TO SIGN EASEMENT WITH MOORE AND BRIGGS FOR GRAVEL IN SECTION 25, TOWNSHIP
1 NORTH, RANGE 67 WEST, CONTAINING 5.50 ACRES, MORE OR LESS, FOR USE OF
ROAD DISTRICT NUMBER TWO:
BE IT RESOLVED, by the Board of County Commissioners of Weld
County, Colorado, that they sign Easement with Moore and Briggs for
surface gravel located in Section 25, Township 1 North, Range 67
West of the 6th P. M. , Weld County, Colorado, more particularly described
as follows; to-wit:
Starting at the Southeast corner of property running
North along the West side of the Great Western Railroad
right-of-way a distance of 860 feet to point of beginning;
thence, West Northwest a distance of 940 feet; thence,
North Northeast a distance of 130 feet; thence, East 300
feet; thence, East 600 feet in an arc pattern along the
south side of the Great Western Railroad right-of-way
"Y"; thence, South 200 feet to point of beginning. The
described area marked at the points of mention by
iron grader blacb stakes; said tract contains 5i acres,
m/l. It is agreed that materials will not be taken below
water level.
Also, agreement for ingress and egress. The consideration is $1,650.00.
Reference is hereby made to the records of the Weld County Clerk and
Recorders Book 1529 at Page 503 .

THIS AGREEMENT, Made this 16th day of April A. D. 1959 ,
by and between MOORE & BRIGGS
of Weld County, Colorado, part of the first part, and Weld County, in the State of
Colorado, a municipality, party of the second part:
WITNESSETH: The part of the first part. orrand in consideration of One
l Thousand, Six Hundred and Fifty 1 -Dollars,
to first party in hand paid by the party of the second part, the receipt whereof is
hereby confessed and acknowledged, do hereby bargain, sell and convey unto the party
of the second part, its successors and assigns, the right to remove all gravel, sand
and road-making and building material which it shall be able to remove from the fol-
low described lands, situate in the County of Weld and State of Colorado, to-wit:
iTract of land located in Section 25, Township 1 North, Range 67 West:
Starting at the Southeast corner of property running North along the West
side of the Great Western Railroad right-of-way a distance of 860 feet to
point of beginning; thence, West Northwest a distance of 940 feet; thence,
North Northeast a distance of 130 feet; thence, East 300 feet; thence, East

Weld County, as a further consideration for this Deed and by acceptance thereof,
agrees that said tract of land shall be excluded from further assessment for taxes;
the first part hereby granting to the party of the second part the right to enter
upon said lands at any time hereafter and to excavate and remove therefrom all gravel,
sand and earthen material which it shall find suitable to its needs, together with the
rights and privileges incident to the proper enjoyment thereof.
This instrument shall give no title to said land, and shall only give the right
to remove therefrom the part of the surface thereof as hereinab ve set forth. This
contract shall be binding upon and inure to the benefit of the heirs, administrators,
and assigns of the part of the first part, and the successors and assigns of the
party of the second part.
