RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR OIL AND GAS PRODUCTION FACILITIES (FOUR OIL AND GAS WELLS AND ASSOCIATED EQUIPMENT) IN THE R-1 (LOW DENSITY RESIDENTIAL) ZONE DISTRICT - CACHE EXPLORATION, INC. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 16th day of December, 1992, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Cache Exploration, Inc. , 1221 28th Avenue, Suite 1, Greeley, Colorado 80631, for a Site Specific Development Plan and Special Review Permit for oil and gas production facilities (four oil and gas wells and associated equipment) in the R-1 (Low Density Residential) Zone District on the following described real estate, to-wit: Part of the SW*, Section 24, Township 6 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by William Crews, Attorney/Landman, and Ed Holloway, Cache representative, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive Plan Urban Growth Boundary Area Goals and Policies. The City of Greeley has reviewed this proposal and has recommended approval of this request. b. The proposal is consistent with the R-1 (Low Density Residential) Zone District and is provided for as a Use by Special Review. The uses which would be permitted can be compatible with the existing surrounding land uses which include residential, irrigated farm production, and pasture land. The uses which would be permitted can be compatible with the future development of the surrounding area as permitted by the existing zoning. d. The property is located in the Airport Overlay District. The Development Standards address this concern. No other overlay districts affect this site. e. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County to the greatest extent possible. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for oil and gas production facilities (four oil and gas wells and associated equipment) in the R-1 (Low Density Residential) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. The applicant shall agree, in writing, to develop the Use by Special Review as a high-density area as defined by Section 127 of the Colorado Code of Regulations, Rules and Regulations of the Colorado Oil and Gas Conservation Commission. 4. Road damage caused by drilling or support equipment shall be repaired within 30 days of completion of the four wells. 5. USR #995 1. The Site Specific Development Plan and Special Review Permit is for oil and gas production facilities (four oil and gas wells and associated equipment) in the R-1 (Low Density Residential) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. The property shall be maintained in compliance with the Colorado Code of Regulations, Rules and Regulations of the Colorado Oil and Gas Conservation Commission, including rules that pertain to oil and gas production in a high density residential areas. 4. The property shall be maintained in compliance with the Weld County Airport Overlay District requirements. 5. All traffic during the drilling operation shall use Weld County Road 66 and enter and exit the property to or from the east on Weld County Road 66. 6. Wellheads shall be located at least 250 feet from the nearest property line in Sonny View Estates and no less than 350 feet from the nearest dwelling. 7. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. Exploration and production waste shall be disposed of at an approved facility. 8. No permanent disposal of wastes shall be permitted at this site. 9. Fugitive dust shall be controlled on this site. 10. The maximum permissible noise level shall not exceed the residential limit of 55 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes, except during any operation involving the use of a drilling rig, workover rig, or fracing, as established according to Rule 803.a, State of Colorado Rules and Regulations, Rules of Practice and Procedure and Oil and Gas Conservation Act, as amended. 11. A spillage retention berm shall be installed and maintained around the tank battery. The volume retained by the spillage berm should be greater than the volume of the largest tank located inside the berm. 12. A stormwater discharge permit from the Colorado Department of Health, Water Quality Control Division, shall be obtained for all construction activities that disturb more than five (5) acres. 921175 DEVELOPMENT STANDARDS - CACHE EXPLORATION, INC. PAGE 2 13. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 14. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 15. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 16. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 17. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 18. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 921175 HEARING CERTIFICATION DOCKET NO. 92-84 RE: SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR OIL AND GAS PRODUCTION FACILITIES (FOUR OIL AND GAS WELLS AND ASSOCIATED EQUIPMENT) IN THE R-1 (LOW DENSITY RESIDENTIAL) ZONE DISTRICT - CACHE EXPLORATION, INC. A public hearing was conducted on December 16, 1992, at 10:00 A.M. , with the following present: Commissioner George Kennedy, Chairman Commissioner Constance L. Harbert, Pro-Tem Commissioner C. W. Kirby Commissioner Gordon E. Lacy Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Lanell Swanson The following business was transacted: I hereby certify that pursuant to a notice dated November 25, 1992, and duly published December 3, 1992, in the Windsor Beacon, a public hearing was conducted to consider the request of Cache Exploration, Inc. , for a Site Specific Development Plan and Special Review Permit for oil and gas production facilities (four oil and gas wells and associated equipment) in the R-1 (low density residential) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Lanell Swanson, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record as written. William Crews, Attorney/Landman, represented the applicant and noted the changes on the plat map, which is to be resubmitted. Mr. Crews explained that the surface location of the Seeley 111 well has been moved. In response to a question from Ms. Swanson, Mr. Crews said Seeley #1 was moved 840 feet east of the original location. Ms. Swanson noted that staff and the Planning Commission were under the impression that the actual distance was to be 1000 feet rather than 840 feet. Mr. Crews and Ms. Swanson agreed that the plat shall be amended to show the new location of Seeley #1 approximately 30 feet north of Seely #4. Ms. Swanson clarified this will be the amended Condition of Approval #5. Ed Holloway, Cache representative, clarified that said well was moved 840 feet to the east from Weld County Road 35, and it is 900 feet from the property lines. (Changed to Tape #92-43. ) He noted that is the furthest to the east they can legally move the well by State regulations. Mr. Holloway explained that Seeley #2 has been moved 200 feet from Road 35, 250 feet from the property lines, and over 300 feet from dwellings. In response to a question from Commissioner Harbert, Mr. Holloway said they could move it further east, but the landowner wanted the well positioned there. Mr. Crews explained that to move the well any further north, they would have to have the consent of all the royalty owners. He answered further questions concerning the State Oil and Gas Commission's requirements for drainage, 200-foot radius, and directional drilling. There was no public testimony offered concerning this matter. Dale Majors, surrounding property owner, stated concerns with wells being drilled on residential zoned land, and he requested the wells be moved further east. Mr. Morrison explained the problem with respect to the County's role, because State rules prevail. There was further discussion between Mr. Majors and the Board, with the Board explaining that the wells have already been moved as far as possible, and that the State has mitigated many problems and increased protection substantially. Ms. Swanson noted that the well depth would be approximately 7,300 feet. Mr. Morrison noted that the area has not been formally designated as high density, but the applicant has agreed to treat it as such. Sheila Baessler, surrounding property owner, questioned where the angle drilling would be coming across. She noted that the soils are unstable and requested the angle drilling not be allowed to come under the housing. Mr. Morrison confirmed that the 921175 RE: HEARING CERTIFICATION - CACHE EXPLORATION, INC. PAGE 2 enforcement of the Permit would be done by Weld County. Ms. Baessler said that at the Planning Commission on December 15, 1992, they requested a geologist be present at today's hearing to ensure soil conditions are not a problem. After further discussion between Ms. Baessler and Mr. Morrison, Ted Baessler, surrounding property owner, stated he would also like to hear a geologist say it is a safe operation. There was further discussion concerning the incident of the Weld County Lumber explosion in LaSalle, which was due to an old water well and gas leaks. Blaine Johnson said his family has owned mineral rights in the area since 1905, and he recommends drilling be permitted according to the Oil and Gas Commission guidelines. Mr. Holloway said in reference to the slant drilling, the well will be located 860 feet from the west line and 530 feet from the south line of Grand View Drive culdesac. The minimum depth, before the drilling enters the subdivision, will be 7, 000 to 7,300 feet. Mr. Holloway said there are unstable soils at the surface; however, the casing required by state is to be at 380 to 400 foot, and the unstable soils are only 60 to 70 feet deep. He reiterated that the wells are as far east as the State allows, and there is an independent geologist present. Mr. Crews said the explosion in LaSalle was an old water well which was not plugged. He noted there are thousands of oil and gas wells in Weld County, of which there have been no incidences of public injury. Dean Cummins, Certified Petroleum Geologist, said the soil profile is thin, consisting of 30 to 50 feet of gravel under the subsoils. He stressed the safety of the deviation technique and noted migration through the cement zones is extremely unlikely. Mr. Cummins said the law requires that minerals be removed. In response to a question from Commissioner Harbert, Mr. Cummins stated there is no risk at all of houses being under structural danger. Mr. Cummins responded to a question from Mr. Morrison concerning the Codell and Niobrara formations. In response to a question from Commissioner Webster, Mr. Morrison said there is nothing in the State regulations which require oil and gas wells to be a specific distance from water wells; however, there are special protections. Mr. Crews explained that uses are limited within a 200-foot radius of oil and gas wells. Mr. Cummins said there are 300-foot water wells in the Fox Hills; but, the State feels 400 feet of surface casing is adequate protection. In response to a question from Commissioner Harbert, Mr. Crews said Seeley #2 will be a straight-down hole. Commissioner Harbert questioned whether they could move the well and angle drill. Mr. Holloway said at the Planning Commission meeting they gave the 100 residents the option to defray the $33,000 cost to deviate the hole, which would also create other problems for Cache. In response to a question from Commissioner Webster, Mr. Holloway said the life expectancy for most wells is nine to fifteen years. Mr. Holloway responded to a question from Commissioner Lacy by stating Cache proposed restricting access to Weld County Road 66 for all heavy-duty equipment. He also noted there are no water wells in Section 24. Commissioner Kirby stated that since the LaSalle incident, there have been more stringent cement requirements enforced. Mr. Holloway reiterated that many regulation changes have been made since that time, and that the explosion was a water well, which are not regulated like oil and gas wells. He said the incident was in the early 1980's, and there are still no final conclusions. In response to a question from Commissioner Lacy, Mr. Holloway said they are installing three mufflers on the pumps and engine, which comply to State Oil and Gas standards. Commissioner Kirby moved to approve the request of Cache Exploration, Inc. , for a Site Specific Development Plan and Special Review Permit for oil and gas production facilities (four oil and gas wells and associated equipment) in the R-1 (low density residential) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Lacy, and on a roll-call vote, it carried unanimously. Commissioner Harbert stated she is voting yes only because she feels her hands are tied, and she would feel better if Seeley #2 was moved. Crews, Attorney, representative, Cache Exploration, Inc. , gave a detailed technical overview of the application (20 minutes) . With the aid of exhibits and visual graphs he showed the proposed location of the four wells around Seeley Lake. He also went into a detailed explanation regarding diversion drilling to a depth of 7,300 feet below the Sunnyview Estates Subdivision. He explained there would be one common tank battery site shielded behind a tree out of view of the Sunnyview Estates Subdivision. Cache Exploration would install an additional muffler on the rig itself. When drilling is complete all that will remain will be the casing, tubing head, and a valve. Bill O'Hare was concerned about traffic and children having access into this area. Ed Holloway, representative, Cache Exploration, Inc. , showed the property line that is partially fenced and explained this proposal will be in the middle of a corn field. Shirley Camenisch asked about a security fence. Ed Holloway said this was not planned for but if necessary Cache Exploration would comply. The Chairperson asked if there was anyone in the audience who wished to speak for or against this application. Jim Kepler, surrounding property owner, had objections to the noise, access onto the site, proximity to a residential area, and safety concerns. Dave Fagerburg, surrounding property owner, said he had started this subdivision and realizes progress can't be stopped. He wants to see Cache Exploration, Inc. , take responsibility for any incidents in this area due to their progress on these wells. Lee Morrison explained Cache Exploration is legally responsible anyway. Insurance coverage for this company was discussed and it was determined Cache Exploration's insurance policy could be circulated to the homeowners. Shirley Camenisch asked who signed the original mineral lease. William Crews said there were a number of lessees, a previous owner sold the land but held on to the mineral rights. This parcel of land was purchased by the new owner, who developed Sunnyview Estates, without the mineral rights. Gwen Jenks, surrounding property owner, compared the explosion of the tank in Lafayette, to what could happen in this area where the ground is already unstable. .275 5 SUMMARY OF THE WELD COUNTY PLANNING COMMISSION MEETING December 15, 1992 Page 4 Ted Baessler, surrounding property owner, said he is a local contractor and is worried about cracks in the foundation of his house due to underground drilling causing vibrations. He said the foundations on the homes in this area have to be engineer designed. He is also concerned about gases rising up through the ground when fracing occurs. Extension discussion followed (90 minutes) covering all areas of concern. Blaine Johnson, Attorney, representative, mineral rights owners, explained angle drilling is not a new process. He would like to see the Planning Commission follow the guidelines set forth by the Colorado Oil and Gas Conservation Commission. Gwen Jenks, surrounding property owner, asked what the purpose of calling the surrounding property owners to these hearings if their concerns were not taken seriously. Lee Morrison explained they were not called to the hearing, the notice they received was to inform them of the hearing date. Lee Morrison also explained the legal process between state government and local government regarding oil and gas permitting. Shelia Baessler, surrounding property owner, had the same concerns as the previous surrounding property owners and was adamant about Ed Holloway, Cache Exploration, providing a geologist to relieve the concerns about the instability of the area and the potential danger to the property owners. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance with Section 24. 3 of the Weld County Zoning Ordinance as follows: The proposal is consistent with the Weld County Comprehensive Plan Urban Growth Boundary Area Goals and Policies. The City of Greeley has reviewed this proposal and has recommended approval of this request. The proposal is consistent with the R-1 (Low Density Residential) zone district and is provided for as a Use by Special Review. - The uses which would be permitted can be compatible with the existing surrounding land uses which include residential, irrigated farm production, and pasture land. The uses which would be permitted can be compatible with the future development of the surrounding area as permitted by the existing zoning. - The property is located in the Airport Overlay District. The Development Standards address this concern. No other Overlay Districts affect this site; and Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County to the greatest extent possible. Page 2 The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1. The attached Development Standards for the Special Review permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's office within 15 days of approval by the Board of County Commissioners . 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. The applicant shall agree, in writing, to develop the Use by Special Review as a high density area as defined by Section 127 of the Colorado Code of Regulations, Rules and Regulations of the Colorado Oil and Gas Conservation Commission. 4. Road damage caused by drilling or support equipment shall be repaired within 30 days of completion of the four wells . 5. USR-995 1, The Site Specific Development Plan and Special Review permit is for oil and gas production facilities (four oil and gas wells and associated equipment) in the R-1 (Low Density Residential) zone district as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. The property shall be maintained in compliance with the Colorado Code of Regulations, Rules and Regulations of the Colorado Oil and Gas Conservation Commission including rules that pertain to oil and gas production in a high density residential areas. 4. The property shall be maintained in compliance with the Weld County Airport Overlay District Requirements. 5. All traffic during the drilling operation shall use Weld County Road 66 and enter and exit the property to or from the east on Weld County Road 66. 6 . Wellheads shall be located at least 250 feet from the nearest property line in Sonny View Estates and no less 350 feet from the nearest dwelling. 7 . All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. Exploration and production waste shall be disposed of at an approved facility. 8. No permanent disposal of wastes shall be permitted at this site. 9. Fugitive dust shall be controlled on this site. 10. The maximum permissible noise level shall not exceed the residential limit of 55 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 11. A spillage retention berm shall be installed and maintained around the tank battery. A stormwater discharge permit from the Colorado Department of Health, Water Quality Control Division, shall be obtained for all construction activities that disturb more than five (5) acres. 13. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 15. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 16. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated hereon and all applicable Weld County Regulations. 17. Safarik, Community Development Director SUBJECT: Use by Special Review to Allow Oil and Gas Drilling, Extraction, and Storage by Mineral Resources, Inc. , Greeley Commerce Center Sites This memorandum is an addendum to the submitted agenda packet provided for Council action at its November 17, 1992, meeting. As noted': in the Planning Commission minutes, no affirmative recommendation was made concerning one of the well sites and associated tank battery (Well and Tank Battery No. 1) . The Commissioners voiced a wide range of concerns relative to the siting of the well, none of which were able to be addressed at the meeting by •the;; applicant. The applicant, an affected property owner, and staff met on November 11, 1992, to discuss remedial actions to lessen safety concerns about the placement of tank batteries near occupied buildings or areas for future industrial development. As a result of this meeting, all outstanding issues have been addressed to the satisfaction of the City departments involved, the applicant, and the adjacent property owner. Adjustments have been agreed upon as to the design of the tank batteries, the size of the tanks to be used, and the safety measures to be taken to lessen impacts on adjacent properties. Following are the suggested amendments for Council 's consideration with this application. < The applicant, Mineral Resources, Inc. , fully supports these changes and has provided the technical evidence that the alternative design for the tank batteries will be viable. (See attachment. ) The plans wil lfully comply with all State regulations, and to the degree possible, satisfy the intent of the City's Zoning and Fire Codes. The specific amendments are as follows: 1. All tank batteries will be placed at below-grade locations. The excavation and construction of holding areas are inclusive of bermed walls which will be at least eight feet (8 ' ) in depth from the top of the bermed walls. The sloped banks will be covered by crushed aggregate which will serve as fire walls. See Alternative D on the attached plan. Za Paul Grattet November 16, 1992 Page Two A four-foot staircase will descend into the holding area. The separator and other equipment for pumping the oil will be at grade near the vehicular access to the tank battery. Tanks having a capacity of 200 barrels rather than 300 barrels are to be used. Inner berms around the base of the tanks to hold in contaminants were discussed. However, narrowing the base of the pits to be five feet (5' ) out from each tank would eliminate the need for a separate interior berm. The bases of all tank batteries will be lined with clay to decrease the risk of contamination of the water table only fourteen feet (14 ' ) below grade. 2. All tanks will be painted muted earth-tone colors. 3. No more than twenty percent (20%) of each tank will be exposed over the top of the berms for the holding areas. 4. Drainage systems shall be installed within each holding area inclusive of sump pumps to draw out any ponded water which might occur from time to time. The applicant shall be responsible for monitoring this situation as needed. 5. Each tank battery shall be enclosed by security fencing. Other equipment may also be enclosed. 6. Each access road to the tank batteries and other equipment shall be compacted and be surfaced by at least a six-inch (6") road base for the twenty-foot (20' ) access drive and turnaround area needed for emergency and service vehicles. 7. Lines designed to serve as pump-outs for the oil must be capable of draining, if they are remote from the tank. Tank batteries utilizing remote at-grade connections will need to have automatic drainback systems with a check valve at each end and a shut-off at the base of the tank. 8. Dirt excavated from the pits on-site shall be dispersed elsewhere on site (land application) . Topsoil will be separated out and retained on site for surface reuse. 9. Tank Battery No. 2 will be relocated so that it will be in the far northwest corner of the tract north of 31st Street. • T.a raitt •J Paul Grattet November 16, 1992 Page Three 10. Tank Battery No. 1 will be relocated so that it will be in the far southeast corner of the parcel on which it is located. It will be at least 25 feet (25' ) west of the western right-of-way line for 1st Avenue. 11. If City Council approves Alternative D, which would suppress the tank batteries into a pit below grade, no occupied building should be closer than two hundred feet (200') , unless appropriate safety measures are taken in the siting and design of future additions to existing buildings or new structures. If there is a change in the design of a tank battery to fully bury the tanks, the 200-foot separation requirement is not needed. 12. The SWV4 is zoned R-1,with Sunny View Estates being on the West side of 35th Avenue (WCR 35), and all areas East of 35th Avenue being used solely for agriculture. No subdivision platting has taken place East of 35th Avenue. Cache is aware that it must seek and obtain a Use by Special Review ("USR") to allow drilling of the wells, since such activities are not within the uses by right for R-1 zoning. An application for such a USR is now being completed, with filing to be done as soon as the complete application package can be assembled. It is extremely important that these wells be drilled during 1992, since to delay drilling will result in the loss of tax credits under Section 29 of the Federal Income Tax Code. The loss to Cache,should drilling not take place, is expected to exceed$350,000. These wells are marginally economic, and the tax credits play a large role in the determination to drill the wells. In addition, drilling will be done by an Oklahoma drilling contractor who has agreed to move a rig to this area based on the drilling of nine wells...of which four will be these Cache wells. The benefits of drilling the wells will flow not solely to Cache. Weld County will gain needed tax revenues from the wells of over $175,000. There is simply no way that the USR can be obtained in time to allow drilling in 1992. Therefore, Cache requests that the Board allow Cache to drill the wells while the USR is in process, with the understanding that Cache will assume the risk of drilling without the USR and will need to cease operations in connection with the wells should the USR be denied. The drilling contractor,Quantum Drilling Company,will be using a truck-mounted rig which is only 102 feet tall...as opposed to the normal non truck-mounted rigs used in this area which average 139 feet in height. The truck-mounted rig will substantially lessen traffic and enable drilling to take place on smaller suface locations. In addition, Quantum has agreed to use an additional muffler, like those they have used while drilling in various Oklahoma towns and cities, to lessen noise levels during drilling. PROPOSED USE: By this Application, Cache Exploration, Inc. ("Cache") seeks a Use by Special Review ("USR") to permit drilling and completion at legal locations of four wells to develop the Code11, Niobrara and other uphole oil and gas horizons within the SW'/4 of Section 24 from surface locations in that part of the SWY4 lying east of WCR 35 ("the "USR Area"). The four wells will be drilled at the locations set forth on the USR plat, and the production equipment, consisting of a single facility for all four wells, will be located on the east side of the USR area behind an emstmg tree. 0nl_y one separator and"not more than two 40.0-barrel oil_stock tanks will be utilized. All flowlines and pipelines will be buried below plow depth. NEED: The oil and gas beneath the USR area is subject to valid oil and gas leases. The proposed use will protect the rights of mineral owners and leasehold owners to explore for and produce oil and gas from beneath the SW1 while minimizing interference with surrounding agricultural land uses, avoiding duplication of or conflict with regulations of the Colorado Oil and Gas Conservation Commission ("OGCC"),maintaining the Board's land use goals, and protecting public health,safety and welfare. EXISTING USES: The USR area and surrounding land are located north of the City of Greeley and have been used for agriculture (irrigated crops) and for oil and gas production. The Sunny View Estates subdivision is directly to the west of the USR area,but is separated from the USR area by WCR 35. The entire USR area was zoned R-1 by the Board at a time when residential zoning seemed prudent to protect the Sunny View Estates and Seeley Lake subdivisions west and southwest of the USR area. DISTANCES TO STRUCTURES: The wellheads will be located at least 350 feet from the nearest occupied dwelling,which is in the Sunny View Estates subdivision, in full compliance with the most strict distance provisions of the rules of the OGCC. USERS. BUYERS, ETC.: None EMPLOYEES AND HOURS: The property will be unmanned after development. During drilling (which takes place around the clock until completed) there will be approximately seven or fewer workers on site at any given time. The drilling of each well is expected to take 5 days. Completion of each well is expected to take place within 30 days after drilling operations have ended. Completion activities are conducted only during daylight hours. WATER: Water is used only for drilling and completion operations. It will be secured offsite and trucked onto the locations as needed. ACCESS: Access for drilling and completion purposes will be from WCR 66 as shown on the plat. Access for normal well service after completion will be from WCR 35 for the Seeley#1 and#2 well, and from WCR 66 for the Seeley #3 and #4 wells. VEHICLES: During the approximate five-day period drilling operations, rig transport trucks,with a permit from Weld County Road and Bridge Department, will move the rig on and off of the locations, and water, tubular goods and other suppliers will be accessing the wellsite. Suppliers will also access the site during completion to deliver tanks, the separator and other materials. Once completion has taken place, there will only be pickup truck traffic (once per day) to each wellhead and the battery facility, and oil tank trucks will haul loads of oil from the tank battery approximately once or twice per week. _. there is a problem with a well (whict. .iappens very infrequently), a completion rig will need to access the well. SEWAGE: No need for sewage exists. Sanitary toilets will be used for workers during the drilling and completion operations. FIRE PROTECTION: No additional fire protection services will be needed. Fire extinguishers and fire protection measures will be in compliance with OGCC regulations. ANIMALS: None. WASTE: All waste and debris will be transported off the premises. Drilling fluid will be vacuumed and removed from the site. Cuttings will be buried in the reserve pit when the pit is backfilled. STORAGE: Storage of produced oil will be in API approved stock tanks of 400 or fewer barrels of capacity. LANDSCAPING: None planned. RECLAMATION: Upon completion of each well, the pits will be properly backfilled and the surface restored to as near its original condition as is practicable to permit continued farming. Upon abandonment, the site will be fully reclaimed in accordance with OGCC regulations. TIME TABLE: Drilling: ±5 days each well Completion: ±30 days each well COMPREHENSIVE PLAN: The drilling of oil and gas wells has been demonstrated to be consistent with the Weld County Comprehensive Plan. Similar USRs have been approved by the Board for wells in R-1 zones. AGRICULTURAL PRESERVATION: The wells have been situated to least interfere with present agricultural use while conforming to rules and regulations of the OGCC. HEALTH AND SAFETY: The OGCC has extensive rules and regulations to protect the health, safety and welfare of inhabitants of the neighborhood. Cache will be in full compliance with all such rules and regulations. COMPATIBILITY: The area surrounding the USR area will not be affected by the intended use. WCR 35 forms an ideal buffer between the agricultural and proposed oil and gas uses and the subdivisions to the west and southwest of the USR area. All other surrounding areas are being used for both agriculture and oil and gas. NO OVERLAYS: The USR area is not within a flood plain, geologic hazard area, or the Weld County Airport overlay district or any other known overlay district. WATER SUPPLY: No water will be needed other than during drilling and completion operations, and water required for these operations will be trucked to the locations as needed. PROOF OF INTEREST: An Affidavit from Edward A.Holloway concerning oil and gas leasehold ownership is attached to this Application as Exhibit C. NOISE REPORT: Waiver requested. The OGCC addresses noise in its rules. SOIL REPORT: No need for a soil report is perceived. The soil is adequate to support a drilling rig, which is the only important consideration for the requested use. The soils within the U.S.R. The parcel is located within the three- mile area of influence of the city of Greeley. The 1987 weld County Comprehensive Plan requires referring land-use proposals for review and comment to any jurisdiction within three miles of the proposal. 3. It is the practice of the City of Greeley Planning Commission to review Weld County requests principally for conformance .with the City's Comprehensive Plan policies. Detailed design specifications are not reviewed for conformance with City standards. 4. Oil and gas exploration and production facilities require a special use permits under the Weld County Zoning Ordinance.
