Weld County Road 18, East of WCR 1 On February 20, 1992, Tom David asked me to investigate the road right-of-way held by Weld County for Weld County Road 18, east of WCR 1 . It is my understanding that this Weld County road is being considered as access to the proposed RE-1393 . The roadway is currently approximately 20 to 25 feet in width. It is maintained by Weld County once per month. m In order to determine if the right-of-way for Weld County Road 18 is wider than the 20 to 25 feet in existence at the present time, n we need to determine if one of the following exists : o 'y N zw A. Was the ground 30 feet on either side of the section line z o within the public domain prior to October of 1889 (the tt infamous "Resolution of 1889" ) ? m• o to B. Was the ground 30 feet on either side of the section line m• o was dedicated to Weld County by the adjacent landowners and was said right-of-way accepted by the County? H r My review of the tract index at Transamerica Title Insurance r N Company reveals the patents for the SW4 of Section 19 , and the NE4 and NW4 of Section 30 relate back to entries onto the properties which occurred prior to October, 1889 . Arguably, the patent for 0 °1 the SE4 of Section 19 relates back to an entry after October, 1889 . Therefore, Weld County does not own a 60 foot right-of-way as per the Resolution of 1889 . A 30 foot right-of-way may exist by virtue o of the Resolution in the SE4 of Section 19 . My review of the tract e index also does not reveal any grants of rights-of-way by tritn surrounding landowners . z � o Attached are various letters which Weld County has written to the d landowners in the area about the ownership and maintenance of WCR 18 . Please note that my December, 1984, letter states that no o N right-of-way exists along WCR 18 . I based that statement upon the fact that there was no indication of an 1889 Resolution right-of- n way to the mid-section line and the fact that no "adjudication" for O ° the roadway had taken place to establish it by the "20-year" statute. That letter was essentially designed to confirm the statements made in the two letters from Dave Becker in October and November, 1984 . I believe that we can safely say that there is a public roadway along WCR 18 which has been created by use as per Section 43-2- 201 ( 1 ) , C.R. S . Specifically, the roadway appears to have been in 4920223 Memo: BOCC RE: WCR 18 Page 2 March 10, 1992 P m r r existence for more than 20 years at its current width of 20 to 25 feet. I believe that the public has used the right-of-way for that • -4 period of time, even though it has primarily been used for access to certain homes which are located in the Southeast Quarter of w Section 19-2-68 . We probably don't need an "adjudication" by a �c o court to assert this right-of-way on behalf of the public . y N zw zo CONCLUSION: At best, WCR 18, running east from WCR 1, is a public o roadway which is 20 to 25 feet in width. In your letter you indicated that this is a private py road, yet I am confused why the road is labeled Weld County Road 18. M o If it is a private road, why is it labeled with a county name? There is a cemetery M on the north side of the road and telephone poles on the south side NH and these would have to be moved to accomodate the 60 ft. requirement. m This road has been maintained for 16 -18 years that I know of and the equipment has never had difficulty doing so. M n O My real concern, though, is our children. Three of the families xy who live along this section of Road 18 have small children. The Mtn elementary school bus travels down the road to pick up the children. o If this were not so our children would have to walk from 5/8 of a Z o mile to over a mile to catch the bus in all kinds of weather at the M intersection of WCR 18 and County Line Road. Cars travel in excess n of 60 mph. along this road and because of possible kidnapping and O injury, I am very concerned and fearful if they should be made to 0 m walk this distance. I believe 5 and 6 year old children are not n 0 able to handle this responsibility. If the road is not maintained the bus will not continue to travel down it to pick the children up. We are only asking for grading; we will handle the snow removal our- selves as we have done for the past 10 years. Couldn't grading be dontevery month? 6 weeks? or 8 weeks? Hankins , Route 2, Box 325 Longmont, Colorado 80501 Dear Mrs. Hankins: The Board of Weld County Commissioners reviewed your letter of November 23, 1979 about the maintenance of Weld County Road 18. Although this road has never been formally accepted by Weld County for maintenance, it was their concensus that there should be sore relief for the families served by the road. Accordingly the Board has directed me to provide minimal maintenance on this section of road to keep it passable year round, to include ocra=ional grading and essential snow removal. You are advised, however, that due to both the ownership status and the narrow- ness of this road, it cannot be maintained as an ordinary Weld County road. To make it a standard road would require acquisition of right-of-way to widen it to a safe width, provision of proper grade, shoulders and barrow pits, all of which would be prohibitively expensive.
