RE: ASSESSMENT OF COSTS OF IMPROVEMENTS FOR WELD COUNTY BASSWOOD AVENUE LOCAL
IMPROVEMENT DISTRICT N0. 1990-2
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, in accordance with CRS, Section 30-20-607, as amended, a statement
of expenses and apportionment has been filed with the Weld County Clerk to the
Board by the Weld County Engineer, and
WHEREAS, pursuant to CRS, Section 30-20-608, there has been proper notice
of this hearing and of the costs of the improvements, and the share to be
assessed to each lot, and
WHEREAS, the Board of County Commissioners finds that the properties
described herein, which includes Lots 2 and 12 of Brenckle Subdivision; Lots 10
and 11 of the First Addition to Brenckle Subdivision; Lots 1, 4, 5, 6, 7, 8, and
9 of the Second Addition to Brenckle Subdivision; and a parcel of land conveyed
to Jack T. and Christine A. Fetig by Warranty Deed on July 23, 1979, Reception
No. 1797594, have been specifically benefitted by the construction of the
improvements authorized under the Resolution of November 14, 1990, for the
following reasons:
A. The market value of each of the properties will increase;
B. The proposed improvements will adapt the property to a more
profitable use;
C. There will be an alleviation of fugitive dust, eliminating the
health hazards to the benefitted properties and to users of the
public roads to be improved;
D. The alleviation of fugitive dust will reduce maintenance costs to
the subject properties and paving will lessen the maintenance
required for a public road; and
E. The proposed improvements will facilitate access to each of the
properties and thereby increase the convenience of the use of said
property.
WHEREAS, copies of the Resolution creating this Local Improvement District
have been provided to the Division of Local Government and the Weld County
Treasurer and Assessor, and

WHEREAS, at the time and place set forth in the notice, the Board of County
Commissioners met in open session for the purpose of hearing and considering any
complaints, objections, and protests that might be made against the proposed
assessments and there being no protests, complaints, or objections, and
WHEREAS, the Resolution shall be prima facie evidence of the fact that the
property assessed is benefitted, the amount of the assessment, and that the
assessment has been lawfully levied.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado:
A. That a local improvement district for the construction and
installation of street improvements, to include shaping, grading,
drainage, preparation of the base and grading, compaction, and
paving, together with any necessary incidentals on a certain County
Road as hereafter described, was created and established in
accordance with the laws of the State of Colorado, and is known as
"Weld County Basswood Avenue Local Improvement District No. 1990-2."
All proceedings heretofore taken by the Board of County
Commissioners and the County staff and then adopted in connection
with the district are hereby ratified, approved and confirmed. The
proposal to create said district was initiated by the Board of
County Commissioners by Resolution of October 3, 1990, upon a
petition, proper in form, subscribed by a majority of the owners of
property who will bear the cost of more than 1/2 of the total
proposed assessment in the district and notice duly given as
heretofore stated.
B. That the property to be assessed for said improvements shall be the
properties specifically benefitted by said improvements and more
particularly described as follows:
The area to be included within the district includes Lots 2 and 12
of Brenckle Subdivision; Lots 10 and 11 of the First Addition to
Brenckle Subdivision; Lots 1, 4, 5, 6, 7, 8, and 9 of the Second
Addition to Brenckle Subdivision; and the parcel of land conveyed to
Jack T. and Christine A. Fetig by Warranty Deed on July 23, 1979,
Reception No. 1797594, being more particularly described in Exhibit
"B", attached hereto and incorporated herein by this reference.
C. That the Statement of Expenses and Apportionment, attached hereto
and incorporated herein by this reference as Exhibit "A", has been
submitted based upon the fact that there has been completion of the
entire local improvement as previously authorized.

D. That the assessment of $959.05 per lot or parcel being levied for
the improvements shall be due and payable within thirty (30) days
after the effective date of this assessing Resolution. However, all
such assessments may be paid at the election of the owner in ten
(10) equal annual installments of principal together with
installments of interest on unpaid installments at an interest rate
of nine percent (9%) simple interest per annum. The first of said
installments of assessment shall be due and payable at the same time
as ad valorem property taxes for the year 1991, due and payable in
1992, and similarly in each successive year thereafter until all are
paid in full.
E. Cost of the improvements assessed to property within the District is
$11,508.34.
F. The Clerk to the Board shall prepare a local assessment roll, in
cooperation with the Weld County Treasurer and Accounting
Department, in a form showing in suitable columns, each parcel of
land assessed, the total amount of assessment, the amount of each
installment of principal and interest if, in pursuance of Part 6 of
Article 20 of Title 30, CRS, the same is payable in installments,
and the date when each installment will become due, with suitable
columns for use in case of payment of the whole amount or of any
installment or penalty, and shall deliver the same, duly certified,
under the County seal, to the County Treasurer for collection.
G. Failure to pay the whole assessment prior to September 31, 1991,
shall be a conclusive determination and held to be an election on
the part of all persons interested, whether under disability or
otherwise, to pay in such installments. All persons so electing to
pay in installments shall be conclusively held and considered as
consenting to said improvements. Said election shall be
conclusively held and considered as a waiver of any right to
question the power or jurisdiction of the County to construct the
improvements, the quality of the work, the regularity or sufficiency
of the proceedings, the validity or correctness of the assessments,
or the validity of the lien thereof.
H. That all Resolutions or parts thereof in conflict with this
Resolution are hereby repealed.
I. Failure to pay any installment, whether principal or interest, when
due shall cause the whole of the unpaid principal to become due and
collectible immediately, and the whole amount of the unpaid
principal and accrued interest shall thereafter draw penalty
interests at the rate of one percent per month from the first day of
May until the day of payment, or until the day of sale. In
computing the amount of penalty interest due under this section, any
portion of a month shall be counted a whole month.

J. That all Resolutions or parts thereof in conflict with this
Resolution are hereby repealed, but all portions of the Resolution
indicating the intent to create the District not in conflict with
the provision of this Resolution are re-enacted as if set forth
herein.
K. The effective date of this Resolution shall be September 1, 1991.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 21st day of August, A.D. , 1991.

The Board of Weld County Commissioners, on August 21, 1991, approved the
Weld County Basswood Avenue Local Improvement District No. 1990-2.
Pursuant to the Resolution, your lot or parcel has been assessed $959.05.
You may pay this amount to the Weld County Treasurer prior to September
31, 1991. When making your payment, please advise the Treasurer's Office
that the payment is for the assessment concerning the Basswood Avenue
Local Improvement District.
Should you choose not to pay in full by September 31, 1991, you will pay
in ten (10) equal annual installments of principal together with
installments of interest on unpaid installments at an interest rate of
nine percent (9%) simple interest per annum. A copy of the amount of
installments due is enclosed. This amount will be separately billed to
you after January 1, 1992, along with your property taxes. Please note
that the interest will accrue in full on January 1 of each year.

STATEMENT OF COST; AND PORTION TO BE ASSESSED UPON EACH LOT

All owners of real estate and property hereinafter described and all
persons generally, are hereby notified that the Board of County
Commissioners of Weld County, Colorado, has received a Notice of
Completion, Statement of Expenses, and Apportionment regarding the Local
Improvement District, within unincorporated Weld County, Colorado,
designated as Weld County Basswood Avenue Local Improvement District. No.
1990-2, all in accordance with the laws of the State of Colorado. The
property within the Local Improvement District is described as follows :

1. All persons are further notified that the whole cost of the
improvements as has been completed is to be $11,508.34 which excludes
any costs which have been assumed by the. County in terms of
engineering, and administrative fees. The costs to be apportioned to
the landowners are the costs of the labor and materials for
installation of hot bituminous pavement and base preparation which is
to be apportioned equally among the 12 lots and tracts in an
apportionment of $959.05 per lot or tract. No portion of thecosts
will be paid by a district-wide sales tax.
2. Any owner of the affected lots may file a complaint or objection in
writing addressed to the Weld County Board of County Commissioners,
915 10th Street, P.O. Box 758, Greeley, Colorado 80632, which
objection must be filed within twenty (20) days from the publication
date of this notice. Any complaint or objection properly made will
be heard and determined by the Board of County Commissioners before
the passage of any Resolution assessing the costs of the
improvements.
3. The hearing where such complaints or objections will be heard will be
on the 21st day of August, 1991, at or about 9:00 a.m. , in the First
Floor Meeting Room of the Centennial Center, 915 10th Street.,
Greeley, Colorado.
