HomeMy WebLinkAbout921113.tiff RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A MEETING HALL IN THE A (AGRICULTURAL) ZONE DISTRICT - HOWARD FARMS, A COLORADO PARTNERSHIP WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 25th day of November, 1992, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Howard Farms, a Colorado Partnership, 8709 Weld County Road 4, Brighton, Colorado 80601, for a Site Specific Development Plan and Special Review Permit for a meeting hall in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the SE! of Section 28, Township 1 North, Range 67 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Bill Hughes, Attorney, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive Plan's Urban Growth Boundary Area Goals and Policies. The City of Northglenn, Department of Community Development, has reviewed this proposal and has no objections to the request. b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c. The uses which would be permitted will be compatible with the existing surrounding land uses which include agricultural production, oil and gas production, and oil and gas processing, and with the future development of the surrounding area as permitted by the existing zoning. The applicant has demonstrated that a diligent effort has been made to conserve productive agricultural land in the locational decision for the proposed use. e. No overlay districts affect the site. f. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a meeting hall in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Within 90 days of approval by the Board of County Commissioners, the applicants shall provide evidence to the Department of Planning Services' staff that the following Conditions of Approval, as set forth by the Brighton Fire Protection District, have been met: a. A 20-foot wide all weather driving surface roadway shall be provided to allow for fire department vehicle access. Should this roadway exceed 150 feet in length and terminate in a dead-end, a turn-around area must be provided for the fire department vehicle. b. The proper road or street address shall be placed near the entrance to the access roadway. The numerals shall be a minimum of 5-inches in height with a 3/4-inch wide stroke. The background for the numerals shall be contrasting in color. c. A minimum of one fire extinguisher shall be provided and mounted within the structure for every 3, 000 square feet of floor area with a minimum of two extinguishers required. Extinguishers shall be rated at 2A-40BC and shall be mounted 3 to 5 feet above the floor surface. Should a single open unseparated area exceed 5, 000 square feet, a fire sprinkler extinguishing system shall be required. If area separations are included, they must be a minimum of one-hour fire rated construction. e. The maximum occupancy load shall be posted and enforced at all times the facility is being utilized for the A-3 type occupancy. f. A minimum of two exits shall be provided. The two exits shall be a minimum distance apart equal to one-half the length of the diagonal distance across the open area of the building. g. Exit doors shall swing in the direction of travel from the building, shall be marked by exit signs which are illuminated or provide self-illumination, and must be openable from the inside without the use of a key or special knowledge and must be provided with panic type operational hardware. 4. Prior to recording the Special Review Permit plat, the plat shall be amended to show all structures on the permitted area. Webs er 921113 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS HOWARD FARMS, A COLORADO PARTNERSHIP USR #980 1. The Site Specific Development Plan and Special Review Permit is for a Meeting Hall in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4. No permanent disposal of wastes shall be permitted at this site. 5. The water and sewage disposal facilities in the building shall be maintained in working order. 6. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 7. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 8. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 9. Personnel from the Weld County Health Department, Brighton Fire Protection District, and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 10. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 11. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Lanell Swanson The following business was transacted: I hereby certify that pursuant to a notice dated October 26, 1992, and duly published November 12, 1992, in the Windsor Beacon, a public hearing was conducted to consider the request of Howard Farms for a Site Specific Development Plan and Special Review Permit for a meeting hall in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Lanell Swanson, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record as written. Bill Hughes, Attorney, represented the applicant and stated they have met all criteria. He stated the building will be an asset to southern Weld County. In response to questions of Commissioner Lacy, John Howard, partner of Howard Farms, said the water is provided by Mountain View Water System, and the septic system is a tank system, which has been approved by the Health Department. After discussion concerning food, it was decided there are no requirements by the Health Department since the food is catered. There was no public testimony offered concerning this matter. Commissioner Lacy moved to approve the request of Howard Farms for a Site Specific Development Plan and Special Review Permit for a meeting hall in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Kirby, and Commissioner Webster said he appreciates the building and feels it will be an asset to the area. The motion carried unanimously. Mr. Hughes asked whether the Board would consider refunding Mr. Howard's application fee. The Board decided against the refund. This Certification was approved on the 30th day of November, 1992. Bill Hughes, Attorney, representative for Howard Farms, explained this building has been used in the past for 4-H meetings, birthday parties, wedding receptions, and family/neighbor gatherings because there are no facilities available in this area. Judy Yamaguchi asked if there were plans to rent this facility. John Howard, applicant, said no, this was for private/social use only. Bill O'Hare asked how this application had come about if the building was already on the property. Lanell Swanson explained this use is considered a meeting hall which is not allowed without a Special Review permit in the Agricultural zone district. John Howard explained this building was a very nice pole barn with steel siding and a bathroom inside. Bill O'Hare asked why water and sewer wasn' t addressed in this application since the public, through private invitation, would be using these facilities. Lanell Swanson agreed stating a new Development Standard could be added to the original application to address this issue and read proposed Development Standard Number 5 " water and sewage disposal facilities in the building shall be maintained in working order. " The remaining Development Standards could be renumbered. The Chairperson asked if the applicant was in agreement with the Planning staff' s recommendation. John Howard said yes. NOTARY PUBLIC My commission expires 11/24/93 6 du199.2 1 921.113 DESCRIPTION OF PROPOSED OPERATION OF USE OF THE HOWARD FARMS BUILDING AND AREA Howard Farms, a Colorado partnership, comprised of Donald Gary Howard, David E. Howard and John Edward Howard, is requesting a Use by Special Review Permit for approximately 10 acres of a parcel containing approximately 98 acres, including a utility and machine shed, located on the partnership farm property located at 8709 Weld County Road 4, Brighton, Colorado 80601. The Use By Special Review Permit area is located on the SE 1/4 of Sec. 28, T. 1 N. , R. 67 W. of 6th P.M. See a copy of the Warranty Deed marked Exhibit "A". 1. The proposed use of the building is for 4-H meetings, Water Board Meetings, grange meetings, political meetings in south Weld County, Colorado, wedding receptions and other civic related matters. However, the building primarily will continue to be used for agricultural purposes for the farming operation. 2 . The need for use is that there is a lack of meeting places in the local area for civic related matters and the facility in general is a tremendous benefit to the local community. 3 . The surrounding properties located near the Howard Farms partnership are tenant homes located on the partnership property which is comprised of approximately 100 acres in this quarter of the section and a natural gas plant owned by Vessels Oil Company. From the Howard Farms agricultural shed, which is being considered by use by special review permit, it is one-half mile distance southeast to the residence of Kenneth and Clifford Wagner; three-fourths of a mile east to the residence of Arnold Grenemeyer; three-fourths of a mile north to a tenant of Howard Farms and three-fourths of a mile to a tenant 's home west of Howard Farms. 4 . The agricultural shed being proposed for use by special review permit is capable of a maximum number of 99 users, patrons, members, etc. , however, generally the facility will be used for 30 to 50 individuals. 5. There are no employees or shifts, and no specific hours of operation as the building is used primarily by Howard Farms for general agricultural usage including repair of machinery and storage of veterinarian supplies, seed and twine. 6. The water source for the proposed use is provided by Mountainview Water, a community water system serving approximately 110 rural families in South Weld and North Adams Counties area. Please see the attached letter of Joe Trostel, President, Mountainview Water, marked Exhibit "B". 7. The access routes to be utilized for the proposed use are from Weld County Road 4 . 8. It is expected that the type and frequency of vehicular traffic associated with the proposed use will be automobiles owned by local residents and elected officials. It is expected that there may be as many as 40 cars at any one time parked on the Howard Farms property. Approximately one-half acre has been designated for parking regarding the Use By Special Review Permit area. 9 . The type of sewage facility for the proposed use is a septic tank. The Weld County Department of Health has approved the system. Please see the copy of letter from Jeffrey L. Stoll, Environmental Protection Specialist, Weld County Department of Health, dated May 11, 1992, marked Exhibit "C", and the copy of Memorandum from Environmental Protection Services dated May 11, 1992, to Weld County Planning Department, marked Exhibit "D" . The septic system is located on the east side of the building, and the leech field runs north and is not in an area of traffic. 10. The fire protection associated with the proposed use is provided by the Brighton Fire Department, and there is adequate protection for the health, safety and welfare of the inhabitants of South Weld County who use the property. 11. There will be no animals on the use by special review area at any time. 12 . Additionally, there will not be any storage area associated with the proposed use or storm water retention facilities associated with the proposed use. All the debris, junk and other waste associated with the proposed use will be removed within 12 hours and taken to a landfill. 13 . There is no proposed landscaping plan for the proposed use, as gravel has been placed in the driveway which will prevent erosion of the soil, which is vona loamy sand as per the Soil Survey of the U. S. Department of Agriculture Soil Conservation Service of Weld County, Colorado. The soil on the proposed site is a deep, somewhat excessively drained soil, and potential native vegetation is dominated by sand reedgrass and blue grama. 14. At the present time there is no plan of reclamation upon cessation of the use by special review activity as it is intended that Howard Farms will continue to allow public meetings to be held at the site as long as they own the real property. 15. The applicants expect that the startup of the proposed use could commence within 60 to 90 days upon approval by the Weld County Board of Commissioners. 16. The proposal is consistent with the Weld County Comprehensive Plan as the applicants intend to continue to farm the land, and the site of the proposed Use by Special Review does not 2 92_1113 remove any land from production as it is located between the applicant's homes and other farm buildings. Furthermore, the proposal would be consistent with the efficient and orderly development of the land as the applicants will be utilizing Mountainview water and a septic sewer. The water supply is adequate in terms of quantity, quality, and dependability. 17. The Use By Special Review Area is not located in a flood plain, geologic hazard or Weld County Airport Overlay District Area. 18.
