RESOLUTION RE: APPROVE GRANTING EXTENSION OF TIME TO COMPLY WITH USE BY SPECIAL REVIEW CONDITIONS - JUDY OAKLEY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on May 18, 1988, the Board approved a Use by Special Review Permit for a dog kennel to be operated by Judy Oakley, and WHEREAS, Condition of Approval #6 states that the kennel shall be completed by December 1, 1988, and WHEREAS, the Department of Planning Services has initiated ZCH-70 to compel compliance of the Use by Special Review, and WHEREAS, on February 27, 1991, Judy Oakley appeared before the Board requesting an extension of time to complete said kennels. WHEREAS, after review, the Board deems it advisable to approve said request for a six month extension of time. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that an extension of six months is hereby granted to Judy Oakley in which to comply with Codition #6 of said Use by Special Review. BE IT FURTHER RESOLVED by the Board that a Probable Cause hearing be, and hereby is, scheduled for September 9, 1991 to determine whether Condition #6 of said Use by Special Review has been met. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 27th day of February, A.D. , 1991. Oakley: An on-site inspection of your property was conducted on February 5 , 1991, to determine if the Conditions of Approval and the Development Standards placed on your property at the time USR-828 was approved by the Board of County Commissioners are in compliance. The inspection revealed violations of Conditions of Approval #6 , 7 and Development Standards #4, 9 , 10, 11, 13, 18 , and 19 . A copy of these items from the approved resolution are enclosed. The Use by Special Review area must be brought into compliance with the Conditions of Approval and the Development Standards within 30 days from the date of this letter. Noncompliance will result in our office scheduling a Probable Cause Hearing before the Board of County Commissioners . If the Board determines there is sufficient probable cause to warrant further action, a Show Cause Hearing will be scheduled to consider revocation of the Use by Special Review permit. OAKLEY LEGAL DESCRIPTION: PART OF THE NW4 OF SECTION 30, T2N, R66W OF THE 6TH P.M. , WELD COUNTY, COLORADO DATE: FEBRUARY S , 1991 CASE NUMBER: ZCH-70 INSPECTION OF THE PROPERTY SHOWED THE FOLLOWING ITEMS IN VIOLATION OF USA-828 AS APPROVED: THE KENNEL STRUCTURES HAVE NOT BEEN BUILT. THEY WERE REQUIRED TO BE BUILT BY DECEMBER 1, 1988 AND WERE REQUIRED TO BE FRAME CONSTRUCTION AND INSULATED TO LESSEN AUDIO IMPACTS. THE DOGS ARE IN CHAIN LINK ENCLOSURES ON THE BACK OF THE LOT WHERE THE KENNEL WAS APPROVED. ADDITIONAL KENNEL AREAS HAVE BEEN CONSTRUCTED DIRECTLY BEHIND THE HOUSE. THE WATER SOURCE FOR THE KENNEL WAS TO BE A CISTERN FILLED WITH A LEGAL, COMMERCIAL SOURCE OF WATER OR A PERMITTED WELL. THE CISTERN HAS NOT BEEN CONSTRUCTED AND NO EVIDENCE HAS BEEN PRESENTED THAT THE WELL CAN BE USED FOR THIS COMMERCIAL USE. QUARTERLY SAMPLES OF THE CISTERN WERE REQUIRED TO BE SUBMITTED TO THE WELD COUNTY HEALTH DEPARTMENT. EXERCISE AREAS ARE NOT OF SUFFICIENT SIZE TO ALLOW ANY DOG TO BREAK INTO A RUN. THE PORTION OF THE SITE WHICH IS NOT USED FOR THE KENNEL OPERATION OR THE RESIDENCE WAS REQUIRED TO BE COVERED WITH GRASS AND SHRUBS. THIS HAS NOT BEEN DONE. HOWEVER, THERE IS QUITE A BIT OF TRASH ON THE SITE. IT APPEARS SOMEONE IS LIVING IN A RECREATIONAL VEHICLE ON THE SITE. THE WELD COUNTY HEALTH DEPARTMENT REPORTS THERE IS NO SEPARATE HOT AND COLD RUNNING WATER AND NO 2-COMPARTMENT SINK FOR SANITIZING. THESE ITEMS ARE REQUIRED.
