RESOLUTION
RE: ACTION OF BOARD AT SHOW CAUSE HEARING CONCERNING SPECIAL REVIEW
PERMIT #690 - ED LOLOFF/LOLOFF CONSTRUCTION, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, on August 24, 1994, a Show Cause Hearing was conducted to consider
revocation of Special Review Permit #690, issued to Ed Loloff/Loloff
Construction, Inc. , 145 3rd Street, Kersey, Colorado 80644-0518, and
WHEREAS, Ed Loloff is the owner of the facility located on property
described as part of the SE,' NW!, SI NE,' NW! of Section 4, Township 5 North,
Range 65 West of the 6th P.M. , Weld County, Colorado, and
WHEREAS, at said hearing on August 24, 1994, the Planning staff advised the
Board that the property is substantially in compliance, and
WHEREAS, after hearing all testimony presented, the Board deemed it
advisable to dismiss said Show Cause Hearing.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Show Cause Hearing concerning revocation of Special
Review Permit #690, issued to Ed Loloff/Loloff Construction, Inc. , be, and hereby
is, dismissed.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 24th day of August, A.D. , 1994.

The following business was transacted:
I hereby certify that pursuant to a notice dated June 15, 1994, and duly
published August 11, 1994, in the Windsor Beacon, a public Show Cause
Hearing was conducted to consider revocation of USR #690 held by Ed
Loloff/Loloff Construction, Inc. Lee Morrison, Assistant County Attorney,
made this a matter of record. Keith Schuett and Barry Kramer, Planning
Department representatives, were present. Mr. Schuett said staff
recommends the hearing be vacated because the property is substantially in
compliance. Responding to questions from the Board, Mr. Schuett explained
the buildings in violation have been removed and the plat and the fees for
the Amended USR have been submitted. (Let the record reflect that
Commissioner Harbert is now present. ) No public testimony was offered
concerning this matter. Commissioner Baxter moved to dismiss the Show
Cause Hearing concerning revocation of USR 1/690 held by Ed Loloff/Loloff
Construction, Inc. , based on the recommendation of the Planning staff.
The motion was seconded by Commissioner Hall, and it carried unanimously.
This Certification was approved on the 29th day of August, 1994.

This letter is to clarify the items that were agreed upon at the June 15, 1994,
Probable Cause Hearing to bring the property into compliance.
1. Have plat recorded for Amended USR-690. The plat needs to be submitted
and the $10 .00 per page recording fee needs to be paid.
2. Have a revised dust abatement plan submitted to and approved by the Weld
County Health Department. A copy of the approved plan needs to be
submitted to the Department of Planning Services.
3. Remove the remaining buildings being stored on the property, by August 17,
1994.
An item that was not discussed at the meeting but was included with the Probable
Cause information is the derelict vehicle being stored on the property. This
should also be removed from the property.
A Show Cause Hearing is schedule for August 24, 1994, to consider revocation of
USR-690 unless the items listed above have been completed by that date. Please
call or write me if these items are removed prior to that date so that I may
close the case prior to the Show Cause Hearing.

thereafter as the agenda of the Board of County Commissioners permits, the Board
of County Commissioners of Weld County will hold a Probable Cause public hearing
pursuant to Section 24.8.1 of the Weld County Zoning Ordinance. This meeting

Standard Number 18 states:
18. The property owner and/or operator of this operation shall be responsible
for complying with all of the above stated Standards. Noncompliance with
any of the above stated Standards may be reason for revocation of the
permit by the Board of County Commissioners.
The property owner and/or operator of this operation is not maintaining
compliance with all of the approved standards. Standards 1 and 17 are not in
compliance.
Amended Special Review Permit #690 was approved on July 8 , 1992. The conditions
of approval have not been met and the plat has not been recorded. Some
violations may be resolved if the conditions of approval are met and the amended
plat is recorded.

The modular buildings that are storage on the property at 8th Street and Balsam Ave.
is only temporarily stored there. They belong to DeJohn Housemover and will be
moved off the property in approx. 120 to 150 days.
