in the records of the Weld County Clerk and Recorder, and

o WHEREAS, pursuant to Weld County's Oil and Gas Lease, said assignment must
x be approved by the Board of County Commissioners, and

WHEREAS, after consideration, the Board deems it appropriate to approve the

w NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the assignment of said lease from Randy Hrbek and John H.
N H Pivonka, to Smith Energy Corporation, be, and hereby is, approved.

Re: Farnik Lease
N/2 NE/4 35-7N-59W
Weld County, Colorado
Dear Bruce:
Per our telephone conversation this date, we purchased the
captioned 80 acre lease including one producing well in June of
this year. Please consider this letter an application for
assignment approval of the Board of Weld County Commissioners
A copy of the recorded assignment is included along with a check
for the processing fee.
Your last operator of record was Impact Energy. Impact Energy
sold the property to Southwest Sites, Inc. Southwest Sites sold
it to John H. Pivonka and Randy Hrbek. We purchased it from
Pivonka and Hrbek. At one time two wells, the Farnik #1 and #2
produced into a common tank battery on this lease. The Farnik #1
was abandoned before our purchase. Please note that the crude
oil purchaser, the Permian Corporation, refers to all crude oil
sales from the tank battery as Farnik #1. Therefore, the checks
all say Farnik #1, but all production is from the Farnik #2 .
Smith Energy Corp. has applied for and been approved as the
operator of this lease by the Colorado Oil and Gas Commission.
Please present this assignment to the Board of Commissioners for
approval.
