Home My WebLink About920493.tiff RESOLUTION RE: APPROVE AUTHORIZATION FOR ENGINEERING SERVICES WITH NELSON ENGINEERS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Authorization for Engineering Services, wherein Nelson Engineers agrees to subcontract with Tuttle Applegate, Inc. , under separate private agreement to provide technical services to the County, with the further terms and conditions being as stated in said authorization, and WHEREAS, after review, the Board deems it advisable to approve said authorization, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Authorization for Engineering Services, wherein Nelson Engineers agrees to subcontract with Tuttle Applegate, Inc. , under separate private agreement to provide technical services to the County, be, and hereby is, approved. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 3rd day of June, A.D. , 1992. Webster 920493 / �r^ D CO TY NELSON ENGINEERS ,7I? 5"1 - I FI I: 45 GREELEY NATIONAL PLAZA 822 7TH STREET GREELEY, COLORADO 80631 (303)356-6362 CLERK TO THE ROAD AUTHORIZATION FOR ENGINEERING SERVICES Weld County, Colorado herein named the Client, herewith authorizes NELSON ENGINEERS, Engineering Consultants, herein named the Engineer, to perform the engineering services described below and agrees to the terms thereof. Nelson Engineers agrees to subcontract with Tuttle Applegate, Inc. , under separate private agreement to provide technical services with regard to water rights, wetlands, and other specialized services. SCOPE OF WORK: The Engineer is requested and authorized to provide technical services to assist Weld County to obtain a Special Use Permit from Weld County, Colorado and a mining permit from the Mined Land Reclamation Division, Department of Natural Resources, State of Colorado, all in accordance with the published rules and regulations of those agencies for the purpose of mining and processing sand and gravel from the Weld County land as described herein. The said land on which said services are to be performed is described as those parcels owned by the client in the Northwest Quarter of Section 2, Township 2 North, Range 68 West, and the Southwest Quarter of Section 35, Township 3 North, Range 68 West in Weld County, Colorado, a total 170 acres . CHARGES AND PAYMENT: The Client agrees to pay the Engineer based on actual time spent on the project in accordance with the attached rate schedules for Nelson Engineers and Tuttle Applegate, Inc. The maximum total fee for the described scope of work shall be $13,000. All work completed through the last day of the month will be billed as of that time. Payment is due within 30 days thereafter. All accounts not paid within 30 days after billing date will bear interest at the rate of 1 1/2 percent per month, an annual average interest rate of 18 percent. TIME OF SERVICES: The services to be provided as proposed herein shall begin as soon as this authorization is executed, and will proceed in an expeditious manner, subject to schedules of the various agencies and commissions involved. INDEMNIFICATION: The client agrees to limit the Engineer' s liability to the Client, to the Owner, and to all construction contractors and subcontractors on the Project, due to the Engineer' s 920493 E4003/ negligent acts, errors or omissions such that the total aggregate liability of the Engineer to all those named shall not exceed $50, 000 or the amount of the Engineer' s total fee and compensation, whichever is greater, unless the Client requests and pays for a larger liability protection amount.
