D. 19 92 , 19 , are erroneous, illegal, or due to error in valuation for the following reasons: a. The fact is that the legislation did not contain an "effective" date but rather only an "approval" date. To make a law retrospective by administrative pronouncement rather than by legislative act is unlawful and unenforceable. b. Prior to June 2, 1992, when the Governor approved Senate Bill 92-101, the Assessor utilized historical aging and number of sales in arriving at an appropriate market absorption rate. Without the benefit of supporting legislation, the State of Colorado Property Division, as approved by the State Board of Equalization, in 1992, changed to a data collection period which goes back only 18 months from the time of assessment. This is unlawful as it constitutes legislation by administrative act and therefore is unenforceable. There has been no enabling legislation prior or subsequent to the administrative modification of the absorption rate. All 1992 valuations of properties listed on Exhibit "A" should be modified or abated to conform to 1991 valuations. The taxes (have) (have not) been paid. Miller, Deputy Clerk to the Board Subject: Tax Abatement Petition - Lake Arrowhead, Inc. Per the recommendation of Bruce Barker, County Attorney, this memorandum is a recollection, to the best of my knowledge, of the telephone conversations with Roy Lundvall regarding the rescheduling of the attached tax abatement to April 12, 1993, at 9:00 a.m. , per Warren Lasell's instruction. I spoke with Mr. Lundvall who requested the original tax abatement hearing originally scheduled for March 15, 1993 be rescheduled to a date after the 7th of April because Charles Karowsky, representing Lake Arrowhead, Inc. , would be out of town until then. After confirming the date of April 12, 1993 with Mr. Lasell and Mr. Lundvall, a memo of confirmation was sent to Mr. Lasell, which is our normal office procedure. Our office procedure does not include reconfirming in writing to the petitioner. Note: Mr. Karowsky's letter, dated March 8, 1993, was not received in our office until March 15, 1993.
