RE: APPROVE AMENDMENT TO THE AGREEMENT FOR SALE AND PURCHASE OF VACANT LAND
FOR RIGHTS-OF-WAY AND/OR EASEMENTS WITH EDITH JEAN CHAVERS AND AUTHORIZE
CHAIRMAN TO SIGN - BRIDGE #8/25A
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Amendment to the Agreement
for Sale and Purchase of Vacant Land for Rights-of-Way and/or Easements for
Bridge I/8/25A between the County of Weld, State of Colorado, by and through the
Board of County Commissioners of Weld County, on behalf of the Public Works
Department, and Edith Jean Chavers with terms and conditions being as stated in
said amendment, and
WHEREAS, after review, the Board deems it advisable to approve said
amendment, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Amendment to the Agreement for Sale and Purchase of
Vacant Land for Rights-of-Way and/or Easements for Bridge #8/25A between the
County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Public Works Department, and Edith
Jean Chavers be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said amendment.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 4th day of April, A.D. , 1994.

AMENDMENT TO THE
AGREEMENT FOR SALE AND PURCHASE OF VACANT
LAND FOR RIGHTS-OF-WAY AND OR EASEMENTS
THIS AGREEMENT, made and entered this c7 9 day of tf1ceviccl , 19''y
by and between Weld County, Colorado, by and through the Board of County
Commissioners of the County of Weld, Colorado, hereinafter referred to as
"County, " and Edith Jean Chavers

hereinafter referred to as "Owner. "
WHEREAS, Owner wishes to make a change in the original agreement under
number 6 of "other conditions, terms or obligations" on page 2 of 2 pages.
Changes would be made to the statement " The County will have their contractor
relocate existing west driveway and gate to the east approximately 50' and
replace or relocate any trees that are disturbed during construction" .
WHEREAS, County wishes to pay Owner Three Thousand,eight hundred and
twenty-five in cash, ($3825.00) to purchase eleven trees that were deleted
during construction and which Owner would install and maintain said trees in
lieu of the contract bid price of $3870.00 to replace or relocate said trees.
WHEREAS, Owner would release the County of any and all responsibility for
the replacement, maintenance, installation, or additional costs occurred for
said trees in the original attached agreement dated October 8, 1993, with the
acceptance of this payment.
WITNESSETH:
That in consideration of the payment by County to Owner of the sum of
Three Thousand, eight hundred and twenty-five Dollars ($ 3825.00 ) ,
in cash. County agrees to pay owner for eleven trees to replace the eleven
trees removed during bridge construction and Owner agrees to release the County
of any responsibility to replace or maintain the trees as stated in the
original agreement.
IN WITNESS HEREOF, the parties hereto have subscribed their names this
4TH day of APRIL , 19 94 .
