This Resolution is forwarded for your information and file. If it is the desire of your board that the abandoned portion should remain public highway, your board should adopt the necessary resolution to add it to your county system as the 1953 Colorado Statutes Annotated, Chapter 202, Section 6 states. that the right-of-way of all abandoned portions of a state highway shall revert to the adjacent property owners, unless the abandoned portions are necessary for use as a public highway and a resolution so stating.is-adopted-by .the County Board of Commissioners within ninety days of the abandonment as a part of the State Highway System. Watrous Chief Engineer Department of Highways 4201 East Arkansas Denver 22, Colorado Dear Mr.Watrous: Receipt is acknowledged of your letter of May 19, 1955, in which you request my opinion upon a number of questions con- cerning Senate Bill No. 27, enacted by the 40th General Assembly, concerning re-routing of highways. You advise that answers to these questions are necessary so that your Department may proceed with its program of advance planning. Your questions fall into three general groupings and will be answered accordingly. QUESTION NO. 1: Do "existing filling stations , lunch rooms or other such businesses" located along highways qualify as "unincorporated business communities?" ANSWER: Senate Bill No. 27, approved April 4, 1944, pro- vides as follows: - "SECTION 1. It is declared to be the public policy of the state of Colorado that where the state highway commission has authorized a by- pass to be built around any incorporated city or town or unincorporated business community of the state of Colorado, regardless of the population of such city, town or unincorporated business community, the original state highway or state and federal highway markings shall re- main on the existing highway through such in- corporated city, town or unincorporated business community and the existing highway shall be main- tained, and the new by-pass highway shall carry the designation 'by-pass' or other similar markings." fir'//p 3� 3 • • i+,.v U +YE . 7,T2 • An examination of the above language and the use to wnich same is employed indicatea that the General Assembly in- tended to include within the purview of the act all established and existing communities , irrespective of their population or legal classification. By statute, to wit: 139-2-2 CRS 453 , the inhabitants of any community may incorporate themselves into any one of three classes of municipal corporations according to population. Cities of the first class must have a minimum - population of 25 ,000 persons; second class cities must have a population in excess of 2,000; and every municipal corporation _ having a population of 2,000 or "less is classified as an-in- corporated town. Therefore, the use of the words "unincorporated business community" clearly indicates an intention to include those established communities which have elected not to organize themselves into any one of the above mentioned classes of munici- pal corporations. However, in my opinion, this terminology is not broad enough to include isolated or scattered businesses of a proprietary nature, such as filling stations or lunch rooms , which are operated along highways independently of one another. Such scattered enterprises lack the necessary element of "community" existence. QUESTION NO. 2; Consolidating a number of your individual inquiries, your principal -question might be re-phrased as follows: • if the Commission authorizes the relocation of an existing state highway through an incorporated city or town or unincorporated business community, to by-pass said population center, may the depart- ment, in lieu of maintaining the established state highway through said center, build a new highway to connect such center directly with the relocated - - - - - or by-pass-highway?- - : - - -- ANSWER: Irrespective of the various refinements or possible conflicts that may be involved, it is clearly the intention of the legislature that existing state highways through these enumerated population centers remain open, maintained and marked as the principal route, and the department cannot abandon • same as the principal state highway route in favor of a direct highway to and from the new by-pass. The act does not prescribe or define the method, type, or location of the connections to and from the by-pass. Therefore, their connections may be as direct or indirect as good engineering and practical economy indicate. Arkansas Ave. , Denver 22, Colorado Dear Mr. Watrous: This will acknowledge receipt of your letter of recent date concerning a request by the Weld County Commissioners that you obtain an interpretation of this office of the so- called By-Pass Bill, to wit, Chapter 248, S.L. '55. You enclosed a copy of their letter and a Resolution respecting their maintenance of several miles of State Highway No. 3 , between the Adams-Weld County line (Baseline Rd. ) and its junction with State Highway No. 52 in the town of Fort Lupton. It appears from the correspondence that the Department re- located and rebuilt said highway parallel to but West of its old location and subsequently abandoned the old highway as a part of the State highway system by Resolution No. 356-C of the State Highway Commission, dated January 10, 1956. Apparently the County objects to such abandonment and contends that the above statute requires the Department to maintain this entire section of the old highway as a "by-pass". We regret that we cannot concur in this interpretation by the County. An examination of this statute, formerly analyzed in our Opinion (25-2$68) to you of October 14, 1955, clearly indicates that this law was designated to prevent the Department from abandoning those portions of its system which traverse or go through any established incorporated city or town or un- incorporated business community of this State. In that opinion we held that the term "unincorporated business community" was not broad enough to include isolated or scattered businesses of a /cf o 33 40 M.U.W. #2 proprietary nature, such as filling stations or lunch rooms, operated along highways independently of one another. WHEREAS, the abandonment of said section of highway would be of great damage to the public generally and particularly to the people of Adams and Weld Counties and would add greatly to the traffic burdens and hazards on the newly constructed Federal Aid Highway to the West thereof, and WHEREAS, said new constructed highway does not enter nor directly serve said City and Town, and said above mentioned "old portion" is absolutely essential to proper service of the public, and WHEREAS, under and by Session Laws of Colorado 1955, Chapter 248, page 752, it is the declared public policy of the State of Colorado that said original portion of said highway with the proper markings thereon shall be maintained by the State of Colorado, and WHEREAS, said County and said Town and the communities between Brighton and Fort Lupton do not have facilities available for the maintenance of said highway; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Weld County, Colorado, that the Highway Commission of the State of Colorado, be and it is hereby requested and urged to rescind forthwith its certain Resolution No. 356-C dated January 10, 1956, wherein it is recited that said portion of said "old highway" be abandoned as a part of the state highway system. Watrous Chief Engineer ' Colorado Department of Highways Denver, Colorado Dear Mark, We have had our attorney draw up a legal resolution in regard to our resisting taking over maintenance of the old "85" between Fort Lupton and Brighton. • His resolution, naturally from a legal mind, sounds rather cold. We, as Commissioners of Weld County, do not intend it that way. The Legislature passed a By-Pass Law which in our opinion is not too clear. Our whole object in our resolution is to clarify the law. It is our hope that through this appeal you can get an answer from the •lttorney • General to clear up the Legislative Act of 1955. If the Attorney General says it is our road, we will -certainly take over the maintenance. It is the hope of our board that this letter or resolution not be . antagonistic. We have had very congenial working relations with your depart- ment and we do not want to jeopardize a good working relationship between the two departments.
