RE: EXCHANGE OF CONTROL AND MAINTENANCE OF STATE HIGHWAY 392
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, pursuant to the provisions of 43-2-101(4) (a), C.R.S. , the State
of Colorado has controlled and maintained 18 miles of roadway known as State
Highway 392 from State Highway 37 easterly and northeasterly to its intersection
with State Highway 14, and
WHEREAS, approximately 9.5 miles of the 18 miles of State Highway 392 are
gravel road on unstable soils, and normal gravel maintenance procedures have not
given satisfactory results, and
WHEREAS, the State of Colorado desires to remove the above described
18-mile portion of State Highway 392 from its highway system, and
WHEREAS, the above described 18-mile portion of State Highway 392 is still
necessary for use as a public roadway, and
WHEREAS, Weld County can pave the 9.5-mile-gravel portion of State Highway
392 to County standard at significantly less cost than the State, and
WHEREAS, the cost to Weld County to pave the 9.5-mile portion is estimated
to be $1, 700,000, and the State has indicated it will enter into a contract with
Weld County to provide the funding.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Weld County will accept and maintain the 18-mile portion
of State Highway 392 described above, and pave the 9.5-mile-gravel section; Weld
County will enter into a contract with the State by which funding will be
provided to Weld County according to the following schedule:
1993 $ 100,000 Engineering
1994 800,000 Construction
1995 800,000 Construction
TOTAL $1. 700,000
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is
authorized to sign any documents necessary to effectuate this exchange, and this
exchange shall become effective upon approval by the Colorado State
Transportation Commission.
