NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1. A Weld County septic permit is required for the proposed home and its septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. Cesspools are specifically prohibited by Section 7.5 of the Individual Sewage Disposal System Regulations. 2. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Regulations. The parcel of land is described as part of the SE4 of Section 36, T5N, R65W of the 6th P.M. , Weld County, Colorado. The property is located north of Weld County Road 50, west of Weld County Road 49. This request is to divide a 117 acre parcel, which is Lot B of Recorded Exemption 899, into two lots of 112 acres and 5 acres, more or less. The proposed larger lot contains two homes and a dairy and is served by Central Weld County Water District and septic systems. The proposed smaller lot has no existing improvements. Water and sewer service for the proposed smaller lot are proposed as Central Weld County Water District and a septic system. It is the opinion of the Department of Planning Services' staff that this application should be denied. Five recorded exemptions have been approved in this section since 1973, two of which have been submitted by these applicants. The 117 .5 acre lot in question is Lot B of Recorded Exemption 899, which was approved in 1986. Recorded Exemption 899 created a 5.4 acre parcel and this 117 acre parcel. The other four recorded exemptions in this section have created 8 additional parcels. As shown on the attached aerial photograph, there are now 12 parcels of land in this section. The level of development and the potential for continued divisions occurring in this section warrants concern. The Board should be aware of the development pattern that has occurred in this area and should consider whether it wishes to allow this type of piecemeal development to continue. Development in this area is reaching a level where continued divisions may evade the intent and purpose of the Weld County Subdivision Ordinance. Increased residential development in rural areas requires more urban-type services such as road maintenance, snow removal, utilities, sheriff and fire protection and school busing.
