RESOLUTION RE: APPROVE TEE SCHEDULE CONCERNING TEES CHARGED BY THE WELD COUNTY DEPARTMENT OF PLANNING SERVICES FOR PROCESSING AND REVIEWING LAND-USE PERMIT APPLICATIONS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, held a public hearing on the 23rd day of December, 1991, at 9:00 a.m. , in the Chambers of the Board for the purpose of considering an increased fee schedule for fees collected by the Weld County Department of Planning Services for processing and reviewing land-use permit applications, and WHEREAS, after study and review, the Board deems it advisable to approve the proposed fee schedule concerning said fees, effective January 1, 1992, a copy being attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the attached fee schedule for land-use permit applications he, and hereby is, -approved, to become effective January 1, 1992. The above and foregoing -Resolution was, on motion duly made and seconded, adopted by the following vote on the 23rd day of December, A.D. , 1991. Don Feldhaus asked if these fees take into consideration notification of public notices submitted to the newspaper. Chuck explained the fees do reflect the current cost of advertising in the legal newspaper. The issue being addressed today is whether the County should attempt to do a better job of notification. -This is a separate issue, and an item that needs to be discussed with the Board of County Commissioners. -Don Feldhaus moved the revised Fee Schedule for land-use applications be forwarded to the Board of County Commissioners with the Planning Commissions' recommendation for approval. Judy Yamaguchi seconded the motion. The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Chuck Cunliffe stated there had been concern about the November 3, 1992 meeting since that is National Election Day. In prior discussions three options were considered. Move it to the second week, delete it off the schedule, or move it to another day in that same week. The Planning staff recommends Thursday, November 5th as the first meeting date in November, 1992. Jean Hoffman motioned to move the November 3, 1992 Planning Commission meeting, which is election day, to Thursday November 5, 1992 and approve all other dates. Don Feldhaus seconded the motion. Two philosophies exist as to who benefits and should pay for the processing of applications. One point of view is that the applicant or resultant users are the beneficiaries of the processing and should pay the costs associated with the processing. Another point of view is that the applicant and community in general are the beneficiaries and that both should bear the costs of processing with application fees and dollars collected by general taxation. The fees recommended for 1992 were developed utilizing the philosophy that the applicant or developer benefits the most from the approval of the application and should pay for the processing. At present, the application fees charged do not cover all of the direct and indirect costs involved in the processing of land-use and development applications. The attached materials indicate the amount needed to recover 100% of the direct and indirect processing costs for each type of application and the recommended fees for 1992. The estimated revenue if collected, will offset approximately 48% of the Department's 1992 budget. The new fees are recommended to be effective January 1, 1992.
