HomeMy WebLinkAbout940750.tiff RESOLUTION RE: APPROVE PRELIMINARY PLAN FOR A SUBDIVISION IN THE E (ESTATE) ZONE DISTRICT - MIKE AND PAM GUTTERSEN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 10th day of August, 1994, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Mike and Pam Guttersen, 26780 Weld County Road 36, LaSalle, Colorado 80645, for a Preliminary Plan for a Subdivision in the E (Estate) Zone District on the following described real estate, to-wit: Part of the SW-', of Section 21, Township 5 North, Range 64 West of the 6th P.M. , Weld County, Colorado WHEREAS, Mike Guttersen, said applicant, and Larry Intermill and Steve Stencel of Intermill Land Surveying, were present, and WHEREAS, Section 6.3.3.5 of the Weld County Subdivision Ordinance provides standards for review of said Preliminary Plan for a Subdivision, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 6. 1 of the Weld County Subdivision Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 6.3.3.5 of the Weld County Subdivision Ordinance including specifically: a. The proposed Preliminary Plan is consistent with the Weld County Comprehensive Plan and is compatible with the future development of the surrounding area as permitted by the existing Estate Zone District and plans of the affected municipality. The Town of Kersey has reviewed the proposal and found no conflicts with its interests. Central Weld County Water District has stated that a water supply to the site that is sufficient in quantity, dependability, and quality, including fire protection, can be made available to the subdivision if its conditions are met. Additional information required to be submitted at the time of the Subdivision final plat will address their conditions. c. The proposed individual sewage disposal systems for the subdivision would be installed according to Weld County Health Department regulations. d. Streets within the proposed subdivision are adequate in functional classification, width, and structural capacity to meet the traffic requirements of the proposed use. e. Off-site street and highway facilities providing access to the proposed subdivision are adequate in functional classification, width, and structural capacity to meet the traffic requirements of the subdivision. Weld County Road 53, a paved county collector, will provide access to the subdivision. f. Sewer service will be provided by individual septic design systems approved by the Weld County Health Department. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Mike and Pam Guttersen for a Preliminary Plan for a Subdivision in the E (Estate) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. Uses permitted within the subdivision shall consist of E (Estate) uses as listed in Section 36 of the Weld County Zoning Ordinance and described in the application materials. 2. A maximum number of 13 lots as shown on the Preliminary Plan plat shall be allowed in the subdivision. 3. Central Weld County Water District shall provide domestic water to the subdivision. 4. Sewer service shall be provided by individual septic design systems approved by the Weld County Health Department. 5. All lots within the subdivision shall comply with the requirements of the Platte Valley Fire Protection District. 7. The operators of the on-site oil and gas wells shall have access to and be allowed to maintain their facilities. 8. A comprehensive site specific geotechnical investigation to determine subsurface soil conditions (i.e. , bearing capacities, swelling potential) , shallow bedrock, groundwater levels and flooding potential and percolation shall be done by the individual lot owners. 9. The Subdivision Final Plat submittal shall include the following: a. A 15-foot utility and drainage easement at all rear lot lines, except where the Lower Latham Ditch goes through a lot and the utility and drainage easement remains to the west of the ditch, where the easement shall be 20 foot. b. Clarification as to whether wetlands exist on this site. c. Provisions for an emergency access. Kir mey 940750 HEARING CERTIFICATION DOCKET NO. 94-55 RE: PRELIMINARY PLAN FOR A SUBDIVISION IN THE E (ESTATE) ZONE DISTRICT - MIKE AND PAM GUTTERSEN A public hearing was conducted on August 10, 1994, at 10:00 a.m. , with the following present: Commissioner W. H. Webster, Chairman Commissioner Dale K. Hall, Pro-Tem Commissioner George E. Baxter Commissioner Constance L. Harbert Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Greg Thompson The following business was transacted: I hereby certify that pursuant to a notice dated July 18, 1994, and duly published July 21, 1994, in the Windsor Beacon, a public hearing was conducted to consider the request of Mike and Pam Guttersen for a Preliminary Plan for a Subdivision in the E (Estate) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Greg Thompson, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record as written. In response to questions from Commissioner Hall concerning the drainage plan and the wetlands issue, Mr. Thompson stated the Army Corps of Engineers, as well as the applicants' engineer, Clifford Ham of Foundation Engineering, has been involved with the wetlands issue; however, as required by Condition of Approval 1/9b, clarification is still needed as to whether wetlands exist on this site. Mr. Thompson indicated the wetlands area is five or less acres, and it could be designed around. Larry Intermill, Intermill Land Surveying, represented the applicant and provided Mr. Thompson with a letter dated July 28, 1994, from the Army Corps of Engineers indicating the wetlands delineation map dated July 6, 1994, by Clifford Ham of Foundation Engineering is considered accurate and acceptable by its office. Mr. Thompson stated this matter could be worked into the recommendation prior to the final plat submittal. He also noted, according to a map from Mr. Ham, that the wetlands area consists of 5.49 acres to the south and east of the Latham Ditch and 0.85 acres to the north of the ditch. Mr. Intermill submitted the abovementioned letter for the record as Exhibit H and reiterated that both engineers agreed the proposal was acceptable for the wetlands area. He stated the subdivision will contain 13 residential lots, and it has received 100 percent support from the Town of Kersey and the Planning Commission. Commissioner Kirkmeyer noted, for the record, that she and Commissioner Hall were at the Town of Kersey Planning Commission meeting. Commissioner Hall stated concerns about the number of lots being served by only one access and the lack of an emergency access and requested further explanation concerning the drainage plan. Mr. Intermill stated the street will be privately maintained and was designed to provide a buffer zone from the rural area. He stated there are 24 new homes to the north and another 60 homes platted; therefore, the design would prevent excess traffic. Mr. Intermill also explained Kersey's police discouraged a circle drive to prevent speeding, etc. He noted there are only 13 lots and the streets will be wide enough for emergency equipment. Commissioner Harbert stated concerns about the gas wells located on the lots and reiterated the need for an emergency access. Discussion ensued concerning a possible location for an emergency access, and Mr. Intermill stated he is agreeable to providing an emergency access; however, he would like to work with staff 940750 tc : PL. RE: HEARING CERTIFICATION - GUTTERSEN PAGE 2 concerning the location, which could possibly be between Lots 3 and 4 where the Town of Kersey has an existing easement to its water tower. Commissioner Kirkmeyer noted that Section 10.2.4 of the Subdivision Ordinance requires coordination with other subdivision alignments. Chairman Webster suggested looking at 7th Street between Lots 4 and 5. Mr. Intermill said that may go through an existing platted lot; however, he reiterated, they will provide an emergency access. Steve Stencel, Project Coordinator of Intermill Land Surveying, explained the preliminary drainage plan prepared by Foundation and Soils Engineering, Inc. He stated the ground is very hilly and sandy and grading and culverts will be used for the roads. Further discussion ensued concerning run off and percolation, and Mr. Stencel read the drainage recommendation from Kevin Patterson, Foundation and Soils Engineering, Inc. He also reiterated there are only 13 home sites, with gravel roads and drives; therefore, there will be minimal impervious area. Mr. Stencel indicated the engineer who completed the soils report may know the percolation rates, and he will obtain and submit them if necessary. Mr. Intermill confirmed that the sandy soil will take care of the water, which is supported by Mr. Patterson's calculations. Richard Sitzman, property owner northwest of the site, stated he has lived on his property for seven years and confirmed the soil conditions are very sandy, with rainfall disappearing within 30 minutes. He reiterated there will not be a problem with standing water. Kevin Chesnut, adjacent property owner, stated he has 440 volts of power for his sprinkler and there is a pond by the wetlands, which creates concern about children in the area. He stated he is also concerned about people complaining about crop dusters. In response to questions from the Board, Mr. Chesnut stated he owns the property on the south side of Latham Ditch and along the east side of the subject property and has cattle on that property. Commissioner Harbert suggested "right to farm" language be included in the covenants to prevent problems with Mr. Chesnut's farming. Mr. Chesnut also questioned whether the owner of Lot 7 would own the wetlands and stated the only access is from his property. Commissioner Harbert noted the 30-foot Latham Ditch easement. In response to a question from Commissioner Kirkmeyer, Mike Guttersen, applicant, stated he had spoken with a representative and the president of CFG Energy and all questions had been answered and all problems had been solved. He stated CFG also operates under Parker and Parsley and confirmed they had been notified of today's hearing and a sign had been posted on the property. Concerning Mr. Chesnut's question regarding the wetlands, Mr. Guttersen confirmed there is a recorded easement for the ditch company and a non-vehicle bridge to utilize. Regarding concerns about children playing, Mr. Guttersen indicated this quality of subdivision should deter children from the trailer court. He noted that 60 houses have been proposed with no opposition from the east property owner and stated this proposal will be positive for Weld County, Kersey, and the neighbors. Concerning the emergency access easement, Mr. Guttersen stated the best option would probably be on 5th Street. He then submitted two letters of support: one from William R. Farr, President of Eaton Bank, marked as Exhibit I, and one from Dorothy Zabka marked as Exhibit J. Responding to further questions from the Board, Mr. Guttersen stated the property to the south and east is fenced with 4- or 5-strand barbed wire; however, most property owners will have calves, horses, etc. , for 4-H projects and will also put up their own fence. He stated the covenants will be similar to those for Pinnacle Park and can be made more strict if necessary. Also in response to questions from the Board, Mr. Morrison said covenants are reviewed; however, they are only reviewed for the mechanism of privately maintained roads. He also stated that, since Pinnacle Park has been completed, subdivisions over a certain size have to abide by State statute requirements. Mr. Guttersen referred to covenants/home owners association for the 14-lot subdivision created by Mr. Gilbaugh and stated an agreement was arranged for Weld County to maintain the roads. In response to a question from Commissioner Baxter concerning the "right to farm" language, Mr. Guttersen stated the subdivision would contain only 13 homes; however, 940750 RE: HEARING CERTIFICATION - GUTTERSEN PAGE 3 he would look at the covenants for the 60 new homes built north of Kersey and reiterated he does not want to interfere with farming. In response to a question from Commissioner Hall, Mr. Guttersen stated he would do whatever is required concerning the emergency access, and he would agree right now to a recorded easement with a passable road through Lot 4. He also stated the covenants for Lot 4 would include a locked gate with a key to whoever the Board deems necessary. Commissioner Harbert suggested Mr. Guttersen work with the Kersey fire and police staff concerning the access. Mr. Guttersen explained the fire protection district already approved the proposal, without the emergency access, as long as a six-inch water line and fire hydrants are provided. After further discussion, Commissioner Kirkmeyer clarified Mr. Guttersen should work with staff concerning the emergency access. Commissioner Hall stated he would like to see a physical location of the access, not just an easement, on the plat. Mr. Morrison suggested the emergency access be required as part of the final approval, explaining the Board would review the final plat and an improvements agreement in the future. After discussion concerning language for Condition of Approval 119c, Mr. Thompson entered the following into the record: "The Subdivision Final Plat submittal shall include the following: Provisions for an emergency access." Commissioner Kirkmeyer moved to approve the request of Mike and Pam Guttersen for a Preliminary Plan for a Subdivision in the E (Estate) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record and the addition of Condition of Approval 1/9c. The motion was seconded by Commissioner Baxter, and it carried unanimously. The purpose of these inspections was to determine if the proposed subdivision and its immediate vicinity fall under Wetland Jurisdictional Status as defined by the Federal Interagency Committee for Wetland Delineation. We understand that the 87+ acre site will be developed into thirteen ( 13 ) single- family residential lots . During the on-site inspections, it was noted that visible signs of wetland hydrology exists presently at the southeastern portion of the tract ( see attached exhibit) on either side of the Latham Ditch, for a total of 7 . 91+ acres . Soils in this area are waterlogged on the southeast side of the ditch . Soils to the north exhibit a relatively distinct boundary between hydric and non- hydric soils . Vegetative indicators include, but are not limited to, Bull Sedge Alkali Saration, Inland Saltgrass , and Bull Rush. The U. S . Soil Conservation Service has determined that the area is also prone to periodic flooding (April - June) and is favorable for wetland wildlife . A review of related soil and plant references supports these observations . We understand that the 86± acre site is to be divided into thirteen ( 13 ) residential lots ranging in size from 5 . 0 to 7 . 0 acres . The purpose of this investigation is to identify potential geologic hazards and potential mineral resources which may conflict with the development intended. The conclusions and recommendation presented in this report are based upon the acquired field data, review of the available literature, and previous experience with similar geologic conditions in this area. SITE DESCRIPTION The site is located along the south boundary of the Kersey Town Limits and east of Weld County Road No. 53 . The site consists of south and east sloping, rolling terrain vegetated with grasses, brush and cacti . Three ( 3 ) gas wells and underground pipelines are located on the property. The Latham Ditch is located at the southeast and northeast corners of the property. 1 910750 SITE INVESTIGATION The site was visually inspected on March 10, 1994 . The locations of geologic features are approximate and should be considered only to the degree implied by the methods used to make those measurements . GEOLOGY The proposed site lies at the eastern edge of the Colorado Piedmont Section of the Great Plains Physiographic Province. The Colorado Piedmont is an elongated trough in the Great Plains, adjacent to the Front Range of the Southern Rockies . The Colorado Piedmont was formed when uplift of the area in Miocene-Eocene times (20-50 million years ago) produced an increase of stream erosion resulting in scouring next to the foothills and outlying areas . The Piedmont is bordered by the southern Rockies to the west, Great Plains escarpment to the northeast, and Palmer Divide to the south. Structurally, the site lies in the Denver Basin, which is a thick accumulation of Paleozoic and Mesozoic Era sediments involved with down warping in the basin area and uplift of the adjacent highlands . It is our understanding that faulting has not taken place in the recent historic past in this area. This area is classified as being in Seismic Zone 1 . 2 91.0750 The upper Cretaceous Laramie Formation underlies the site. The Laramie Formation is comprised of claystone, siltstone, sandstone and major coal beds . The thickness of the Laramie Formation is in the order of several hundred feet at the site . POTENTIAL GEOLOGIC HAZARDS AND RECOMMENDATIONS Potential geologic hazards at the site include potentially swelling bedrock and high groundwater levels . The claystones of the Laramie Formation and associated soils have swell potentials . The effects of the potentially swelling soil and rock can be minimized by careful planning prior to construction at the site. A geotechnical investigation should be conducted at each site or for the subdivision as a whole to identify these conditions . The sandstones of the Laramie Formation have been described by the Colorado Geological Survey as a potential uranium source. The degree of potential radioactivity affecting homes will depend on the presence and depth of underlying uranium bearing rock and the construction of the homes . Uranium will eventually decay into radon isotopes, a potentially hazardous gas which could infiltrate structures . We recommend that preliminary radon mitigation measures be incorporated in the construction after a routine living condition has been established in the homes, addressing further remedial measures . 3 9?0750 The far southeast corner of the site may have high groundwater levels and/or flooding conditions . The geotechnical investigation conducted prior to construction at the site should address these conditions . SOIL DESCRIPTIONS The Soil Conservation Service describes three ( 3 ) different soil types at the site. A map showing the locations and a description of the soil are included at the end of this report. Most of the soils are sands which have slight limitations for septic systems . Cutbanks in the sands will tend to cave . A minor area at the southeast side of the project may have severe limitations for construction due to flooding. POTENTIAL MINERAL RESOURCES The Colorado Geological Survey describes this site as not having any potential sand, gravel, or quarry aggregate resources . CONCLUSION Potential geologic hazards are located in various areas of the 4 91,0750 property. Care should be taken in choosing each building site and designing the roadways . Follow up inspections and recommendations should be conducted as necessary for each building site. Economic mineral resources were not found in the property. In conclusion, we feel that the development intended is compatible with the geologic conditions at the site provided the recommendations in this report are met. The data presented herein were collected to help determine the feasibility of this project . Professional judgments on design alternatives and criteria are presented in this report . These are based on evaluation of technical information gathered, partly on our understanding of the characteristics of the development proposed, and partly on our experience with geologic conditions in the area. We do not guarantee the performance of the project in any respect, only that our engineering work and judgments rendered meet the standard of care of our profession. We recommend that construction be continuously observed by a qualified soils technician trained and experienced in the field to take advantage of all opportunities to recognize some undetected conditions which might affect the performance of the structures . 5 91.0750 LIST OF REFERENCES 1 . Mike Guttersen stated they had 87 acres adjacent to the Town of Kersey and they would like to subdivide into 13 lots for residential use. Bud Clemons asked the price range for the residences. Mr. Guttersen stated the minimum price would be $80,000 and up. Judy Yamaguchi asked if there would be covenants. Mr. Guttersen stated there would be. Marie Koolstra asked how the Town of Kersey reacted to the proposal. Mr. Guttersen stated that they had tried to negotiate with the Town for an annexation but he felt the town was not interested. The Chairperson asked if anyone in the audience would like to speak for or against the application. Richard Sitzman, surrounding property owner, stated that he felt this proposal would be a welcome addition to the community. Cynthia Zeren, representative for C.F.G. Energy, Inc. , stated that the mineral owners on the case were not contacted about this meeting. Ms. Zeren stated that C.F.G. Section 10.2. 4 of the Weld County Subdivision Ordinance indicates streets shall be designed in relation to existing or planned streets.
