RE: APPROVAL OF RECORDED EXEMPTION NO. 1576 - RICE
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held
in the Chambers of the Board, that a certain parcel of land, to be divided into
two parcels, as shown on the plat known as Recorded Exemption No. 1576, does not
come within the purview of the definition of the terms, "subdivision" and
"subdivided land", and
WHEREAS, the request for Recorded Exemption No. 1576 was submitted by Billy
Marian Rice, 9036 Weld County Road 26, Fort Lupton, Colorado 80621, for property
which is located in the Wi NWiNWe of Section 3, Township 2 North, Range 67 West
of the 6th P.M. , Weld County, Colorado, being more particularly described in the
plat which shall be provided by the applicant and known as Exhibit "A", said plat
to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to
be approximately 9.5 acres and 2.5 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby
is, exempt from the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption No. 1576 for
Billy Marlan Rice be, and hereby is, approved conditional upon the following:
1. A Weld County septic permit is required for the proposed home. It
shall be installed according to the Weld County Individual Sewage
Disposal System (ISDS) Regulations.
2. Any existing septic system(s) which is not currently permitted
through the Weld County Health Department shall require an ISDS
evaluation prior to the issuance of the required septic permit(s) .
3. The applicant shall submit a mylar plat to the Department of
Planning Services to be recorded in the office of the Weld County
Clerk and Recorder. The plat shall be prepared in accordance with
the requirements of Section 11. 7 of the Weld County Subdivision
Ordinance. The plat shall be submitted within sixty days from the
date of approval by the Board of County Commissioners. The
applicant shall be responsible for paying the recording fees.

4. Both Lot A and Lot B shall have access off of Weld County Road 26.
The owners of Lots A and B shall enter into an access easement
agreement providing for access from Weld County Road 26 to Lot A
across Lot B. Said access easement agreement shall be recorded
simultaneously with the recording of the plat.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 2nd day of February, A.D. , 1994.

THIS AGREEMENT, dated February %L-"' , A.D. 1994, by the

Subject: Recorded Exemption 1576.
Dear Commissioners:
This request for a recorded exemption is submitted by Billy Marlan Rice. The
parcel of land on which this proposal is being made is described as the W2 of the
NW4 NW4 of Section 3, T2N, R67W of the 6th P.M. , Weld County, Colorado. One
dwelling currently exists on the site. This site lies outside of an Urban Growth
Boundary.
The Department of Planning Services recommends denial of this request due to
incompatibility with the Comprehensive Plan - A (Agricultural) zone district
goals and policies and lack of efficient and orderly development.
The applicant is proposing to split this 12 acre parcel into two lots of 9.5
acres, more or less, and 2.5 acres, more or less. The applicant originally
purchased this 12 acre parcel in 1984. There are two accesses to the parcel one
provided from Weld County Road 19 and the other from Weld County Road 26.
Central Weld Water District currently provides water to the site and is able to
provide water to any additional lots. This property has five shares of Coal
Ridge Ditch; however the property does not appear to be farmed at this time.
Thisproperty is zoned Agricultural and conversion of agricultural land to
residential development is discouraged by the Comprehensive Plan when the parcel
lies outside of an Urban Growth Boundary area. Additionally, this property is
already 68 acres less than the minimum lot size in the A (Agricultural) zone
district. This property is recognized as a legal lot because it was created
prior to 1971 and is therefore not required to adhere to minimum lot sizes,
however, any additional lot created will not adhere to the minimum lot size
criteria either.

The Comprehensive Plan encourages property zoned Agricultural located outside of
Urban Growth Boundaries to remain predominantly agricultural. Approval of this
request does not encourage or enhance agricultural production, on the contrary
the addition of more people to this area will increase the demand for urban uses.
The surrounding properties range in size from one 3 acre parcel to 140 acre
farming operations. The general character of the area is agricultural in nature
and use. This request does not provide efficient and orderly development in
terms of use or location.
The Comprehensive Plan allows a lot in the A (Agricultural) zone district to be
divided into two separate parcels if the intent of the recorded exemption is met.
This applicant however, is not able to satisfy any of the three established
criterion. The Department of Planning Services' staff requests that the Board
of County Commissioners consider whether this proposal meets the criteria for
review as set forth in Section 11.5.1 through 11.5.6 of the Weld County
Subdivision Ordinance.

The proposed recorded exemption could allow construction of a
single family dwelling unit in the Northeasterly portion of
the Applicant ' s property on the proposed Lot A, containing

B , containing 9 . 55 Acres , would contain the existing garage
and dwelling structure and the remaining grassland pasture .

The subject property is located at the Southeast corner of the
intersection of Weld County Roads 19 and 26 , approximately
four miles Southwest of Platteville , Colorado ; the overall
property contains 12 . 05 acres and is presently grassland
pasture which is occasionally mowed , with one garage - dwelling
unit , presently occupied by the Applicant .
3 . Explain how the proposal is consistent with the Weld County Comprehensive
Plan and any adopted municipal plan , if applicable .
The site is within the Weld County Comprehensive Plan but is
not within a municipal district . The site is zoned
"Agricultural . " The proposed division into two lots ( 2 . 50
acres and 9 . 55 acres ) is consistent with the Weld County
Comprehensive Plan, the zoning district ( Lots of 1 acre
minimum) and the Recorded Exemption Procedural Guide .
4 . Explain how the uses permitted will be compatible with existing uses
surrounding the proposed recorded exemption .
The surrounding parcels are presently small , medium and large
farms and pasture lands . Most are developed with single family
dwelling structures and pertinent outbuildings . The proposed
use for the Applicant ' s two Lots is identical . Lot A is as yet
undeveloped while Lot B contains one dwelling unit with minor
outbuildings and a livestock pen .
5 . Explain how the proposal is consistent with the intent of the zoning
district it is located within .
The Applicant ' s site is within the Agricultural Zoning
District . The proposed uses of the two Lots include a single
family dwelling unit , farming , ranching , gardening , etc . , all
consistent with Section 31 . 2 , " Uses Allowed by Right in the A
District , " Weld County Zoning Ordinance dated July 6 , 1993 .
6 . Explain how the proposal is consistent with efficient and orderly

Applicant's proposal for the two Lots includes consideration
of access , both dwellings to be accessed from the gravel road
known as Weld County Road No . 26 . Applicant surmises this a
better access than from the high - traffic Weld County Road No .
19 . The proposed 2 . 5 acre undeveloped Lot A was chosen for its
practical size and prudent placement .
7 . Explain how adequate provision for the protection of the health , safety ,
and welfare of the inhabitants of the neighborhood and the County will be
accomplished . Fire Marshall , Glenn Miller , Platteville Fire
Protection District , comments " no problem" for protection of
the proposed Lots and hopes to add yet another hydrant nearby .

MONUMENT RECORD DATED JANUARY 31, 1973. THE ORIGINAL 1863 RECORD READS: "Drove charred stake
with post & mound for 1/4 Sec. Cor." NO EVIDENCE OF THE ORIGINAL MONUMENT WAS FOUND DURING THIS
SURVEY. NOTE: THE FOUND SQUARE ROD WAS 19 1/2 INCHES LONG.

"SURVEY". ONTO THE #6 REBAR I ATTACHED A 2 1/2 INCH ALUMINUM CAP, SET AT 6 INCHES BELOW THE
ASPHALT SURFACE, MARKED AS SHOWN IN #4 BELOW.

AT THE POINT FOR THIS NW-NW 1/64th CORNER, SECTION 3, I SET A 30 INCH STEEL PIPE, 2 3/8 INCHES
IN DIAMETER, WITH A 3 1/4 INCH DIAMETER CAP MARKED AS SHOWN IN #4 BELOW. THIS CORNER FALLS IN
A SMALL DIRT ROADWAY; HENCE, I SET THE TOP OF THE CAP 6 INCHES BELOW THE ROAD SURFACE. I ADDED
CONCRETE AT THE BASE OF THIS MONUMENT AROUND ITS FLANGE, AND FILLED THE REMAINING HOLE WITH
THE EXCAVATED MATERIAL UP TO ROAD LEVEL.
