"l i_,. 4 ,.. 7 ¢ . ., ., • . ,. ri 6 RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR AN AGRICULTURAL SERVICE ESTABLISHMENT (COMMERCIAL TRUCKING OPERATION) IN THE A (AGRICULTURAL) ZONE DISTRICT - MARLIN AND SHIRLEY NESS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 19th day of August, 1992, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Marlin and Shirley Ness, 19755 Weld County Road 66, Greeley, Colorado 80631, for a Site Specific Development Plan and Special Review Permit for an agricultural service establishment (commercial trucking operation) in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the SEe, Section 20, Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, Marlin Ness, applicant, was present, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24. 7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. This proposal is consistent with the Weld County Comprehensive Plan's Urban Growth Boundary Area Goals and Policies. These conditions are addressed in the Development Standards. b. The proposal is consistent with the intent of the A (Agricultural) Zone District and is provided for as a Use by Special Review. c. The uses which would be permitted will be compatible with the existing surrounding land uses which include farm production, oil and gas production, and rural residences. Conditions of Approval and Development Standards will ensure compatibility. No objections have been received from surrounding property owners. d. No overlay districts affect the site. e. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for an agricultural service establishment (commercial trucking operation) in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. We ster 920760 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS MARLIN AND SHIRLEY NESS USR-973 1. The Site Specific Development Plan and Special Review Permit is for an agricultural service establishment (commercial trucking operation) as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. The Special Review Permit shall not be transferable to any successor in interest to the described property and shall terminate automatically upon conveyance or lease of the property to others, except immediate family, for operation of the facility. 4. Tractors and trailers shall not be stored outside on site beyond seven days. 5. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 6. No permanent disposal of wastes shall be permitted at this site. 7. Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 8. Fugitive dust shall be controlled on this site. 9. The maximum permissible noise level shall not exceed the commercial limit of 60 dB(A) , as measured according to Section 25-12-102, Colorado Revised Statutes. 10. The property shall be maintained in compliance with S.A.R.A. , Title III. 11. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 12. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 920760 DEVELOPMENT STANDARDS - NESS PAGE 2 13. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 14. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 15. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 16. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Harbert, Pro-Tem Commissioner C. W. Kirby Commissioner Gordon E. Lacy Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Keith Schuett The following business was transacted: I hereby certify that pursuant to a notice dated August 3, 1992, and duly published August 6, 1992, in the Windsor Beacon, a public hearing was conducted to consider the request of Marlin and Shirley Ness for a Site Specific Development Plan and Special Review Permit for an agricultural service establishment (commercial trucking operation) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Keith Schuett, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record as written. Marlin Ness, applicant, was present and explained the operation is for maintenance and repair, which is done by Mr. Ness and his son. In response to a question from Commissioner Lacy, Mr. Ness said they do all their own repair work, and parking on site is limited to seven days. He also said they have well water, and they agree to all Conditions of Approval and Development Standards. Commissioner Lacy stated the development standard requiring a restroom facility was removed because this is a family operation. There was no public testimony offered concerning this matter. Chairman Kennedy questioned the issue regarding the transferring of the permit which was discussed during the Planning Commission hearing. Mr. Schuett read the language change in Development Standard #3 into the record. Commissioner Harbert moved to approve the request of Marlin and Shirley Ness for a Site Specific Development Plan and Special Review Permit for an agricultural service establishment (commercial trucking operation) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Webster, and it carried unanimously. This Certification was approved on the 24th day of August, 1992. LANDSCAPING: The proposed shop lies North of the residence and 200 ft. (more or less) from the road. The residence will provide some screening from the County road. The shop building will look no different from the many farm shops on the surrounding farms.
