HomeMy WebLinkAbout930303.tiff RESOLUTION RE: APPROVE LEASE OF BUILDING WITH DISABLED AMERICAN VETERANS GREELEY CHAPTER #8, INC. , AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Lease of Building between the Disabled American Veterans Greeley Chapter #8, Inc. , and Weld County Veterans Services Office, by and through the Board of County Commissioners, commencing May 1, 1993, and ending May 1, 1994, with the further terms and conditions being as stated in said lease, and WHEREAS, after review, the Board deems it advisable to approve said lease, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Lease of Building between the Disabled American Veterans Greeley Chapter #8, Inc. , and Weld County Veterans Services Office, by and through the Board of County Commissioners, be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized to sign said lease. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 12th day of April, A.D. , 1993. Kirkme er 930303 11 4 o O 0 a LEASE OF BUILDING THIS LEASE is made this day of (/2a41Xq 1993, by and between the Disabled American Veterans Greeley Chapter # 8, Inc. , whose address is P.O. Box 215, Greeley, Colorado 80632 , Lessor, and the Board of County Commissioners of the County Weld, Colorado, on behalf of the Weld County Veterans Services Office, whose address is 915 Tenth Street, Greeley, Colorado 80631, Lessee. IN CONSIDERATION of the payment of all utilities during the period of this Lease and the performance of the covenants and agreements by the Lessee set forth below, Lessor does hereby lease to the Lessee the following described premises located in the City of Greeley, Colorado, the address of which is 1830 Eighth Avenue, Greeley, Colorado 80631, described as follows : The top floor of the building situated on Lots 33 and 34 , Block 9, Arlington Heights, City of Greeley, Weld County, Colorado. TO HAVE AND TO HOLD the same with all the appurtenances unto the said Lessee from 12 : 00 A.M. on the first day of May, 1993 and until 12 : 00 A.M. on the first day of May, 1994 and shall continue on a year-to-year basis thereafter, subject to the termination provisions in paragraph "D" , below. No rental shall be charged and/or collected by the Lessor. The Lessee, in consideration of the leasing of the premises, agrees as follows : 1 . To pay all utilities for the period of this Lease including, but not limited to, gas, electric, water, trash, and telephone used by Lessee. 2 . To keep the premises in a clean and sanitary condition as required by the ordinances of the City of Greeley, Colorado. 3 . To sublet no part of the premises, and not to assign the Lease or any interest therein without the written consent of the Lessor. 4 . To use the premises only as offices for the Weld County Veterans Services, and to use the premises for no purposes prohibited by the laws of the United States or the State of Colorado, or of the ordinances of the City of Greeley, Colorado, and for no improper or questionable purposes whatsoever, and to neither permit nor suffer any disorderly conduct, noise, or nuisance having a tendency to annoy or disturb any persons occupying adjacent premises . 5 . To allow the Lessor to enter upon the premises at any reasonable hour. 930303 IT IS EXPRESSLY UNDERSTOOD AND AGREED BETWEEN THE LESSOR AND LESSEE AS FOLLOWS: A. No assent, express or implied, to any breach of any one or more of the agreement hereof shall be deemed or taken to be a waiver of any succeeding or other breach. B. In the event of a condemnation or other taking of the premises by any governmental agency, all proceeds shall be paid to the Lessor hereunder, Lessee waiving all right to any such payments . C. This Lease is not intended to benefit any third party, nor is it to be intended to waive any privileges or immunities of parties or their officers, agents, or employees may possess . D. This Lease may be terminated at any time by either party hereto upon 30 days written notice to the other party sent to the addresses in paragraph "E" , below. E. Any written notice required to be given under this agreement shall be delivered to the Lessor at: P.O. Box 215, Greeley, Colorado 80632 , to the Lessee at: 915 Tenth Street, Greeley, Colorado 80632 .
