HomeMy WebLinkAbout900922.tiff RESOLUTION RE: APPROVE MUTUAL AID AGREEMENT WITH EMERGICARE, INC. , AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Mutual Aid Agreement between the Weld County Ambulance Service and EmergiCare, Inc. , and WHEREAS, the terms and conditions are as stated in the Agreement, a copy of which is attached hereto and incorporated herein by reference, and WHEREAS, after study and review, the Board deems it advisable to approve said Agreement. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Mutual Aid Agreement between the Weld County Ambulance Service and EmergiCare , Inc. , be, and hereby is , approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is , authorized to sign said Agreement. Harbert C 'SaC:=> C.W. 1 y County Attorney Go 900922 MUTUAL AID AGREEMENT Date of this Agreement: - tg , 19 go Agencies to this Agreement: WELD COUNTY AMBULANCE SERVICE by and through the Board of County Commissioners of Weld County, Colorado, and EmI RLt CARS These agencies maintain paid and/or volunteer emergency service personnel and equipment. It is to the mutual benefit of each agency to assist the other. As a result, both agencies agree as follows: 1. To respond to requests for assistance from the other agency whenever possible. However, it shall be entirely within the discretion of the management of the requested agency as to whether and/or what personnel and equipment will respond to the request. 2. This Agreement does not create an employment relationship between the agencies. Each agency agrees that its personnel do not become employees of the other agency as a result of this agreement. Each agency' s equipment and personnel shall remain the responsibility of that agency even when responding to a request under this Agreement. Each agency' s personnel do not become entitled to any employees ' benefits provided by the other agency as a result of this Agreement. Each agency shall provide necessary Worker' s Compensation Insurance for its own personnel at its own cost and expense. 3 . Each agency waives all claims against the other agency for compensation for any loss of or damage to equipment and for any loss, damage, personal injury or death sustained by its personnel, which occurs as a result of the performance of this Agreement. - Y�"Y VL [I--lllJ L11C applieable requirements of Colorado law "j and to acceptable methods and practices of emergency response services . 5. This Agreement may be supplemented with various exhibits setting forth specific areas of response, protocol, communications, and other procedural matters. These .9C0923 supplements must be adapted, signed, and dated by both agencies. 6 . This Agreement shall supersede and replace any and all agreements, contracts, and written and/or oral understandings in existence prior to the execution of this Agreement. 7. No alteration of the terms of this Agreement shall be valid unless made in writing and signed by the authorized representatives of the parties to this Agreement. S . Nothing in this Agreement shall be construed to create a cause of action and/or civil liability remedy in any person not a party to this Agreement. This Agreement exists for the sole benefit of the parties to the Agreement. The Agreement shall not be construed to create a duty by either party to any third party where no such duty otherwise existed. 9. This Agreement shall take effect upon execution by authorized representatives to each party. This Agreement shall remain in effect until such time as either agency gives sixty (60) days advanced written notice to the other agency of its intention to terminate or amend. McCabe; Please find enclosed the Mutual Aid Agreement for our agencies. I have crossed out and initialled #4. We do not maintain Colorado certified people, but respond into Colorado occasionally through the permission of the respective EMS Offices approval . It is my understanding that these agreements were obtained many years prior to our beginning operations in the Cheyenne area. We do exceed all State requirements and federal requirements for equipment and vehicles. I have also attached a sheet for emergency contact numbers in case dispatch is needed , or questions answered . I am formally requesting the same from your agency. Should you have further questions, please do not hesitate to contact me. A second mailing was done in July . We have enclosed those who have responded . They should be signed off by the chairman of the Board of County Commissioners and copies returned to the fire departments/ambulance services and to this office .
