HomeMy WebLinkAbout920250.tiff RESOLUTION RE: APPROVE PURCHASE OF SERVICES AGREEMENT BETWEEN LARIMER COUNTY DEPARTMENT OF HUMAN DEVELOPMENT HELPMATE PROGRAM AND WELD COUNTY DIVISION OF HUMAN RESOURCES AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Purchase of Services Agreement between Larimer County Department of Human Development HelpMate Program and Weld County Division of Human Resources, with the terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Purchase of Services Agreement between Larimer County Department of Human Development HelpMate Program and Weld County Division of Human Resources be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized to sign said agreement. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 16th day of March, A.D. , 1992. Webster 920250 µ,a53 cc H R L,A-RJm R PURCHASE OF SERVICES AGREEMENT THIS AGREEMENT, made and entered into this a9t6 day of FEBRUA ty /99.2 , by and between the Weld County Board of Commissioners for the Weld County Division of Human Resources, hereinafter referred to as "Weld County," and the Larimer County Board of Commissioners for the Larimer County Department of Human Development HelpMate Program, hereinafter referred to as "Larimer County." WITNESSETH: WHEREAS, Larimer County during the past fiscal year has received a grant to provide emergency health and safety repairs in Weld County in conjunction with weatherization as a cost effective and efficient means of providing services to low-income individuals in Weld County. NOW THEREFORE, in consideration of the covenants contained herein, the parties hereto mutually agree as follows: 1. Larimer County agrees to provide HelpMate activities for a minimum of 60 eligible Weld County applicants, in accordance with Affordable Housing Program/HelpMate guidelines. 2. Larimer County and Weld County agree to designate a contact person for each agency to coordinate providing HelpMate services to low-income individuals in Weld County. 3. Larimer County agrees to provide Weld County with an annual report which will include the costs incurred during the year for all homes completed, the cumulative totals on costs incurred, the total number of homes completed, and the names of all Weld County participant homes completed. 920250 4. Weld County agrees to reimburse Larimer County $3,500 representing non-grant reimbursed services rendered by Larimer County for the HelpMate Program. These monies shall be distributed to Larimer County in four (4) quarterly payments beginning after the end of the first quarter this Agreement is in effect. 5. The term of this Agreement will be from F6$ . 29 . /9t2 through MAY 3 / , / 993 . 6. This Agreement may be amended or terminated giving thirty (30) days written notice to either party. This Agreement will terminate immediately in the event of a loss of funding to the program. 7. Larimer County agrees that it is an independent contractor and its officers, agents, or employees do not become employees of Weld County, and therefore are not entitled to any employee benefits as Weld County employees, as the result of the execution of this Agreement. Likewise, Weld County agrees that it is an independent contractor and its officers, agents, or employees do not become employees of Larimer County, and therefore are not entitled to any employee benefits as Larimer County employees, as the result of the execution of this Agreement. 8. Larimer County shall provide adequate liability and workers' compensation insurance for all its employees. Larimer County will provide adequate liability insurance for all its volunteers and agents engaged in the performance of this Agreement. 9. No officer, member, or employee of either Larimer County or Weld County, and no member of their governing bodies, shall have any pecuniary interest, direct or indirect, in the approved Agreement or the proceeds thereof. aeozso 4 C, C 10. Larimer County understands that monitoring and evaluation of the performance of this Agreement shall be conducted by the Weld County Department of Human Resources and the results provided to the Board of Weld County Commissioners. 11. Larimer County and Weld County assure that they will comply with Title VI of the Civil Rights Act of 1964 and that no person shall, on the grounds of race, creed; color; sex, or national origin; be excluded from participation in, be denied benefits of; or be otherwise subjected to discrimination under the approved Agreement. The Department of Weatherization, which serves both Weld and Larimer Counties, will be managing the HelpMate Program to help low-income families with emergency, health, and safety repairs. The goal of this project is to intervene with real help at an early point of the downward cycle of home deterioration, thus preventing major rehab, loss of housing stock for the low-income population, and the final problem of homelessness in our counties. The total HelpMate grant award is $82,312. Weld County, by the traditional usage of Weatherization, is expected to benefit from 59% of the funding, or approximately $48,564 of the grant funds. A minimum of 60 eligible families will be served. For these benefits, Weld County Division of Human Resources agrees to reimburse Larimer County $3,500 representing non-grant reimbursed services rendered by Larimer County for the HelpMate Program.
