RE: APPROVE INTERGOVERNMENTAL AGREEMENT WITH CITY OF GREELEY AND AUTHORIZE
CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Intergovermental Agreement
for transportation services between the Weld County Division of Human Resources,
by and through the Board of County Commissioners of Weld County, Colorado, and
the City of Greeley, with terms and conditions being as stated in said agreement,
and
WHEREAS, after review, the Board deems it advisable to approve said
agreement, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Intergovermental Agreement for transportation services
between the Weld County Division of Human Resources, by and through the Board of
County Commissioners of Weld County, Colorado, and the City of Greeley be, and
hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 4th day of October, A.D. , 1993.

INTERGOVERNMENTAL AGREEMENT
, THIS INTERGOV Z E TAL AGREEMENT, made and entered into the
Y '- day of r� �J , 1993, by and between the WELD
COUNTY, COLORADO, by and through the Board of County Commissioners
of Weld County, 915 Tenth Street, Greeley, Colorado 80631, by and
on behalf of the WELD COUNTY DIVISION OF HUMAN RESOURCES,
hereinafter referred to as "Weld County" and the CITY OF GREELEY,
COLORADO, by and through the Greeley City Council, 1000 Tenth
Street, Greeley, Colorado 80631, hereinafter referred to as "City" .
WITNESSETH:
WHEREAS, the Weld County Division of Human Resources building
is located at 1551 N. 17th Avenue, and
WHEREAS, Weld County administers various programs for the
citizens of Weld County, Colorado, and
WHEREAS, City operates a public bus service for the citizens
of Greeley and various surrounding areas, and
WHEREAS, no City bus stop is located at said Division of Human
Resources building, and no City fixed route bus service is provided
to said building, and
WHEREAS, in order to provide transportation services to
clients of the Weld County Division of Human Resources, Weld County
desires to provide bus service for said clients and City wishes to
provide reimbursement to Weld County for said bus service.
NOW, THEREFORE, in consideration of the mutual promises and
covenants contained herein, the parties hereto agree as follows:
1. TERM: The term of this Intergovernmental Agreement shall be
from August 1, 1993, and shall be automatically renewed on a
yearly basis subject to mutual approval and funding
availability, unless sooner terminated by either party
pursuant to the termination provisions contained in paragraph
6 below.

2 . BUS SERVICE: Weld County shall provide bus service for
clients of the Weld County Division of Human Resources on a
daily basis from the bus stop located at the Weld County
Department of Social Services, 315 N. 11th Avenue, to the Weld
County Division of Human Resources building located at 1551 N.
17th Avenue. The buses which shall be used will be 14-
passenger maxi-vans. Approximately 10 trips per day will be
provided by Weld County on said route.
3. COMPENSATION: City agrees to compensate Weld County for
providing said bus service at the rate of $1. 14 per mile
driven, not to exceed $8, 500 per year. Said price shall be
reviewed on an annual basis and shall include all overhead
expenses, including, but not limited to, time expended by
drivers, equipment time, maintenance, repair work, and fuel.
4. PAYMENT: Weld County shall bill City monthly for providing
said bus service. City agrees to pay each invoice submitted
by Weld County within 15 days of its receipt.
5. RECORDS: Weld County agrees to maintain sufficient records to
provide adequate information to substantiate and justify all
billings to City. Said records shall be open to review by
City at any reasonable time. All such records shall be open
to public inspection, pursuant to Section 24-72-203 , C.R. S.
6. TERMINATION: This Agreement may be terminated by either party
by providing written notice to the other party at least 15
days prior to said scheduled date of termination.
7. THIRD PARTY LIABILITY/WAIVER OF IMMUNITY: No portion of this
Agreement shall be deemed to constitute a waiver of any
immunities the parties or their officers or employees may
possess, nor shall any portion of this Agreement be deemed to
have created a duty of care with respect to any persons not a
party to this Agreement.
8 . NON APPROPRIATION: No portion of this Agreement shall be
deemed to create an obligation of the part of either party to
expend funds not otherwise appropriated in each succeeding
year.
9. REPORTING: City agrees to comply with all required reporting
pursuant to state and/or federal public utilities regulations.

CITY OF GREELEY, COLORADO
RESOLUTION NO. 42 , 1993
A RESOLUTION AUTHORIZING AND DIRECTING THE MAYOR OF THE CITY OF
GREELEY TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT WITH WELD
COUNTY FOR THE PROVISION OF BUS SERVICE TO WELD COUNTY'S HUMAN
RESOURCES AND DEVELOPMENT BUILDING.
WHEREAS, the Greeley City Charter permits the City Council, by
resolution, to enter into contracts with other governmental bodies
to furnish governmental services or enter into cooperative or joint
activities with other governmental bodies; and,
WHEREAS, Colorado Revised Statutes §29-1-201, et seq. , permits
and encourages governments to make the most efficient and effective
use of their powers and responsibilities by cooperating and
contracting with other governments; and,
WHEREAS, the City of Greeley and County of Weld desire to
enter into an agreement to provide transportation services to
clients of the Weld County Division of Human Resources.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF GREELEY, COLORADO:
Section 1: The Mayor of the City of Greeley is hereby
authorized to enter into an Intergovernmental Agreement (a copy of
which is attached and incorporated herein as Exhibit "A") with the
County of Weld to provide transportation services to clients of the
Weld County Division of Human Resources and Development Building.
Section 2 : The City Council hereby declares that the best
interests of the citizens of Greeley would best be served by
entering into said Intergovernmental Agreement.
Section 3 : This resolution shall be effective immediately
after passage of this resolution as provided by the Greeley City
Charter.
PASSED AND ADOPTED, SIGNED AND APPROVED this 17th day of
August , 1993 .

Enclosed for Board approval is an agreement between the Weld County Board
of Commissioners and the City of Greeley for the purchase of
transportation services from Weld County Division of Human Resources.
The City agrees to compensate Weld County $1.14 per mile not to exceed
$8,500 per year for transportation of persons from the bus stop located at
the Weld County Department of Social Services to the bus stop located at
Weld County Division of Human Resources.
This agreement shall be automatically renewed on a yearly basis subject to
mutual approval and funding availability.
