder--Panasonic Model#AG160 2. 2 channels to be used at the discretion of the School District. Ownership Starr Communications, Inc, incorporated November, 1988 is owned 50% (25,000 shares) by Frank Starr and 50% (25,000 shares) by Lynn Johnson. Frank Starr has an extensive financial and business background and Lynn Johnson has an extensive technical and operational background in cable television. Together they possess the ability to operate a quality system. 900349 Legal Expenses Starr Communications is prepared to pay for legal expenses involved in granting the franchise and drafting the cable TV Ordinance. We are enclosing a check for$500 to pay for these expenses. The FM signal level on each channel shall be maintained within: a. 3 decibels of the FM signal level of any FM signal on an adjacent (200) KHz spacing channel, and b. 6 decibels of the FM signal level of any other FM signal carried on the system. 25 . A reserve of amplifier gain of at least 2 db shall be retained at each amplifier station and a reserve of at least 25 dbmV shall be retained at the end of each feeder line unloaded where pressure taps are used. 28. Every second amplifier in the trunk line shall be auto- matically controlled for gain as sensed by a constant level pilot carrier inserted at headend. Directional tapoff units and splitters used on the trunk and distribution system shall be of such con- struction to allow measuring of signal levels and line powering voltages with service interruption to a mini- mum number of subscribers. 30 . Trunk amplifiers shall be spaced at 22 db less a 2 db reserve nominally. 31. The number of taps per feeder shall be limited to that which does not degrade system performance beyond the specifications set forth above and/or beyond the FCC technical standards for CATV. 32 . The system shall be line powered from occasional power stations distributed throughout the system. All power- ing arrangements shall conform to City, State, and Na- tional electrical safety codes. b.
