RE: APPROVE EIGHT INTERGOVERNMENTAL AGREEMENTS WITH VARIOUS ENTITIES AND
AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with eight Intergovernmental
Agreements between Weld County, Colorado, and the following entities:
1. Town of Ault 5. Town of Erie
2. City of Firestone 6. City of Evans
3. Town of Platteville 7. Town of Johnstown
4. Town of Gilcrest 8. Town of Milliken
WHEREAS, after review, the Board deems it advisable to approve said
agreements, with the terms and conditions being as stated in said agreements, and
copies being attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the eight Intergovernmental Agreements between Weld
County, Colorado, and the abovementioned entities be, and hereby are, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said agreements.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 21st day of April, A.D. , 1993.

INTERGOVERNMENTAL AGREEMENT
THIS AGREEMENT, entered into this /� t h day of f11a j C k\ 1.9 I by and between
the BOARD OF COMMISSIONERS OF WELD COUNTY, COLORADO, a body p tic of the State
of Colorado, hereinafter called "the County," and the City of i , i1
a body politic, hereinafter called "the City."
WITNESSETH:
WHEREAS, pursuant to the Housing and Community Development Act of 1977, as
amended, hereinafter called "the Act. : the United States, acting by and through
the Secretary of the Department of Housing and Urban Development, hereinafter
called "HUD," is making available to the State certain funds for community
development activities as set forth in the Act: and
WHEREAS, the State of Colorado, through the Department of Local Affairs,
has the legal authority to provide funds to counties for community development
activities; and
WHEREAS, the City has expressed interest in allowing the County to operate
a Housing Rehabilitation Program within its jurisdiction; and
WHEREAS, the County has indicated a willingness to submit a program
proposal to the State to carry out the Housing Rehabilitation Program within
their jurisdiction; and
WHEREAS, the parties hereto desire to provide assurances and delineate the
areas of cooperation between the County and the City, with respect. to housing
rehabilitation activities.
NOW, THEREFORE, in furtherance of said resolution, and in consideration of
the mutual conditions, covenants and agreements herein contained, it is agreed
by and between the parties as follows:
1. Planning the housing rehabilitation program: the parties, through
their executives and staff, shall cooperate with each other in developing the
Housing Rehabilitation Program proposal, with all parties giving due
consideration to the needs of its citizens and goals, objectives, rules and
regulations of the Act;
2. Term of Agreement: this Agreement shall remain in full force and
effect until the program proposal is approved by the State and a contract is
executed by all parties. In the event the program proposal is approved by the
State, this Agreement shall remain in effect through the completion of program
activities;
3. Authorization to submit a proposal: the County is authorized to
submit a proposal to the State on behalf of the City to apply for State Loan
Grant Assistance Funds and to act on behalf of the City, with regard to any
subsequent negotiations, presentations or information in conjunction with the
grant application;
4. The City shall have no obligations or responsibilities, financial or
otherwise, concerning the administration of Weld County Housing Rehabilitation
Programs and the County agrees to indemnify the City from any and all liability,
loss or damage the City may suffer in connection with the administration of the
project upon approval of the proposal.

delineate the areas of cooperation between the County and the Town,
with respect to housing rehabilitation activities.
HOW, THEREFORE, in furtherance of said resolution, and in
consideration of the mutual conditions, covenants and agreements
herein contained, it is agreed by and between the parties as
follows:

parties, through their executives and staff, shell cooperate with
Cash other in developing the Housing Rehabilitation Program
proposal, with all parties giving due consideration to the needs of
its citizens and goals, objectives, rules and regulations of the
Act;
2. Term of Agreement: this Agreement shall remain in full
force and effect until the program proposal is approved by the
State and a contract is executed by all parties. In the event the
program proposal is approved by the State, this Agreement shall
remain in effect through the completion of program activities;

3 . Author' zation to submit a ro osal: The County is
authorized to submit a proposal to thS e tate on behalf of the City
to apply for State Loan Grant Assistance Funds and to act on behalf
of the Town, with regard to any subsequent negotiations,
presentations or information in conjunction with the grant
application;
4 . The Town shall have no obligations or responsibilities,
financial or otherwise, concerning the administration of Weld
County Housing Rehabilitation Programs and the County agrees to
indemnify the City from any and all liability, loss of damage the
City may suffer in connection with the administration of the
project upon approval of the proposal.
