APPROVED WITH CONDITIONS
The Department of Planning Services has determined through the review that
the standards of Section 9-2 E. (1) (a) through (m) of the Weld County
Subdivision Regulations have been met. This Recorded Exemption is approved
with the following conditions in accordance with information submitted in
the application and the policies of the County.
An ISDS evaluation by the Weld County Health Department on all existing
septic systems will be necessary prior to issuing the required septic
permits on the existing systems. The applicant shall obtain a repair
permit and make the necessary repairs to the system on Lot A.
The Recorded Exemption plat shall show a 75 foot right-of-way reservation
south from the centerline of Highway 52.
The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be prepared in accordance with the requirements
of Section 9-2 C. (4) of the Weld County Subdivision Regulations. The plat
shall be .submitted within sixty (60) days from the date of approval by the
Department of Planning Services. The applicant shall be responsible for

Dear Lanell :
The City of Fort Lupton Planning and Zoning Commission met
on April 14, 1992 and made the following recommendations
regarding three ( 3) Weld County Referrals :
1 . Recorded Exemption for Joseph J. and Dolores R. Sack:
Case # RE 1411 .
Recommend approval of the request contingent upon the
applicants meeting the requirements of the Weld County and
State Health Departments . Furthermore, this application is
approved based upon the following findings of fact:
a. Property has never been exempted from subdivision
regulations in the past.
b. Both properties currently have an existing dwelling
unit.
2 . Recorded Exemption for Richard Lee Hein Case # RE 1409
Recommend Denial of the request based upon the following
findings of fact :
a. Property has an Recorded Exemption dated 1985 for an
adjacent piece of property.
b. Soils suitability maps place this property in a
potential unsuitable septic tank and leach field
situation.
c . The property owner could have an appearance of
circumventing the intent of the Subdivision
Regulations .
d. This petition would not meet or be consistent with

the policies and goals of the Fort Lupton Landuse
plan for lot size.
3 . Recorded Exemption for Harry Howard Ewing Case # RE 1406
Recommend approval of this recorded exemption contingent
upon the applicants providing adequate access to both lots A
and B. Furthermore, this action is based upon the following
findings of fact:
a. Applicant meets the policies and intent of the Fort
Lupton Land use plan.
b. The property has never been exempted from the intent
and purposes of the Subdivision Regulations .
Also, the Planning and Zoning Commission has requested a
workshop with you and your Planning Commission sometime in
the near future to discuss policies and goals for the City
as well as Weld County. Please let me know if you and your
commissi are receptive to this idea.

Dear Ms. Swanson:
We have reviewed the application from Sack' s for a Recorded Exemption,
and we have the following comments:
Projected traffic on S.H. 52 indicates the need for a 150 foot total right
of way, 75 feet each side of the highway centerline. Since the existing
width along this property is apparently less than 75 feet south of the
centerline, additional width to meet the projected need should be protected
by reservation or, preferably, dedication, as permitted by County regulations.
Since there will apparently be no change of use of the property, the existing
accesses will be allowed to remain. At such time that there is a change
of use of the property, access permits may be required.

Dear Ms. Swanson:
We have reviewed the above referenced proposal to split off an 11.48 acre parcel from an
80 acre parcel. The proposed Lot A would be 11.48 acres and Lot B, 68.52 acres. The water supply
is to be from two existing permitted wells. Permit No. 88814 would serve Lot A and Permit No.
55090, Lot B. The permits allow for inhouse use, the watering of domestic animals and livestock,
and the irrigation of not over one acre of home gardens and lawns, from each well.
Since a water supply is available to serve the two proposed lots,we recommended approval
of this exemption proposal, provided the use of these wells does not exceed their permitted uses.

PROPOSED RECORDED EXEMPTION
March 24, 1992
The reason for asking to divide this parcel into two parcels is that we are living in
a home adjacent to the parcel we want to split off and have been renting the house
and some ground. Joe is retiring in the near future from the U.S. Postal Service and
no longer wants the headaches of a rental. We would like to spend the rest of our
lives doing other things and enjoy the rest of our living time. We feel this small
parcel would make a good home for someone and give them a place of their own to take
care of and grow with their family.
There are few small parcels close to us, however we feel splitting this small parcel
off would not be inconsistant with the Weld County Comprehensive Plan. Growth of
Fort Lupton should be to the East of town, but as to time of growth, no one can say
for sure.
The property is zoned agriculture and all the ground lying East of Highway 52 is
zoned agriculture. Aims Community College is across the highway and not agriculture.
However, we feel that this parcel will not change anything on the east side of Hwy 52.
The property to be split off vil] be used as it is now for a residence and some
animals. Nothing will really change from the way it is now.
We can not see that this parcel will be incompatible with future development on this
side of the Highway and should not affect any master plans with any municipalities.
Development in this area could be small acreages and should not hinder orderly
development.
The home has a deep well of it own and septic tank and leach field which have been in
existance since the home was built. Weld County has checked the well water and septic
and the results are in this packet.
This property is not in a flood plan nor airport overlay district. There are no
geologic hazards and complies with Section (50) overlay district regulations as
outlined in the Weld County zoning ordinance.
This property does have the Fulton Irrigation Ditch running through it and does
subirrigate some pasture below the ditch. The home is located above the ditch and
therefor does not have soils problems or major water problems.
