AR2317614 RESOLUTION RE: APPROVE FEE SCHEDULE CONCERNING FEES CHARGED BY THE WELD COUNTY DEPARTMENT OF PLANNING SERVICES FOR PROCESSING AND REVIEWING LAND-USE PERMIT APPLICATIONS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, held a public hearing on the 14th day of December, 1992, at 9:00 a.m. , in the Chambers of the Board for the purpose of considering an increased fee schedule for fees collected by the Weld County Department of Planning Services for processing and reviewing land-use permit applications, and WHEREAS, after study and review, the Board deems it advisable to approve the proposed fee schedule concerning said fees, effective December 15, 1992, a copy being attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the attached fee schedule for land-use permit applications be, and hereby is, approved, to become effective December 15, 1992. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 14th day of December, A.D. , 1992. Two philosophies exist as to who benefits and should pay for the processing of applications. The first philosophy is that the applicant, developer, or resultant users are the beneficiaries of the processing and should pay all the costs associated with the processing. The second philosophy is that the applicant and community in general are the beneficiaries and that both should bear the costs of processing with application fees and dollars collected by general taxation. The fees recommended for 1993 were developed utilizing the philosophy that the applicant or developer benefits the most from the approval of the application through increased market value of the property or increased uses on the property and should pay for the 50% of the application processing and 50% should come from the general fund. At present, the application fees collected do not cover 50% of all of the direct and indirect costs involved in the processing of land-use and development applications. The attached materials indicate the amount needed to recover 100% of the direct and indirect processing costs for each type of application and the recommended fees for 1993.
