RE: APPROVE ROAD MAINTENANCE AND IMPROVEMENTS AGREEMENT WITH
SIEGRIST CONSTRUCTION COMPANY AND AUTHORIZE CHAIRMAN TO SIGN

WHEREAS , the Board of County Commissioners of Weld County,
O Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
A affairs of Weld County, Colorado, and

0 3• WHEREAS, the Board has been presented with a Road Maintenance
Z
'Le and Improvements Agreement with Siegrist Construction Company, and
p WHEREAS, said Agreement concerns improvements to a certain
W portion of Weld County Road 26 , with the terms and conditions
orx being as stated in the Agreement, and

x WHEREAS, after review, the Board deems it advisable to
rx approve said Agreement, a copy of which is attached hereto and
(N wa incorporated herein by reference.

Lr) NOW, THEREFORE, BE IT RESOLVED by the Board of County
0rj Commissioners of Weld County, Colorado, that the Road Maintenance
and Improvements Agreement with Siegrist Construction Company be,
wa' and hereby is , approved.
o w BE IT FURTHER RESOLVED by the Board that the Chairman be, and
cz hereby is, authorized to sign said Agreement.

ROAD MAINTENANCE AND IMPROVEMENTS AGREEMENT

o U THIS AGREEMENT, made and entered into this 16th day of April,
N o , 1990, by between the COUNTY OF WELD, STATE OF COLORADO,
U hereinafter called "County" , and SIEGRIST CONSTRUCTION COMPANY,
q hereinafter called "Owner" , and

0 3 WHEREAS, the Owner has applied to the county for a Use By
ov�w Special Review Permit, Case No. U.S.R. 907, for an opencut
0 gravel mine located in Section 31, Township 3 North, Range 67
x West of the 6th Principal Meridian, and

a WHEREAS, the gravel mine will generate an increase in heavy
w
truck traffic, and
a WHEREAS, the County and the Owner have reviewed the proposed
Na maintenance and improvements conditions and acknowledge they will
rn U enhance the accessibility and safety of the roads that serve the
gravel mine.

F NOW, THEREFORE, in consideration of the mutual covenants and
a conditions hereinafter set forth, the County and Owner mutually
agree as follows :

CO w 1. The designated haul route that services the gravel mine
o z is Weld County Road 26 from the gravel mine ingress/egress
en cv point west to Weld County Road 13 (herein after called
"the road" ) , south to Weld County Road 24 , and west to
W Interstate 25.
0 2. No truck traffic generated from the gravel mine will be
M permitted east on Weld County Road 26, except for
occasional loads necessitated by physical restrictions.

3. The Owner agrees to maintain that portion of Weld County
Road 26 from the gravel mine ingress/egress point west
to Weld County Road 13 in its present condition or
better at all times, during periods of mining operation.
4 . The Owner will furnish the necessary base material,
equipment, and labor to repair and maintain "the road" .
Dust palliative will be added when necessary during
mining operations.
5. The County will inspect and replace any culverts that
are in a deteriorated condition or require extensions
prior to any repair work by the Owner.

6 . At anytime in the future during the course of the permit
when road damage along "the road" has increased beyond
the point that repair can reasonably restore the road,
the Owner will cooperate with the County in the recon-
struction of those parts of "the road" deemed necessary.
om U The details of construction will be determined by
o sampling and testing of existing road by the Weld County
M O- Engineering Department.

7. All reconstruction materials and methods will be in accor-
d w dance with the State Department of Highways, Division of
0 3 Highways, State of Colorado, Standard Specifications for
o a Road and Bridge Construction, 1981 ;

O8 . The County will supply testing and inspection for the
U construction if deemed necessary;

ro x 9. Access from Weld County Road 26 to the site will be
" 'a limited to one location for ingress and egress and

H x having adequate sight distance in all directions. The
w Owner will install and maintain stop signs at all exit

o H IN WITNESS WHEREOF, the parties hereto have duly executed the
