HomeMy WebLinkAbout940315.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #1594 - BOND WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #1594, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption #1594 was submitted by Jack and Lila Bond, 1357 43rd Avenue, Greeley, Colorado 80634 for property which is located in part of the NE} of Section 16, Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 1.5 acres and 28.5 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1594 submitted by Jack and Lila Bond be, and hereby is, approved conditional upon the following: 1. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. 2. The following note shall be placed on the recorded exemption plat prior to recording: Both lots shall conform to the requirements of the A-P (Airport) Overlay District. 3. Prior to recording the plat: a. The noncommercial junkyard consisting of secondhand building materials and various junk shall come into compliance with the Weld County Zoning Ordinance. 4. The following note shall be placed in the recorded exemption plat prior to recording: Prior to the issuance of a building permit for Lot B, the owner shall submit evidence that an adequate public water source and public sewer system will serve the site. 5. The following note shall be placed in the recorded exemption plat prior to recording: At such time as a public sewer system is extended to Lots A and B, the dwelling then located on Lot A shall attach to said public sewer system. The parcel of land is described as part of the NE4 of Section 16, T5N, R65W of the 6th P.M. , Weld County, Colorado. A single-family dwelling currently exists on proposed Lot A, however, no dwellings exist on proposed Lot B. The property is located within the Urban Growth Boundaries of the City of Greeley, the City of Evans and the Town of Garden City. Both Greeley and Garden City indicated they have reviewed the request and found no conflicts with their interests. The City of Evans did not respond. This request is to divide the contiguous land holdings of the applicant into two lots, one which is 1.5 acres and the other 28.5 acres, more or less. The subject property is located in an R-1 (Low Density Residential) zone district. The recorded exemption process creates two separate, legal building lots. In the R-1 zone, one of the uses allowed by right is one single family dwelling per legal lot. However, according to Section 32.2.2.1 of the Weld County Zoning Ordinance, the single family dwelling shall "be connected to and served by a public water system and a public sewer system." The Zoning Ordinance continues by indicating, "This requirement does not apply to any legal lot created prior to the enactment date of this Ordinance. . . " Therefore, the property as it exists presently can utilize the septic system it is hooked up to, but any newly created lots would be required to utilize public water, as well as public sewer. 940315 RECOMMENDATION, RE-1594 Jack and Lila Bond Page 2 The Weld County Subdivision Ordinance contains recorded exemption standards which a recorded exemption application shall comply with. Section 11.8.2 of the Subdivision Ordinance indicates, "An adequate sewer service is available to serve the uses permitted on both proposed lots. The sewer service shall comply with the requirements of the applicable zone district and the Weld County Health Department." The applicants verbally indicated the current residence is served by a septic system. Public Sewer will not be provided to proposed Lot A or proposed Lot B. The Department of Planning Services recommends denial for the proposed Recorded Exemption. If the recorded exemption were approved, Lot B would be a legal building lot, but would not be able to obtain building permits because it would not meet the basic minimum R-1 district requirements of connecting to a public sewer system. Therefore, the proposed Recorded Exemption is not in accord with efficient and orderly development and does not provide adequate means of sewage disposal as stated in Sections 1.3.1 and 1.3.16 of the Weld County Subdivision Ordinance. The Department of Planning Services staff requests the Board of County Commissioners deny this recorded exemption because the criteria for approval as set forth in Section 1 and Section 11 of the Weld County Subdivision Ordinance, and Section 32.2.2.1 of the Weld County Zoning Ordinance has not been met. The purpose for the request is to create a utilization of the lard in conformity with its traditional historical use in the past. This is a 30 acre parcel which was primarily used for farming with farm house and outbuildings located cer the property. The present landlord has no use for the farm house and outbuildings in order to carry on the traditional composes of the remaining Parcel A. Landowner therefore proposes to seek this recorded exemption for the farm muse and outbuildings aril to sell the farm house and outbuildings to a third party. That third party has already been located and has in fact, executed an InLrist to Purchase the lard ace it has been identified separately through the recorded exemption procedure. 2. Describe the location, size and present use of the area where each proposed new lot will be created. This property is located East of Greeley and presently the farm house actually has address of 906 East 20th Street, Greeley, Colorado. Tie parcel in question is approximately a 30 acre parcel which has been farmed in the past. The larger parcel is subject to an oil and gas lease and the indications are that an oil and gas well will be drilled upon the larger parcel. Explain how the uses permitted will be oampatible with existing uses surrounding the proposed recorded exemption. The uses permitted will be compatible with the existing use of surrounding property. The character of the land in question is changing rapidly from a previous agricultural use to a more intensive land use adjacent to the City of Greeley. A school is located immediately East of the property in question. Further East are found mobile home parks an both sides of the road, other single fanily dwellings created from prior farm estates, and farmland are all around the property. There is also commercial activity along this street at various locations. 5. Explain how the proposal is consistent with the intent of the zoning district it is located within. There is nothing issocnsistent with the proposed use in the intended zoning district in which it is located. It is also compatible with the Weld Canty Can rehessive Plan. 940315 pa- 6. The landlord does intend to seek a mini-subdivision regarding the retained 28.5 acres (more or less, ) in the future, or a portion of that acreage, which are believed to be more appropriately placed to a higher and better use than residential properties.
