RESOLUTION
RE: APPROVE TERMINATION OF SUBSIDY FOR COURT FACILITIES BY WELD COUNTY,
COLORADO, PURSUANT TO SECTION 20(9), ARTICLE X, COLORADO CONSTITUTION AND
SECTIONS 29-1-304.5 AND 29-1-304.7, C.R.S. , AND DIRECT STAFF TO SEND
APPROPRIATE NOTICE
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, Weld County, Colorado, pays various subsidies for the provision
of and maintenance of court facilities at Greeley, Colorado, for the State of
Colorado 19th Judicial District, pursuant to Sections 13-3-108, 13-6-304, and
30-11-104, C.R.S. , and
WHEREAS, Weld County annually spends approximately $300,000 on maintenance
and janitorial services for the Weld County Courthouse, the Probation Services
Department, and the Weld County Law Library, and
WHEREAS, said amount does not include capital improvements and special
projects in and for the buildings, courtrooms, offices, and other rooms used by
the courts and their supporting services, and
WHEREAS, the 19th Judicial District has submitted to the Board of County
Commissioners ten requests for "special projects" for completion in the fall of
1994 and in 1995, and
WHEREAS, copies of said requests are attached hereto and are collectively
referred to herein as Exhibit "A, " and
WHEREAS, the Board of County Commissioners considers all requests for
capital improvements and special projects as "new mandates" (non-current
programs) for which Weld County is not required to reduce its responsibilities
and subsidies in three annual equal installments, but rather, may end said
subsidies immediately after 90 days notice, pursuant to Section 29-1-304.7,
C.R.S. , and
WHEREAS, the Board of Weld County Commissioners now desires to terminate
its subsidies for the above stated court programs, pursuant to the provisions of
Section 20(9), Article X of the Colorado Constitution and Sections 29-1-304.5 and
29-1-304.7, C.R.S.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the subsidy to be paid by Weld County, Colorado, for the
provision of court facilities for the 19th Judicial District at Greeley,
Colorado, including but not limited to, the Weld County Courthouse, the Probation
Services Department, and the Weld County Law Library, pursuant to provisions of
Sections 13-3-108, 13-6-304, and 30-11-104, C.R.S. , shall terminate on the dates
and in the amounts as follows:

BE IT FURTHER RESOLVED by the Board of County Commissioners that the Weld
County Attorney and the Director of Finance and Administration for Weld County
are hereby directed to prepare notification to the State of Colorado of Weld
County's intent to terminate said subsidy in accordance with the provisions of
Section 29-1-304.7, C.R.S. , for signature by all members of the Board of County
Commissioners and that such notice, if it may be dated prior to the date of this
Resolution, is hereby ratified.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 24th day of August, A.D. , 1994.
