IRRIGATION WATER CONVEYANCE AGREEMENT
Donald 0. Magnuson and Jeanette Magnuson, owners of Lot B
of Recorded Exemption No . 0803-1-2-RE1S83 as per nap recorded
March , 1994 in Book under Reception No. , Weld
County Records , being a portion of North Half (N2) of Section One
(1) , Township Six (6) North , Range Sixty-five (65) West of the
6th P .M. hereby agree to deliver one (1) share of Larimer and Weld
Irrigation Company water to Lot A of Recorded Exemption No .
0803-1-2-RE1583 (under 5 .5 shares of Owl Creek Supply and Irrigation
Company, we own and use on the above land) .
The consideration for carrying said water, as an easement only,
was included in the purchase price of land described in attached
Warranty Deed between Donald 0. Magnuson and Jeanette Magnuson,
Grantors, and Ronald Lee Humphrey and Judy K . Murray, Grantees ,
recorded in Book and Reception Number stated hereon.
It is the intent of this agreement that the owners of Lot A are
to pay any and all costs incurred by the owners of Lot B associated with •
• irrigation water requested by and delivered to the owners of Lot A.
However, the owners of Lot A are not to be assessed any ditch or
lateral maintenance or repair costs , but are to pay "carrying charges" ,
"water rent " charges, or ownership charges .
This agreement is also to be filed with the Owl Creek Supply and
Irrigation Company and the Larimer and Weld Irrigation Company.
This agreement shall inure to the benefit of the heirs, successor
and assigns of the parties .
